SELECTMEN'S REPORT


To the Inhabitants of Dighton :


According to the State Census taken this year the popu- lation is 3,208, a gain of 634 since 1920.


It is gratifying that each year our town valuation is increased by business and building activities.


The Department of Public Works Division of Highways have laid out and built a cement highway from the residence of Howard C. Briggs on Somerset Avenue southerly branch- ing on to private land at the Simmons Bros. farm, running west of the N. Y., N. H. and Hartford Railroad, crossing Main and Hart Streets to the Somerset boundary line extending therefrom in a direct line to the Fall River Bridge.


The Department joined with the town in the construc- tion of a bituminous macadam section of Center Street from the overhead Railroad Bridge to the Taunton River. Eventually this line will become a through route between Providence, R. I., New Bedford and the Cape when about two miles of improved road is built in Dighton and about the same amount in Freetown and Berkley.


They also joined the town in improving a short section of Wellington Street, easterly from the Rehoboth boundary line.


A liberal sum has been spent for general repairs and for oiling the streets.


MOTOR BUSSES


The Board of Selectmen have had four applications by as many companies for licenses to operate motor busses on

our streets. Hearings were held and three licenses were granted with rules, regulations and orders governing their operation as required by the General Laws.


One company the New England Transportation Co. met the requirements of the General Laws and filed a bond for $30,000 to protect passengers in case of accident.


Any company or person making a business of carrying passengers for hire is a Common Carrier and is responsible for their safety and must pay the damages in case of acci- dent if they have the financial ability, otherwise passengers are unprotected. The attention of the public is called to following provisions of the General Laws.


COMMON CARRIERS OF PASSENGERS BY MOTOR VEHICLE CHAPTER 159, SECTION 45.


Section 45. No person shall, in any city or town, operate any motor vehicle upon any public way, for the carriage of passengers for hire, in such a manner as to afford a means of transportation similar to that afforded by a rail- way company, by indiscriminately receiving and dis- charging passengers along the route on which the vehicle is operated or may.be running, or for transporting passengers for hire as a business between fixed and regular termini, without first obtaining a license therefor from the city council of such city or the selectmen of such town, in this and the two following sections called the licensing author- ity. Any such license issued in a city shall be subject to the approval of the mayor and shall not be valid unless such approval has been endorsed thereon in writing. Any person, receiving a license under this section and operating thereunder, is hereby declared to be a common carrier and shall, in respect to the operation of such a vehicle, be subject to such orders, rules or regulations as shall be adopted by the licensing authority under the following sec- tion.

Section 46. No license shall be granted under the pre- ceding section until orders, rules or regulations shall have been adopted by the licensing authority in the town where the vehicle is to be operated, and any such authority may make such orders, rules or regulations. No such motor vehicle shall be operated as aforesaid until the licensee of the vehicle, in addition to complying with all rules, orders and regulations of the licensing authority, shall have de- posited with the treasurer of the town security by bond or otherwise, running to the town treasurer and approved by him and by the licensing authority, in such sum as the li- censing authority may reasonably require, conditioned to pay any final judgment obtained against the principle named in the bond for any injury to person or property or damage for causing the death of any person by reason of any negligent or unlawful act on the part of the principle named in said bond, his or its agents, employees or drivers, in the use of operation of any such vehicle. Any person so injured or damaged, or his executor or administrator, or the executor or administrator of any person whose death was so caused, may enforce payment of such judgment by suit on said bond in the name of the town treasurer. Such a bond shall be furnished in each town where said motor vehicle is licensed to operate, and shall, in each instance,be in accordance with the rules, orders and regulations of the licensing authority in such town.


Section 49. Whoever violates any order, rule or regu- lation adopted or established under Sections 45 to 48 inclusive or violates any provision of any said sections, shall be punished by a fine of not more than one hundred dollars or by imprisonment in the House of Correction for not more than two months, or both.


The General Laws wisely provides for the protection of passengers by requiring Common Carriers to be bonded. The Common Carrier is responsible for the safe carriage of the passengers including school children. This subject is ably explained by Chief Justice Rugg in 144 and 250 Mass. reports pages 115-116-117.

POLICE


The increase in the expense of the Police Department has been necessary on account of the increase in the use of motor vehicles for business and pleasure and their reckless operation.


FIRE DEPARTMENT


The Fire Department is to be commended for the very efficient accomplishments with the present supply of ap- paratus for fighting fires.


We trust the town will make an addition by purchase of a power pump and hose.


The nearness of river and brooks with a few fire wells in the business and residential sections of the Town would furnish the needed supply of water.
