Town Meeting Warrant


Commonwealth of Massachusetts


Essex ss. To either of the Constables of the Town of Middleton, in the County of Essex :


GREETING :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the in- habitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Town Hall in said Town on Tuesday, the fourteenth day of March next, at eight o'clock in the evening, then and there to act on the following articles :


ARTICLE 1. To authorize the Selectmen to appoint such other Town Officers as are required to be chosen annually.


ARTICLE 2. To see what action the Town will take to defray the Town expenses for the ensuing year.


ARTICLE 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1938, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may he given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


ARTICLE 4. To see if the Town will vote to authorize the Electric Light Department to use the earnings of the department for the ensuing year, agreeable to the petition of the Electric Light Commissioners.


ARTICLE 5. To see if the refund of the dog taxes shall be transferred to the Library fund.


ARTICLE 6. To see what action the Town will take in regard to the letting of the Town Hall.


ARTICLE 7. To see if the Town will vote to raise and appropriate the sum of $3,000.00 to purchase materials for W. P. A. or other Federal Relief Projects, to be spent under the supervision of the Board of Selectmen.


ARTICLE 8. To see if the Town will vote to raise and appropriate the sum of $4,500.00 for the maintenance of Chapter 81-Koads; said money to be used in conjunction with any money which may be allotted by Fed- eral, State or County, or all, for this purpose, or take any other action in relation thereto.


ARTICLE 9. To see if the Town will vote to raise and appropriate the sum of $1,000.00 for the maintenance of Chapter 90-Roads, the same to be expended in conjunction with the State allotment.


ARTICLE 10. To see if the Town will vote to appropriate the sum of $1, 700.00 from the Highway Fund, pro- vided by Chapter 2 of the Acts of 1939 for any of the purposes authorized by said chapter.


ARTICLE 11. To see if the Town will vote to authorize the Selectmen and their successors in office to sell at public or private sale any of the property which the Town may have acquired or my hereafter acquire through proceedings based upon the non-payment of taxes or under proceedings for the sale of lands of low value, to impose upon the property so sold such restrictions, reservations or conditions as shall be deemed ex- pedient, and to execute and deliver in the name and under the seal of the Town quitclaim deeds or other in- struments therefor.


ARTICLE 12. On petition of B. Gertrude Hayward and twenty-four others to see if the Town will vote to raise and appropriate a sum of money to repair and oil Mt. Vernon Street, that portion running from Maple Street to King Street.


ARTICLE 13. On petition of Harold Murphy and thirty-five others to see if the Town will vote to have 700 feet of Lakeview Road, (off Liberty Street) accepted.


ARTICLE 14. To see what action the Town will take in regard to placing the Highway Surveyor on a salary.


ARTICLE 15. On petition of Lyman S. Wilkins and sixteen others to see if the Town will vote to extend the street lights on and along East Street to the Boxford line and appropriate a sufficient sum of money for the same.


ARTICLE 16. To see what action the Town will take in regard to purchasing a 1} ton dump truck for the Highway Department.


ARTICLE 17. To see if the Town will vote to appropriate the sum of $500.00 to be used for the purchase of a certain parcel of land located at the corner of Lake and North Main Streets as shown on a plan made by Thomas A. Appleton C. E., dated August 1938.


ARTICLE 18. To see if the Town will vote to amend Section 7, Chapter 10 of the Town By-Laws so as to read as follows :- No person or persons shall remove, or cause to be removed and carried, or assist in removing and carrying through any part of any street or public way in the Town, any house, shop or other building, either in parts or a whole, without permission from the Selectmen first had and obtained in writing ; and under such limitations as they may deem expedient and prescribe. Whoever shall oflend against the provis- ions of this section shall forfeit and pay for each offence a sum not less than ten dollars, nor more than twenty dollars. The Selectmen shall not give such permission for the removal of any house, shop or other building, either in parts or a whole, exceeding twenty feet in height and fifteen feet in width, until after a hearing has been given to any party interested. Seven days at least previous to such hearing a notice there- of shall be given in some newspaper published in the County, which notice shall state the dimensions of the building to be removed, and the streets through which it is proposed to pass in removal.


ARTICLE 19. To see if the Town will vote to authorize the Board of Assessors to use such free cash in the Treasury as they, in their best judgment, feel is warranted and is approved by the Commissioner of Corpor- ations and Taxation for the purpose of reducing the tax rate.


ARTICLE 20. To see if the Town will vote to authorize the expenditure of Twenty-five hundred dollars from the Road Machinery Fund to maintain equipment.


ARTICLE 21. (a) To see if the Town will vote to set aside a parcel of land in Oakdale Cemetery to be used for the interment of Soldiers and Sailors in accordance with Section 19, Chapter 115 of the General Laws. (b) To see if the Town will vote to appropriate a sufficient sum of money for the improvement of the above parcel of land.


ARTICLE 22. To see if the Town will vote to accept the sum of $750.00 from the Electric Light Department to be used to reduce the 1939 tax rate.


You are hereby required to notify and warn said qualified voters to meet at the adjourned meeting at the Town Hall, on Monday, March 20 next for the following purposes, viz : To choose by ballot the following Town Officers for the ensuing year :


Moderator, Town Clerk, three Selectmen, one Assessor for three years, one member of the Public Welfare Board for three years, one member of the School Committee for three years, Highway Surveyor, two Trustees of the Flint Public Library for three years, Constable, Treasurer, Tax Collector, Tree Warden, Superintendent of Burials, Custodian of the Town Hall, one Electric Light Commissioner for two years, one Electric Light Commissioner for three years, one Cemetery Commissioner for three years.


The polls will be open at 5:45 A. M. and may be closed at 5:00 P. M.


And you are directed to serve this Warrant, by posting up attested copies thereof at Town Hall, Post Office, and Store at Howe Station, in said Town, seven days at least before the time of holding said meeting.


HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
