REPORT OF THE COMMISSIONERS


Appointed by the Court to make a Division of the Public Property between Dedham and Norwood.


The subscribers, appointed Commissioners under the provisions of the statute above named, have attended to the duties thereby devolved upon them, and have fully heard all the evidence submitted by the parties, and have duly and deliberately considered all matters of law and fact submitted to them ; and make this as their determinaton and adjudication in the premises.


The property claimed by the town of Norwood to be "corporate property," the valuation and proportions of which the Commissioners were called upon to determine, was as follows :-


1-A tract of land called the Common.


2-A tract of land opposite Memorial Hall.


3-Certain school-houses, and land therewith, and furniture, fixtures etc., thereto belonging.


4-Certain fire engines, engine houses, and land therewith, and appurtenances thereto belonging.


5-Certain gravel pits, containing materials for road repairs.


6-The Almshouse, Farm, and property thereto belonging.


7-Memorial Hall, and the lot of land on which the same stands.


The valuation of the fire engines, houses, and apparatus thereto belonging, was agreed by the parties at sums hereinafter stated.


We find and determine that the tract of land known as the Common is not "corporate property" of the town of Dedham, and is not to be included in the valuation and proportion to be made by us in the premises.


We find and determine that the lot of land opposite Memorial Hal is not corporate property of the town of Dedham, and is not to be in- cluded in the valuation and proportion to be made by us in the premises.

We find and determine the valuation of the school-houses, lands, and school property to be the sum of $60,670, of which $14,752 lies in and has been received by the town of Norwood, and the balance, $45,918 lies in, and has been received by, the town of Dedham.


We find and determine the valuation of the fire engines, houses, lands and property thereto belonging to be $12,536.50, of which $3,815 is and has been received by the town of Norwood, and the bal- ance, $8,721.60 is in, and has been received by, the town of Dedham.


The gravel pits are in and belong to the town of Dedham, and we determine their valuation to be $410.


The Almshouse, Farm and property thereto belonging are in and belong to the town of Dedham, and we determine the valuation there- for to be $9,500.


The building known as Memorial Hall, and erected under a vote of the town of Dedham, passed April 6, 1866, in which the objects of the structure are thus stated :


1st-"To provide a suitable place for the transaction of the publie business of the town.


2-To provide a suitable memorial of the soldiers of Dedham who died in the service of our country in the late war, or Rebellion."


The building, while it contains appropriate memorials of the pa- triotism of the sons of the entire town of Dedham in the war of the Rebellion, was mainly arranged as a town hall, with ante-rooms, offices, and other conveniences, for the transaction of municipal business. It was conceded by the town of Norwood that the patriotie and memorial element entered into the cost and design of this struefure, and that for this reason, some deduction should be made from its valuation, as indicated by its cost. Making due allowance in this respect, we deter- mine the valuation of the building to be $40,000, and of the personal property to be $910.


The lot of land upon which Memorial Hall stands we have not in- cluded in our valuation, because it was given to the town of Dedham by some of its citizens ; and as it cost the town nothing, we do not consider that it would be "just and equitable" that Norwood should receive. anything from Dedham on account of it, and because, also, we determine that the gift was a charitable one, to a charitable purpose. The hall was built by taxation, and neither of these reasons apply to that.

Mention was made of a certain fund called the Damon donation. This is a public charity, and we have not included it in our valuation of corporate property.


The whole amount of corporate property valued by us in the case is $123,826.50. . .


The agreed valuation of the town of Dedham, for the purposes of proportion, is $5,255,673.30, and that of the town of Norwood is $1,355,397.42.


Of the whole amount of corporate property valued by us, there would thus belong to Dedham, $98,738, and to Norwood, $25,088.50.


Norwood has received, and has of this corporate property, the sum of $18,567, as per schedule (A) annexed.


Dedham has received, and has of this corporate property, the sum of $105,259.50. as per schedule (B) annexed.


The town of Norwood is therefore entitled to receive from the town of Dedham, the sum of $6521.50, which we determine and adjudge to be its "just and equitable proportion of all corporate property" owned by the town of Dedham at the time of the passage of the Act under which these proceedings are instituted. But from this sum should be deducted the sum of $155.92, being its just and equitable proportion of the public debt of the town of Dedham at the time of the passage of the act aforesaid, leaving Dedham to pay to Norwood the sum of $6,365.58.


The costs of these proceedings, being the fees and expenses of the Commissioners, amounting to $1045, are to be paid equally by the towns of Dedham and Norwood, the petitioners in the case.
