For the Year Ending December 31st, 1939
Record of the Annual Town Meeting January 16th, 1939, with its adjournments.
Article I. To choose all necessary Town Officers, the fol- lowing officers to be voted on one ballot, viz: a Moderator for one year, two Selectmen for three years, two members of the School Board for three years, one member of the Planning Board for five years, one member of the Board of Assessors for three years, two members of the Finance Committee for three years, one member of the Finance Committee for one year to fill vacancy.
The polls will be opened at half past eleven o'clock A. M. for vote on the foregoing article, and will not be closed before eight o'clock P.M.
Meeting called to order at eleven o'clock in Precinct 1 by Warden B. J. Allan, Precinct 2 by Moderator Fletcher Clark and Precinct 3 by Warden Harlas L. Cushman. The polls were opened at 11:30 o'clock.

At this point a motion was presented by Mr. Millette that as it was apparent that it was the wish of the meeting to adopt the Budget as presented by the Finance Committee, that the Budget be voted in its entirety. The chair ruled that this motion was not in order. The chair stated that he would accept a motion on the remainder of the Budget providing each Department was read. Mr. Harding proceeded with a motion mentioning the items that are shown in report of the Finance Committee making a total of each department as follows:

A standing vote was taken in consideration of motion on Cash Grants of $10,500.00 under the Aid to Dependent Children De- partment. The result of the vote was: Yes, 347; No, 59.
The Finance Committee made recommendation on Article 2 in the form of a printed Budget.
Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.
Voted that the Town authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning Jan- uary 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chap- ter 44, General Laws.
Article 4. To hear the report of any committees or officers of the town; to appoint any committee, or take any action relative thereto.
Mr. George Donner presented the following report for the Union Street School Building Committee:
In accord with the recommendations in the report of the Com- mittee of Sixteen appointed in 1936 to study school building needs, the Town voted on March 8, 1937, to appropriate the sum of $105,573.00 for the purpose of financing the construction of, fur- nishing and equipping an elementary school building on the Union Street lot in accordance with the plans and specifications of the Frank Irving Cooper Corporation, and for acquiring any addi- tional land. The Selectmen were authorized to accept Federal assistance and to acquire by the right of eminent domain two parcels of land on the westerly side of Union Street, and by authorization of the same meeting a building committee of five members was appointed by the Moderator.
On November 12, 1937, bids for construction of the building were publicly opened and three days later the contract was awarded to the lowest builder, the D'Amore Construction Com- pany of Boston, for the sum of $81,725.00. On November 30, 1937, construction was started. On August 28, 1938, the com- pleted building was opened for public inspection.
Your committee feel that they have fulfilled their obligation in presenting to the Town a truly modern, eight room building, carefully constructed in every detail, properly furnished and equipped for use as an elementary school. The full cooperation of architects, general and sub-contractors, Federal Engineer, our own clerks of works, and Superintendent of Schools has made the work of the committee a genuine pleasure.
A carefully conducted financial program has allowed your committee to complete the building within the funds available and they are returning to the general fund of the Town an unexpended

balance of two hundred thirty-six dollars and seventy-six cents ($236.76). A detailed financial statement accompanies the re- port.
By the submission of this report your committee feel their duties are completed and do now humbly ask dismissal.

Voted to accept report of the committee and that committee be discharged and that committee be thanked for the good work they have done.
Article 5. To see if the Town will vote to raise and appro- priate for the use of the Plymouth County Trustees for County Aid to Agriculture, a sum not exceeding two hundred dollars ($200.00), and choose a Town Director for one (1) year, as pro- vided in Sections 41 and 45 of Revised Chapter 128 of the General Laws, or take any action relative thereto.
Voted that the Town raise and appropriate for the use of the Plymouth County Trustees for County Aid to Agriculture, the

sum of two hundred dollars ($200.00), and choose as Town Di- rector H. Arthur Standish for one year, as provided in Sections 41 and 45 of Revised Chapter 128 of the General Laws.
Article 6. To see if the Town will vote to raise and appro- priate by loan or otherwise a sum of money not to exceed four thousand dollars ($4,000.00) for the construction of that portion of Plympton Street extending from Eddyville to the Plympton Town Line, under Chapter 90 so-called, provided the State or the State and County will assist financially in the cost of this work, and act thereon.
Voted that the Town raise and appropriate the sum of four thousand dollars ($4,000.00) for the purpose of constructing Plympton Street between Eddyville and the Plympton Town line, under Chapter 90, so called, provided the State or the State and County will assist financially in doing this work.
Article 7. To see if the Town will vote to raise and appro- priate a sum not exceeding twenty-five hundred dollars ($2,500.00) for the purpose of constructing portions of either Thomas Street, Chestnut Street, Purchase Street, Old Center Street or Fuller Street under Chapter 90, so called, providing the State or the State and County will assist financially in the cost of this work, and act thereon.
No action taken on this article.
Article 8. To see if the Town will vote to authorize the Selectmen to petition the Legislature for a Special Act for the purpose of reorganizing the financial structure of the Water Department comparable to the financial set-up of the Gas and Electric Department, or take any action in relation thereto.

Article 9. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of the extension of water mains of not less than six inches in diameter to those parts of Middleboro known as Rock and South Middleboro villages in co- operation with the Federal Government as a W. P. A. project ; the appropriation to be raised by loan or otherwise, in accordance with Chapter 44, General Laws, subject to the adoption of Article 8, and act thereon.
No action taken on this article.
Article 10. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of the extension of water mains of less than six inches in diameter and for Water Depart- ment equipment to those parts of Middleboro known as Rock and South Middleboro villages, including Tispaquin Street, for a dis- tance of 1056 ft. (2/10 mile) from Wareham Street, in coopera- tion with the Federal Government as a W. P. A. project; the appropriation to be raised by loan or otherwise, in accordance with Chapter 44, General Laws, subject to the adoption of Article 8, and act thereon.
No action taken on this article.
Article 11. To see if the Town will vote to raise and appro- priate by loan or otherwise a sum of money for the purpose of extending the water main on South Main Street from the end of

the present main to the Lakeville town line, in cooperation with the Federal Government as a W. P. A. project, subject to the adoption of Article 8 and act anything thereon.
No action taken on this article.
Article 12. To see if the Town will raise and appropriate a sum of money to establish a Road Machinery account for the pur- pose of repairing and operating road machinery, and act anything thereon.
Voted that the Town raise and appropriate the sum of forty- two hundred dollars ($4,200.00) to establish a Road Machinery account for the purpose of repairing and operating road ma- chinery.
Article 13. To see if the Town will vote to raise and appro- priate a sum of money by loan or otherwise for the purpose of continuing the W. P. A. work, and act anything thereon.
Voted that the Town raise and appropriate the sum of fifteen thousand dollars ($15,000) for the purpose of continuing the W. P. A. work for the year 1939. Said appropriation to be spent under the direction of the Board of Selectmen.
Article 14. To see if the Town will vote to raise and appro- priate a sum of money not exceeding twenty-five hundred dollars ($2,500.00) for the purpose of constructing portions of East and Beach Streets and act anything thereon.
Voted that the Town raise and appropriate the sum of two thousand dollars ($2,000.00) for the purpose of constructing portions of East and Beach Streets providing the County or the County and State will aid in financing this work.
Article 15. To see if the Town will vote to appropriate a sum of money to pay the land damages caused by the re-location of the bounds of portions of Thomas, Chestnut, Purchase, Old Centre and Fuller Streets and act anything thereon.

Article 16. To see if the Town will vote to authorize the Board of Selectmen to lay out and accept West End Avenue and Warren Avenue, appropriate money for the repair of the same, and act thereon.

Article 17. To see if the Town will vote to transfer the unexpended balances in the following accounts to the Excess and Deficiency Fund as follows: Pumping Unit account $44.28, Pierce Street Water Mains $106.31, Sand Filter Unit $975.03, Police Cruising Car $68.01, and act thereon.

the Treasurer and Board of Selectmen deem advisable, or take any action relative thereto.
Voted to authorize the Town Treasurer with the approval of the Selectmen to dispose of the railroad bonds formerly the prop- erty of the Middleboro Fire District valued at four thousand dollars ($4,000) at such time as the Treasurer and Board of Selectmen deem advisable.
Article 19. To see if the Town will vote to raise and appro- priate a sum of money for the purpose of oiling Plymouth Street from Waterville to the southwest corner of the property of Ben- jamin & Ward Inc., a distance of approximately two miles, and act thereon.
No action taken on this article.
The Finance Committee made recommendations under Arti- cles 5-12-13-6-17 and 18 as per the vote under each article. Under Article 16 the Finance Committee recommended its adop- tion with the appropriation of $500.00. The Finance Committee recommended under Article 14 that it be discarded stating that they did not know where the money was coming from.
