The Moderator, Mr. Oliver Wolcott, opened the meeting at seven- thirty o'clock in the evening (7:30 p. m.) on Monday, March 3, 1947.


Rev. Charles Francis Hood lead the meeting in prayer.


Moderator: "The first business of the evening is Article II :


Article II. "To choose and appoint all other Town Officers in such manner as the Town shall determine."


Moved by Mr. Edward A. DeWitt and duly seconded: "That four field drivers and four measurers of wood, lumber, and bark be elected by the meeting from the floor, and that the field drivers be nominated and elected first and the measurers of wood, lumber, and bark immediately following."


Voice vote on motion. Motion unanimously carried.


Moved by Mr. Dewitt and duly seconded : "That Fred Berry, William W. Bancroft, Carl C. Anderson, and Ernest M. Barker be elected field drivers for the ensuing year."

Moved by Mr. DeWitt and duly seconded : "That Jesse S. Mann, Timothy A. Moynihan, Ernest M. Barker, and Charles B. Poole be elected measurers of wood, lumber, and bark for the ensuing year."

Article III. Moderator : "Article 3-To hear the report of the Town Officers and of the Finance and Advisory Committee and all other com- mittees and take any action thereon."

ports of the town officers, finance and advisory committee and all depart- ment reports as printed in the Annual Town Report be received and placed on file."

Article IV. Moderator: "Article 4-To raise and appropriate money for Schools, Highways and all other town expenses and determine the manner of expending same."

Moved by Harold A. Daley and duly seconded "that the Assessors ex- pense appropriation be increased to $1,090.00 and the Assessors publish a Valuation Book and have it delivered to the citizens of the town."

Moderator : "We now come to Schools, Salaries and Expenses, as passed."


Mrs. Nellie E. Woodman : "I move that school salaries be increased by $1.440.00 to read $78,668.70, plus the dog tax of $440.27."


Remarks by Mrs. Woodman and Mr. Theodore A. Holland, Chairman of the Finance Committee.

Moved by Harold A. Daley and duly seconded that the appropriation for the Town Reports be amended by including an approval of the present form of the Town Report.


Voice vote. Motion unanimously carried.


Article V. Moderator : "Article 5-To see if the Town will vote to transfer the sum of $10,000.00 from the Excess and Deficiency Fund to Maturing Debt, or take any action thereon."


Moved by Mr. Theodore A. Holland and duly seconded: "That the sum of Ten Thousand Dollars ($10,000.00) be transferred from the ex- cess and deficiency fund to maturing debt."


Voice vote. Motion unanimously carried.


Article VI. Moderator: "Article 6-To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Ac- count, the sum of $3,125.00 for Chapter 90 Highway Construction, or take any action in relation thereto."


Moved by Mr. Lawrence R. Stone and duly seconded: "That the Town raise and appropriate the sum of Three Thousand One Hundred Twenty-five Dollars ($3,125.00) for Chapter 90 Highway Construction.


Voice vote. Motion unanimously carried.


Article VII. Moderator: "Article 7-To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Ac- count, the sum of $1,000.00 for Chapter 90 Highway Maintenance, or take any action in relation thereto."


Moved by Mr. Lawrence R. Stone and duly seconded : "That the Town raise and appropriate the sum of One Thousand Dollars ($1,000.00) for Chapter 90 Highway Maintenance.


Voice vote. Motion unanimously carried.


Article VIII. Moderator: "Article 8-To see if the Town will vote to make certain repairs to the grass and cannon at the Memorial Green arising from damage by an automobile on or about April 3, 1946. and that $89.70 received by the town for damage sustained be applied to and used by the town in payment for repair of such damage, or take any ac- tion thereon."


Moved by Mr. Ralston F. Pickering and duly seconded: "That the damage done to the grass and cannon at the Memorial Green on Main Street by an automobile on or about April 3, 1946, be repaired and that Eighty-nine Dollars and Seventy Cents ($89.70) received by the Town for such damage be applied to and used by the Town in payment therefor."


Voice vote. Motion unanimously carried.


Article IX. Moderator: "Article 9-To see if the Town will vote to purchase or take by eminent domain, for the protection of the Hamilton

town water system, a certain strip or parcel of land situated on the north- easterly side of Bridge Street, in said Hamilton, being a portion of the now discontinued Essex Branch of the Boston and Maine Railroad. con- taining about 164,000 square feet, as shown substantially on a plan now on file in the office of the town clerk, raise and appropriate the sum of $600.00 therefor, or take any action thereon."


Moved by Mr. Everett F. Haley and duly seconded : "That the Town purchase from the Boston and Maine Railroad. a corporation duly organ- ized under the laws of the Commonwealth. a certain strip or parcel of land situated in Hamilton in the County of Essex and Commonwealth of Massa- chusetts. being a portion of the now discontinued Essex Branch of the Boston and Maine Railroad, the center line of which begins on the North- easterly side of Bridge Street at about Valuation Station 70+60 on the center line of said location: thence extending Easterly and Southeasterly about three thousand. three hundred fifteen (3.315) feet to the North- westerly side of said Bridge Street at about Valuation Station 103+75 on said center line of location, said strip of land being forty-nine and fifty hundredths (49.50) feet in width throughout, twenty-four and seventy- five hundredths (24.75) feet on each side of said center line of location, said strip of land containing about one hundred and sixty-four thousand (164,000) square feet and being shown upon a plan marked "Land in Hamilton. Mass. Boston and Maine Railroad -to- Town of Hamilton. J. P. Cronin. Engineer of Design. February, 1947." now on file in the office of the town clerk. that the sum of Six Hundred Dollars ($600.00) be raised and appropriated therefor. and that the Board of Selectmen be and hereby are instructed, authorized and empowered with full powers on behalf of the Town to consummate such purchase.

Article X. Moderator: "Article 10-To see if the town will vote to purchase and acquire a new combination cruiser and ambulance for the police department, raise and appropriate a sum of money therefor, or take any action thereon."


Moved by Mr. Percival D. Whipple and duly seconded: "That the Town purchase and acquire a new combination cruiser and ambulance motor vehicle for the use of the police department. that the sum of One Thousand Six Hundred Dollars ($1,600.00) be raised and appropriated therefor, and that the selectmen in conjunction with the chief of police be instructed, authorized and empowered with full powers on behalf of the Town to consummate such purchase."


Rising vote. Motion carried.


Article XI. Moderator: "Article 11-To see if the Town will vote to transfer to School Cafeteria, High, the sum of $1,229.18 from the various unexpended balances of the sums of money raised and appro- priated under Article 4 for the annual town meeting held March 7, 1946, to wit :

Article XII. Moderator : "Article 12-To see if the Town will vote to transfer the sum of $300.00 from the Cemetery Sale of Lots and Graves Fund to a Special Cemetery Account to be expended by the Cemetery Commissioners for improvements of the cemetery, or take any action there- on."


Moved by Mr. Raymond A. Whipple and duly seconded : "That the sum of Three Hundred Dollars ($300.00) be transferred from the Ceme- tery Sale of Lots and Graves Fund to a Special Cemetery Account to be expended by the cemetery commissioners for improvements of the ceme- tery."


Voice vote. Motion unanimously carried.


Article XIII. Moderator: "Article 13-To see if the Town will vote to build a sidewalk with a "hot-top," or other similar surface, along the northeasterly side of Asbury Street, from Main Street to Highland Street, and appropriate the sum of $1,500.00 therefor, or take any action there- on."


Moved by Mr. Percival D. Whipple and duly seconded : "That the Town build a section of sidewalk with a "hot-top" or similar surface along the northeasterly side of Asbury Street from Highland Street toward and in the direction of Main Street and raise and 'appropriate the sum of $1,500.00 therefor, and that the work be done under the supervision and direction of the surveyor of highways."


Voice vote. Motion unanimously carried.

Article XIV. Moderator : "Article 14-To see if the Town will vote to construct a sidewalk on the northwesterly side of Willow Street, from Rust Street to Asbury Street, such construction to include the installa- tion of curbing at street corners, and the sidewalk surface to be of a a permanent nature, raise and appropriate a sum of money therefor, or take- any action thereon."


Moved by Mr. Lawrence Lamson and duly seconded : "That the Town build a sidewalk on the northwesterly side of Willow Street, from Rust Street to Asbury Street, to include curbing at street corners and a side- walk surface of a permanent nature, raise and appropriate the sum of $1,200.00 therefor, and that the work be done under the supervision and direction of the surveyor of highways."


Voice vote. Motion unanimously carried.


Article XV. Moderator: "Article 15-To see if the Town will vote to build, grade, drain and oil Savoy road and raise and appropriate a sum of money therefor, the work to be done under the direction and supervision of the Highway surveyor, or take any action thereon."


Moved by Miss Olive P. Welch and duly seconded : "That the Town build, grade, drain and oil Savoy road, raise and appropriate the sum of $3,410.50 therefor, and that the work be done under the supervision and direction of the surveyor of highways."


Rising vote. Motion unanimously carried.


Article XVI. Moderator : "Article 16-To see if the Town will vote to receive the report of the General George S. Patton, Jr., Memorial Com- mittee printed in the annual town report, as a report of progress, to in- crease the membership of the committee to nine, to be appointed by the Moderator, and that they be authorized to employ and compensate archi- tects and civil engineers to prepare plans and specifications for a field house on the playground, raise and appropriate the sum of $500.00 there- for and other expenses of the committee, or take any action thereon."


Moved by Mr. Standish Bradford and duly seconded: "That the re- port of the General George S. Patton, Jr., Memorial Committee be ac- cepted as a report of progress, and the present committee be authorized to employ architects and civil engineers to submit plans and specifications for a memorial field house or other structure on the playground and that the Town raise and appropriate the sum of $500.00 therefor."


Voice vote. Motion unanimously carried.


Article XVII. Moderator: "Article 17-To consider the final re- port with recommendations of the Planning Board, including a proposed zoning by-law and map originally establishing the boundaries of zoning districts in the town and the regulations and restrictions to be enforced therein, copies of which will be filed with the Town Clerk prior to the meeting, and to see if the Town will vote to adopt the proposed zoning by-law and map recommended in such report of the Planning Board or to take any other action thereon."

Moved by Mr. John R. Hollister and duly seconded: "That the re- port of the Planning Board with recommendations, including a proposed zoning by-law and map originally establishing the boundaries of zoning districts in the Town of Hamilton and the regulations and restrictions to be enforced thereunder, as now on file in the office of the Town Clerk, be adopted, that the vote on such adoption be taken by a secret ballot, with the use of the official checklist, and that the moderator appoint a com- mittee of three to distribute, collect and count ballots. This by-law shall take effect only after its approval by the attorney-general and publication in compliance with section 32 of Chapter 40 of the General Laws and amendments thereto."


Moderator: "The motion is that the vote be taken by a secret ballot with the use of the official checklist."


Voice vote. Motion unanimously carried.


Moderator : "Robert Chittick, Donald Trussell, and Frank Buzzell will act as a committee of three to distribute, collect, and count ballots."


Moderator: "We shall now commence with the voting, by secret ballot with the use of the official checklist. Mr. Chittick, Trussell, and Buzzell will act as a committee of three to distribute, collect, and count ballots."


The meeting proceeded to vote by secret ballot with the following result, as announced by the Moderator :

Motion to adopt the zoning by-law was lost.


Article XVIII. Moderator: "Article 18-To see if the Town will vote to transfer from the Excess and Deficiency Account, a sum of money for the state and county share of Chapter 90 Highway Maintenance and Construction."


Moved by Mr. Frederic Winthrop, Jr. and duly seconded : "That the · sum of $21,875.00 be transferred from the Excess and Deficiency Account to meet the cost of the state and county share of Chapter 90 Road Con- struction and Maintenance, and that the reimbursements later from the state and county on account of such work be credited to the Excess and Deficiency Account."


Voice vote. Motion unanimously carried.


Article XIX. Moderator : "Article 19-To see if the Town will vote to make certain repairs and alterations in the Adelaide Dodge Walsh School in East Hamilton, raise and appropriate a sum of money therefor or take any action thereon."


Moved by Mr. Edward A. DeWitt and duly seconded: "That the Town make certain repairs and alterations in the cellar, first floor and auditorium of the town building on School Street, East Hamilton, former- ly used for school purposes under the name of Adelaide Dodge Walsh School, consisting of remodelling, painting, plumbing, heating, carpenter work, changes in and additions to the electrical equipment walls, flooring,

etc., and that the sum of Ten Thousand Dollars ($10,000.00) be raised and appropriated therefor, the work to be done under the direction and supervision of the selectmen with full powers in the premises."


Voice vote. Motion unanimously carried.


Article XX. Moderator: "Article 20-To see if the Town will vote that the Adelaide Dodge Walsh schoolhouse building and appurtenances thereto at East Hamilton be used by the Town for the purpose of provid- ing suitable headquarters for Augustus P. Gardner Post 194. American Legion, to be under the direction and control of such post and subject to regulations, approved by the Town, raise and appropriate a sum of money therefor, or take any action thereon, in compliance with Section 9, Chap- ter 40 of the General Laws, Terc. Ed., and Amendments thereto."


Moved by Dr. Henry F. Larchez and duly seconded: "That for the purpose of providing suitable headquarters for Post 194. American Legion. the Town approve and authorize the use of the first floor and basement of the town building on School Street. East Hamilton, formerly used for school purposes under the name of the Adelaide Dodge Walsh School, said premises to be under the control and direction of said Post, subject to the following regulations approved herewith by the town :


1. These premises shall be used as a headquarters for members of Post 194, American Legion, and its guests.


2. Each member shall upon application be entitled to a key to the headquarters.


3. There shall be a house committee consisting of five members, to be appointed annually by the commander. Such committee shall from time to time make such additional rules and regulations as may arise as to the conduct of the members, the use of the premises, the hours of opening and closing, entertainments, etc., the Town reserving the use at all times of the auditorium and entrance thereto for the inhabitants of Hamilton."

Article XXI. Moderator: "Article 21-To see if the Town will vote to accept the lay-out as a public way by the selectmen of North Street. so-called, in accordance substantially with a plan dated November, 1946, now on file in the office of the Town Clerk, or take any action thereon, as petitioned for by Barkley W. Tree and others."


Moved by Mr. Edward A. DeWitt and duly seconded : "That the Town accept the lay-out as a public way by the selectmen of North Street, so-called, in accordance substantially with a plan dated November. 1946, now on file in the office of the Town Clerk."
