GENERAL INFORMATION


OPEN MEETING LAW-CHAP. 626, ACTS, 1958


Meetings of every district, city and town board, com- mission and school committee shall be open to public and to press (unless in executive session). A notice of such meetings must be filed at least twenty-four hours prior with the clerk of the district or town. (A regular schedule of meetings filed in advance is permissible.) Accurate records of all meetings shall be maintained setting forth action taken. A summary of all matters voted shall be made available with reasonable promptness after each meeting. The records shall become a public record and available to the public upon being approved. (For information on executive sessions and emergencies check law with Town Clerk.)


The town offices are open Monday through Friday from 8:30 A. M. to 4:00 P. M., and the office of the Town Clerk, Treasurer, and Collector is also open Wednesday evenings from 6:30 P.M. to 8:00 P.M.


The Board of Selectmen, Welfare, and Health, and the Assessors meet in their offices Wednesday evenings at 7:30 P. M.


The School Committee meets the third Wednesday of each month at 7:30 P. M. in the School Committee room.

SELECTMEN'S REPORT


To the Citizens and Taxpayers of Dighton :


The organizational meeting of the Board was held after the Annual Town Meeting. For the fourth consecutive year the chairmanships were divided with Mr. Atwood chosen as Chairman of Selectmen, Mr. Benevides for the Board of Public Welfare, Mr. Torres for the Board of Health, and Mr. Bene- vides was chosen to serve as recording clerk of the three Boards.


Fifty-two weekly and twenty-nine special meetings were held with one absentee. Several joint meetings were held with the other town boards and committees to discuss and resolve matters of mutual interest.


Necessary hearings were held upon application received for the various licenses as required. All transactions have been properly recorded and the many statutory requirements completed to the best of our knowledge and ability.


All Board members have participated in and attended all County Association meetings. Some members attended various governmental conferences on the regional and state level where and when convenient in an effort to obtain benefit of experiences to better serve the Town. Hearings were at- tended on the several Chapter 90 and Public Works projects in behalf of the Town's interest.


Four meetings were held with Bristol County Agricultural School trustees, county commissioners and public works engineers in relation to mutual problems on Center Street at the approaches to the Old Colony Railroad Bridge. A complete survey by the Department of Public Works is in process as this report is compiled.


All appointments of town officers and committees have been recorded with the Town Clerk together with the list of

jurors and are contained in the Clerk's annual report. Annual reports of the numerous town officers and departments as required by law are contained in this 1959 Town Officers' Report.


The vote of the Town for the printing and issuance of the 1959 valuation list has been fulfilled whereby a contract was made with the Davol Printing House, Inc. of Taunton, Mass. in the amount of $770.00.


All special committee activity and reports are included in the records of the Town Clerk. All orders and votes of the town meeting have been accomplished with the exception of the 250th anniversary committee. One meeting, which was very well attended by an enthused and interested group, was held. The preliminary groundwork was discussed and sug- gestions received. Representatives of governmental, educa- tional, civic and religious interest responded, and it is planned to organize the various committees required immediately after the 1960 town meeting.


The year 1959 will undoubtedly be recorded as the ending of an era of capital expenditures for school building and con- struction. In the years from 1952 to 1959 the Town estab- lished liabilities for bonded debt in excess of $1,600,000. The Town's annual appropriation required to reduce the debt will amount to over $20.00 on the tax rate. The Town's needs for other capital outlay will require very serious consideration and planning.


The Board has met on many occasions with Massachu- setts Department of Public Health officials and engineers relative to the several sewage systems which have been classified as in violation of sanitation laws. The Board has cooperated fully with the officials in a survey completed within the year. Many hours of field study, table conferences and discussions have been held with engineers and counsel.


Preliminary plans are in process. At such time as pro- posals and recommendations may be made, the Board will

present to the Town and all parties concerned a complete report.


The sewage subject, together with pollution, both domes- tic and industrial, have long been delayed for many reasons. However, through full cooperation of all parties concerned, the Town, the citizens, industry, and the Commonwealth, a desirable and successful solution can be obtained.


We express our appreciation and gratitude to the citizens, Town officials and employees for their cooperation in the per- formance of duty. Especially to the Town office staff, we recognize your everlasting loyalty and many services to the Town.

TOWN CLERK'S REPORT 1959


The regular Annual Town Meeting for the election of officers for the Town of Dighton was held on March 2, 1959 on warrant dated February 11, 1959. The meeting was called to order at 12 Noon by Stafford H. Hambly, Moderator. The balloting was under the supervision of the following election officers: Elaine Varley, Ruth Leeming, Edna Seekell, George Rose, Selma Wall, Anna Simmons, Hazel Reed, Lucy Baer, Yvette Alves, and Caroline Tripp.


The polls were closed at 8:00 P. M. The total number of votes cast were 1047. The ballots having been assorted and counted, the result was declared as follows:

VOTED UNANIMOUSLTY : To dispense with the reading of the articles and to refer to them by number and subject matter.


VOTED: That the meeting consider adjournment at 10:30 P. M.


(2) VOTED: On motion of Gordon Spinney that the reports of Town Officers as printed and published in the 1958 Annual Town Report be accepted.


(3) VOTED: On motion of Gordon Spinney that the Board of Selectmen be authorized to appoint all necessary Town Officers and Committees not otherwise provided for by statute.


(4) VOTED: On motion of Gordon Spinney that the Town Treasurer be bonded in the amount of $38,300.00 and the Town Collector be bonded in the amount of $53,100.00 to satisfy the provisions of Section 35 of Chapter 41 and Section 13 of Chapter 60 of the General Laws.


(5) VOTED: On motion of Francis Torres that the Board of Selectmen be authorized to appoint one of its membership to the position of "Sanitation Inspector" under the Board of Health for a one year term in compliance with the provisions of Section 4A of Chapter 41, General Laws.

(8) VOTED: On motion made by Gordon Spinney that the Town appropriate and transfer the sum of $5,000.00 from the Reserve Fund (Overlay Surplus) to Reserve Account Ap- propriated in accordance with Chapter 40, Section 6, The General Laws.


(9) VOTED: On motion made by Albert DeSilva that the Town appropriate and transfer the Dog Tax Refund in the amount of $581.96 to the Elementary School Library Account. (10) VOTED: On motion made by William Benevides that the Town raise and appropriate $250.00 for the purpose of maintaining for the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931.


(11) VOTED: On motion made by Anthony Andrews that the Town appropriate and transfer $2,825.00 from Surplus Revenue to a Police Cruiser Account for the purchase of a new 1959 motor vehicle with accessories and equipment for the use of the Police Department, and that the Board of Selectmen be authorized to dispose of the 1957 Plymouth cruiser as a trade value.


(12) VOTED: On motion made by Clayton Atwood that the Town appropriate and transfer $3,750.00 from Surplus Reve- nue to Chapter 90 Highway Construction to continue the Elm St. project.


(13) VOTED: On motion made by Clayton Atwood that the Town authorize the transfer of unappropriated available funds in the Treasury in the sum of $28,125.00 to Highway Revenue in anticipation of reimbursement from the State and County for Chapter 81 and Chapter 90 Highway Maintenance and Construction.


(14) VOTED: On motion made by Clayton Atwood that the Town appropriate and transfer $17,500.00 from Surplus Reve- nue to the Gravel Roads Account for the purpose of gravelling and improving Town Roads.


(15) VOTED: On motion made by Clayton Atwood that the Town vote to raise and appropriate $10,000.00 for the purpose

of constructing a building on Town owned land located on the east side of Somerset Avenue, to garage Street Department vehicles and equipment and that the Board of Selectmen be authorized to supervise the construction.


(16) VOTED: On motion made by Harold Mnedoza that the Town raise and appropriate $4,000.00 for the purpose of completing the Tax Mapping Project as established by vote of the Town on May 6, 1957.


(17) VOTED: On motion made by Stuart Arnold that the Town raise and appropriate $3,745.74 as the Town's share of the Dighton-Rehoboth Regional School District budget for 1959.


Gordon Spinney reported for the finance committee that the said committee had voted on and approved of all financial transactions in articles 9 through 17.


(18) VOTED: On motion made by Gordon Spinney that the Town authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in antici- pation of the revenue of the financial year beginning January 1, 1959 and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


(19) VOTED: On motion made by Gordon Spinney that the Town authorize the Town Treasurer, with the approval of the Selectmen, to sell at public auction or private sale, all prop- erties which the Town has legally acquired by Tax Title.


(20) VOTED: On motion made by Milton Horton that the Town authorize the Board of Selectmen, subject to the ap- proval of the finance committee to dispose of used materials returned to them, by sale at public auction.


(21) VOTED: On motion made by Gordon Spinney that the Town authorize the Board of Selectmen to sell at public auc- tion, the shed and outbuildings adjacent to the Civic Center on Somerset Avenue.

(22) VOTED: On motion made by William Benevides that the Town make changes in grade, take land by purchase or eminent domain, and to settle damages for land taken in conjunction with the 1959 Highway Program under Chapter 81 and Chapter 90.


(23) VOTED: On motion made by Clayton Atwood that the Town vote by ballot to instruct the Representative to the General Court, Mr. J. Robert Tickel, to file a bill to provide for tenure of office for the incumbent Charles H. Mason, Chief of Police of the Town of Dighton.


The voting was done by "Yes" and "No" ballots. The election officers working as checkers were: Hazel Reed, Elaine Varley, Anna Simmons, Mary Allie, and Edna Seekell. The official count of the votes was Yes-146, No-35.


(24) VOTED UNANIMOUSLY: On motion made by Clayton Atwood that the Town vote to adopt as provided under author- ity of Section 3, Chapter 143 of the General Laws, the follow- ing by-law to become effective upon approval by the Attorney General :


TITLE-BUILDING PERMITS:


Section 1. No structure shall hereafter be erected, structurally or externally altered, changed in use, moved or demolished without a permit from the Board of Selectmen.


Section 2. The Board of Selectmen shall issue such per- mits providing said work meets with the following requirements :


A. Certification by the Planning Board that such erection is in compliance with the provisions of the Sub-Division of Land Control By-Law.


B. Certification by the Sanitation inspector that the location of the work conforms with the rules and regulations as required by the Board of Health.


C. That such work is in accordance with all existing Town By-Laws and provisions of the General Laws of Commonwealth of Massachusetts.

ANNUAL REPORT


Section 3. Any person who violates any provision of this By-Law shall be punished by a fine of not more than Twenty Dollars ($20.00) for each offense.


(25) VOTED: On motion of Francis Torres that the Town authorize and instruct the Board of Selectmen to select and appoint an adequate number of citizens to a Committee to make necessary plans for the 250th Anniversary Celebration of the Town to be observed in 1962.


(26) The following motion was made by Earle Smith and seconded : I move that the Town vote to instruct the selectmen of the Town of Dighton to include in the Annual Town Report for the year 1960, a full and complete list of all individual and corporate taxes paid to the Town of Dighton, itemized by parcels according to assessment, and that such list be in- cluded in the said Town Report every third year thereafter.


Before the voting or discussion on this motion was done the report of the Town Officers' Committee was given as fol- lows:


"Under authority of the Town Meeting vote of 1956, a special committee to study the long range planning needs of the Town, subsequently reported and made recom- mendations. Foremost of the needs was that of the Schools. The second objective was stated to be improved methods of tax assessing.
