The meeting was called to order by the Moderator, Oliver Wolcott, at seven-thirty o'clock in the evening Tuesday, March 2, 1942.


Rev. John L. Yenches led the meeting in prayer.


Article 1. "To bring in your ballots for : Moderator for one year.


Town Clerk for one year.


Three Selectmen for one year.


Three Overseers of Public Welfare for one year.


Treasurer for one year.


Tax Collector for one year.


One Surveyor of Highways for one year.


Tree Warden for one year.


Three Constables for one year.


One Assessor for three years.


One Member of the School Committee for three years.


One Library Trustee for three years.


One Cemetery Commissioner for three years.

The Moderator stated that in accordance with the Warrant Article I would be acted upon Tuesday, March 10, 1942.


Moderator : "The first Article for consideration this evening is Article 2."


Article II. "To choose and appoint all other Town Officers in such man- ner as the Town shall determine."


Moved by Mr. Edward A. DeWitt and seconded : That Fred Berry, Loring Cook, Carl Anderson, and Ernest M. Barker be elected as Field Drivers for the ensuing year.


Voice vote. Motion unanimously carried.


Moved by Mr. Edward A. DeWitt and seconded: That Jesse S. Mann, Ernest M. Barker, Timothy A. Moynihan and Wendell W. Dodge be elected as Measurers of Wood, Lumber and Bark for the ensuing year.


Voice vote. Motion unanimously carried.


Article III. "To hear the report of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action there- on."


Moved by Mr. Robert B. Walsh and seconded: That this article be di- vided and that all departmental reports be considered first and reports of special committees then be taken up.


Voice vote. Motion unanimously carried.


Moved by Mr. Robert B. Walsh and seconded: That all departmental reports contained in the Town Reports be received and placed on file.


Voice vote. Motion unanimously carried.


Moved by Mr. Robert B. Walsh and seconded : That the report of the Committee on the H. M. C. S. Hamilton be received and placed on file.

Moved by Mr. Robert B. Walsh and seconded: That the report of the Committee on remodelling the Town Hall be received and placed on file.


Voice vote. Motion unanimously carried.


Article IV. "To see if the Town will vote to have the Defense Committee of 1941 act as a Town Defense Committee or take any action thereon."


Moved by Mr. John H. Perkins and seconded: That the members of the local Defense Committee of 1941, at the present time functioning under the Massachusetts Committee on Public Safety, be and act as the Town Defense Committee on Public Safety, subject to the powers, rules and regulations of both the Massachusetts Committee on Public Safety and the Federal Office of Civilian Defense.


Voice vote. Motion unanimously carried.


Article V. "To see if the Town will vote to raise and appropriate the sum of $1.800.00 for the preservation of health and protection of persons and property, to purchase equipment, uniforms and supplies for auxiliary fire and police departments, air-raid wardens, first aid rescue squads and other essential units of defense; and to provide for such other means as may be necessary in the national emergency for the protection of the people and property in the Town, or take any action thereon."

Moved by Mr. Percival D. Whipple and seconded : That the sum of $1,800.00 be raised and appropriated for the preservation of health and pro- tection of persons and property ; to purchase equipment, uniforms and supplies for auxiliary fire and police departments, air-raid wardens, first aid rescue squads and other essential units of defense; to provide for the training of its citizens in first aid and other matters essential to civilian defense; and to provide for such other means as may be necessary in the national emergency for the protection of the people and property in the Town.


Voice vote. Motion unanimously carried.


Article VI. "To raise and appropriate money for the Schools, Highways, and all other expenses and determine the manner of expending same."


Moderator : "On this Article I will read the recommendations of the Finance Committe on all departments. If debate is wished on any item please call "Pass" and we will take that up after voting on the others as a whole."

Selectmen : Salaries .- Moved by Mr. Everett F. Haley and seconded : that Selectmen, salaries be $1,000 00.

Article VII. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxation, to transfer the sum of $7,000 00 from the Excess and Deficiency Fund to the Selectmen's Unemployment Ac- count, to be expended for work to be done on the Highways, the Cemetery, the Moth Suppression Department, the Parks, Fire Protection, the Water Supply System, municipal buildings, and other municipal works projects in conjunction with the Federal Government, and for materials and implements, to provide work for the needy unemployed of the Town, or take action thereon."


Moved by Mr. Theodore A. Holland and seconded : That subject to the approval of the Commissioner of Corporations and Taxation, the sum of $7,000.00 be transferred from the Excess and Deficiency Fund to the Select- men's Unemployment Account, to be expended for work to be done on the Highways, the Parks, Fire Protection, the Water Supply system, municipal

buildings, and other municipal works projects in conjunction with the Federal Government, and for materials and implements to provide work for the needy unemployed of the Town.


Voice vote. Motion unanimously carried.


Article VIII. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxations, to transfer the sum of $4,000.00 from the Excess and Deficiency Fund to Maturing Debt, or take any action thereon."


Moved by Dr. John King and seconded : That subject to the approval of the Commissioner of Corporations and Taxation the sum of $4,000.00 be trans- ferred from the Excess and Deficiency Fund to Maturing Debt.


Voice vote. Motion unanimously carried.


Article IX. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxations, to transfer the sum of $500.00 from the Overlay Surplus to the State Guard Reserve or take any action thereon."


Moved by Mr. Standish Bradford and seconded: That subject to the ap- proval of the Commissioner of Corporations and Taxations, the sum of $500.00 be transferred from the Overlay Surplus to the Commanding Officer of the Hamilton unit of the State Guard Reserve.


Voice vote. Motion unanimously carried.


Article X. "To see if the Town will vote to raise and appropriate the sum of $8,400.00 to purchase and acquire a combination ladder, truck and pumper piece of fire apparatus for the use of the Fire Department, or take any action thereon."


Moved by Mr. Standish Bradford and seconded : That the sum of $8,400.00 be raised and appropriated to purchase and acquire a combination ladder, truck and pumper piece of fire apparatus for the use of the fire department.


Voice vote. Motion unanimously carried.


Article XI. "To see if the Town will vote to accept Gifford Road, so called, as per plan on file at the Town Clerk's office or take any action thereon, as petitioned for by Ethel M. Feindle and others."


Moved by Mr. Edward A. DeWitt and seconded: That the town accept Gifford Road, so called, as shown on a plan now on file in the office of the Town Clerk.


Voice vote. Motion unanimously carried.


Article XII. "To see if the Town will vote to adopt the following by- law." No new street shall be accepted by the Town unless the owners of the land over which the street is to be laid out shall remove the turf from the entire length of the proposed street and to such width of said proposed street as shall be determined by the Board of Selectmen and shall also remove the loam and replace it with gravel for such depth as the selectmen shall deem it necessary."


"A plan of the proposed street shall be attached to the petition for the layout."

"Whenever the Selectmen shall deem it necessary, the owners of the land over which the street is to be laid out shall provide an easement to the Town for the purpose of taking care of the drainage of said street, or take any action thereon."


Moved by Mr. Robert B. Walsh and seconded: That the Town adopt the following by-law, "No new street shall be accepted by the Town unless the owners of the land over which the street is to be laid out shall remove the turf from the entire length of the proposed street and to such width of said proposed street as shall be determined by the board of Selectmen and shall also remove the loam and replace it with gravel for such depth as the Select- men shall deem necessary."


"A plan of the proposed street shall be attached to the petition for the layout."


"Whenever the Selectmen shall deem it necessary, the owners of the land over which the street is to be laid out shall provide an easement to the Town for the purpose of taking care of the drainage of said street."


"This by-law shall become operative upon its approval by the attorney- general but shall not be applicable to any street accepted before July 1, 1942." Voice vote.


Due to dissent in the voice vote and the necessity for a four-fifths vote for this motion the Moderator called for a standing vote. Tellers: Robert Robertson, Oscar Wood and Frank Buzzell.


The vote: Affirmative 81 Negative 1 Motion carried.


Article XIII. "To see if the Town will vote to raise and appropriate the sum of $783.56 for the payment of unpaid bills of the School Department for the year 1941, due to the insufficiency of appropriations, as provided for by Chapter 179 of Acts of 1941."


Moved by Mr. Standish Bradford and seconded: That the Town raise and appropriate the sum of $783.56 for the payment of unpaid bills of the School Department for the year 1941, due to insufficiency of appropriation, as pro- vided for by Chapter 179 of Acts of 1941.


Voice vote. Motion unanimously carried.


Article XIV. "To see if the Town will vote to authorize the Selectmen to sell after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, property taken by the Town under Tax Title pro- cedure, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take action relative theretc."


Moved by Mr. Lawrence R. Stone and seconded : That the Town authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, property taken by the Town under Tax title procedure, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate.


Voice vote. Motion unanimously carried.

Article XV. "To see if the Town will vote to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1943, and to issue a note or notes therefor payable within one year, in accordance with Section 17, Chapter 44, General Laws and Amendments thereto."


Moved by Mr. Bernard A. Cullen and seconded: That the Town Treas- urer, be and hereby is authorized with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1943, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a shorter period than one year, in accordance with Section 17, Chapter 44, General Laws and amendments thereto.


Article XVI. "To see if the Town will authorize the Collector to use all means of collecting taxes which a Town Treasurer, when appointed Collector, may use agreeable to Chapter 41, Section 37, of the General Laws and amend- ments thereto."


Moved by Mr. Frank B. Crowell and seconded: That the Town authorize the Collector to use all means of collecting taxes which a Town Treasurer when appointed Collector may use agreeable to Chapter 41, Section 37, of the General Laws and amendments thereto.


Voice vote. Motion unanimously carried.


Article XVII. "To act on any cther matter that may legally come before said meeting."

WARRANT FOR SPECIAL TOWN MEETING


ESSEX, ss. To either of the Constables of the Town of Hamilton:


GREETING :


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Hamilton, quali- fied to vote in the election and town affairs to meet in the Town Hall in said Town on Wednesday, the fourteenth day of October, nineteen hundred and forty-two (October 14, 1942) at seven-thirty o'clock in the evening (7.30 P. M.) then and there to act on the following articles, viz.


Article 1. To see if the town will vote to donate to the United States Army the three iron guns and carriages standing on the Hamilton Soldiers' Green and the four brass mortars standing on the Soldiers' Plot in the Ham- ilton town cemetery to be turned into war materials for the armed forces of the United States and its allied forces now engaged in the World War, or to take any action thereon.


Article 2. To act on any other matter that may legally come before said meeting.


And you are directed to serve this warrant by posting attested copies thereof, one at the Town Hall, and one at each of the three postoffices in said Town, seven days at least before the time of holding said meeting.


Hereof fail not and make return of this warrant with your doings there- on to the Town Clerk at the time and place of holding said meeting.
