The Moderator, Mr. Oliver Wolcott, opened the meeting at seven- thirty (7:30) o'clock in the evening on Monday, March 7, 1949.
Rev. Edward J. McLaughlin lead the meeting in prayer.
Moderator: "The first business of the evening is Article 2 :
"To choose and appoint all other Town Officers in such manner as the Town may determine."
Moved by Mr. Edward A. DeWitt and duly seconded: "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately fol- lowing."
Voice Vote. Motion unanimously carried.
Moved by Mr. Edward A. DeWitt and duly seconded : "That Fred Berry. Carl C. Anderson, William W. Bancroft and Ernest M. Barker be elected field drivers for the ensuing year."

Article 3. Moderator : "To hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action thereon."
Moved by Mr. Lawrence R. Stone and duly seconded: "That the re- ports of the Town Officers, Finance and Advisory Committee and all depart- ment reports as printed in the annual town report be received and placed on file."
Voice Vote. Motion unanimously carried.
Article 4. Moderator: "To raise and appropriate money for Schools, Highways, Essex County Retirement Board and all other Town expenses and determine the manner of expending the same."
As in past years I shall read the appropriations recommended by the Finance Committee and if debate is wished on any item, call "Pass" and that item will be considered after the others are voted as a whole.

HEALTH
Mr. Everett F. Haley: "Mr. Moderator, the Board of Health feels that we should have the money all set up in one lump sum. All four items are fixed charges except that Miscellaneous Expenses should be $200.00 and the Rubbish Collection should be $2,300.00. I move that this sum of $6,571.00 be passed as one appropriation."
Voice Vote. Motion unanimously carried.
HIGHWAY
Mr. Frederic Winthrop: "We feel that the town should raise what money is necessary. You people are the ones who will decide how much money you want to spend. There are a great many taxes-Federal, state and town-and if the people want to have higher taxes. that is alright. We could very well spend $100,000 on this town. I think it would be out of line. All money that is raised should be for the benefit of the town as a whole. not for any particular group. I should like to draw your attention to the Finance Committee report: 'The Finance Committee recommends that the special Articles 23, 24 and 25 requesting work on individual roads be not voted. It is the opinion of the Committee that development of the Town roads and the maintenance of existing roads should be carried on by the Surveyor of Highways on the basis of a systematic plan established and followed by him. It is opposed to isolated hit or miss development. The approved budget for the Highway Department for 1949, excluding snow removal and street lighting, amounts to $25,927. which is an increase of about $5,000, or a dollar in the tax rate over the appropriation for 1948. This includes increases in salaries and wages. and work which the Surveyor has laid out for the year. The Committee feels no more should be spent.' I move that we defer action on these two Highway Department items until after Articles 23, 24 and 25 have been considered."
Voice Vote. Motion unanimously carried.
PARKS
Mr. Richard L. Wiggin : "Why is there an increase in that particular item? Labor seems to be taking a downward trend and this increase seems rather odd."
Mr. Ray M. Sanford : "We have only one man who does all the work in the Park Department. He has charge of Patton Park, Soldier's Green. Walsh Park. Asbury Park and the two triangles on Miles River Road. It is hard to expect one man to take care of all that and the purpose of the increase is to retain his services."
Voice Vote. Motion unanimously carried.
Article 5. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for chapter 90 Highway Construction on Essex street or take any action thereon."

Moved by Mr. Everett F. Haley and duly seconded: "That the Town transfer from the Excess and Deficiency Account the sum of Four Thou- sand ($4,000.00) Dollars for Chapter 90 Highway Construction on Essex street, to be expended for its share of said work, provided the state or county or both cooperate with the Town and contribute to the cost thereof as provided for by Chapter 90 of the General Laws and Amendments there- to and that available funds may be used while carrying on the work until the Town is so reimbursed."
Voice Vote. Motion unanimously carried.
Article 6. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for chapter 90 Maintenance or take any action thereon."
Moved by Mr. Everett F. Haley and duly seconded : "That the Town raise and appropriate the sum of One Thousand ($1,000.00) Dollars for Chapter 90 Maintenance for the maintenance of various streets, said money to be used in conjunction with any money which may be allotted by the state or county or both for the purpose as provided for by Chapter 90 of the General Laws and Amendments thereto and that available funds may be used while carrying on the work until the Town is so reimbursed."
Voice Vote. Motion unanimously carried.
Article 7. Moderator : "To see if the Town will vote to sell at public auction or by advertising for sealed bids or at private sale, as the Board of Selectmen may deem for the best interests of the Town, its parcel of land situated at 45 School street, East Hamilton, containing 7,883 square feet with the one-story building thereon, or take any action thereon."
Moved by Mr. Edward A. DeWitt and duly seconded: "That the Town sell for cash at public auction or by written bids or at private sale, as the selectmen may deem for the best interests of the town, its parcel of land with the building or buildings thereon situated at 45 School Street, East Hamilton, and that the selectmen with full powers, on behalf of the town, be empowered and authorized to consummate the transaction and execute and deliver a proper quit-claim deed or deeds conveying said property to the purchaser or purchasers thereof."
Voice Vote. Motion unanimously carried.
Article 8. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for the purpose of purchasing and installing necessary heating equipment in the Municipal Garage and Storage Building in the rear of the Town Hall or take any action thereon."
Moved by Mr. Lewis K. Pierce and duly seconded: "That the Town raise and appropriate the sum of Three Thousand ($3,000.00) Dollars for the purpose of purchasing and installing necessary heating equipment in

the Municipal Garage and Storage Building in the rear of the Town Hall, and that the work be done under the direction and supervision of the Board of Selectmen with Full powers."
Remarks by Mr. Winthrop, Mr. Pierce and Mr. Hartnett.
Voice Vote. Motion defeated.
Article 9. Moderator: "To see if the Town will vote to continue the present Patton Memorial Committee with its present powers or take any action thereon."
Moved by Mr. Standish Bradford and duly seconded: "That the present General Patton Memorial Committee be continued in force with its present powers."
Voice Vote. Motion unanimously carried.
Article 10. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for the purpose of purchasing a mist sprayer for the moth depart- ment or take any action thereon."
Moved by Mr. John E. Lawrence and duly seconded : "That the town transfer from the Excess and Deficiency Account the sum of Twenty-two Hundred ($2200.00) Dollars for the purpose of purchasing a mist sprayer for the Moth Department, said purchase to be under the direction and supervision of the board of selectmen."
Voice Vote. Motion carried.
Article 11. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for the purpose of purchasing a one-ton truck for the moth depart- ment or take any action thereon."
Moved by Mr. Harold A. Daley and duly seconded : "That the Town transfer from the Excess and Deficiency Account the sum of Sixteen Hun- dred ($1600.00) Dollars for the purpose of purchasing a one-ton truck for the moth department, said purchase to be under the direction and supervision of the board of selectmen, and that the selectmen be authorized to sell or exchange the present truck and apply the proceeds therefrom to the purchase of said new truck."
Voice Vote. Motion carried.
Article 12. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for the purchase of a truck for the Highway Department or take any action thereon."
Moved by Mr. Leland D. Thompson and duly seconded: "That the Town raise and appropriate the sum of $6400.25 for the purpose of pur-

chasing a motor truck for the Highway Department, said purchase to be under the direction and supervision of the Highway Surveyor."
Remarks by Mr. Thompson, Mr. Wiggin and Mr. Winthrop.
Voice Vote. Motion Defeated.
Article 13. Moderator: "To see if the Town will vote to apply the money received from insurance against fire damage at the Lamson School the past year to recoup the cost of repairing such damage or take any action thereon."
Moved by Mr. Lawrence R. Stone and duly seconded: "That the in- surance Money received by the Town for fire damage at the Lamson School the past year be applied to recoup the Town for the cost of repairing such damage."
Voice Vote. Motion carried.
Article 14. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for the purpose of improving the grounds and driveways about the Adelaide Dodge Walsh School Building on School street, East Hamilton, now being used in part by the A. P. Gardner Post of the American Legion for headquarters, or take any action thereon."
Moved by Mr. Edward A. DeWitt and duly seconded: "That the Town raise and appropriate the sum of Two Hundred ($200.00) Dollars for the purpose of improving the grounds and driveways about the Adelaide Dodge Walsh School building on School street, East Hamilton, now being used in part by the A. P. Gardner Post of the American Legion, the work to be done under the direction and supervision of the board of selectmen with full powers."
Voice Vote. Motion unanimously carried.
Article 15. Moderator : "To see if the Town will vote to accept chap- ter 588 of the Acts and Resolves of 1948. being entitled "An Act Authoriz- ing Increases of the Amounts of Pensions Payable to Certain Former Pub- lic Employees Who Have Been Retired and to Beneficiaries of Certain Retired Public Employees," or take any action thereon."
Moved by Mr. Everett F. Haley and duly seconded : "That the article be indefinitely postponed.
As a note of explanation, this is a law that was passed last year to increase the amount of pensions of certain former public employees who had retired before 1946. There is a mandatory provision that this be brought before the town. We do not have a single person in Hamilton who would be affected by this law and we might be accepting something that would be embarrassing to us. It should be indefinitely postponed."
Voice Vote. Motion unanimously carried.

Article 16. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I of chapter 41 of the General Laws, to accept the proposed layouts of two public foot- ways by the selectmen marked A and B on the plan on file in the office of the Town Clerk entitled "Footways to Pleasant Pond, Hamilton, Mass., December 14, 1948, Charles H. Morse & Son, Engineers," or take any action thereon."
Moved by Mr. Lawrence R. Stone and duly seconded : "That this article be laid on the table.
Voice Vote. Motion carried.
Article 17. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I of chapter 41 of the General Laws, to accept the proposed layout by the selectmen as a public way of Hatfield Road, so-called, as shown on a plan on file in the office of the Town Clerk, entitled "Plan of Hatfield Road, Hamilton, Mass., for Acceptance December, 1947, Charles H. Morse, Engineer," and raise and appropriate a sum of money for necessary repairs or take any action thereon."
Moved by Mr. C. Laurie Waterman and duly seconded: "That the Town accept the proposed layout as a public way of Hatfield Road, so called, as shown on a plan on file in the office of the Town Clerk, entitled "Plan of Hatfield Road, Hamilton, Mass., for Acceptance, Dec. 1947, Charles H. Morse, Engineer," and that the sum of Twelve Hundred ($1200) Dol- lars be raised and appropriated therefor."

Article 18. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I of chapter 41 of the General Laws to accept the proposed layout by the selectmen as a public way of the extension of Lake Drive, so called, as shown on a plan on file in the office of the Town Clerk, entitled "Plan of Lake Drive for Acceptance, December 13, 1948, Charles H. Morse & Son, Engineer," or take any action thereon.
Moved by Mr. Lawrence R. Stone and duly seconded: "That this article be laid on the table.

Article 19. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I of chapter 41 of the General Laws, to accept the proposed layout by the selectmen as a public way of Durham avenue, so called, as shown on a plan on file in the office of the Town Clerk, entitled "Plan of Durham Ave., Appleton, Stopford and Gibney Street, Hamilton, Mass., for acceptance, Nov. 22, 1941, Morse, Dickinson and Goodwin, Engineers, Haverhill, Mass.," and

raise and appropriate a sum of money for necessary repairs or take any action thereon.'

Geikie and duly seconded: "That the Town accept the proposed layout by the selectmen as a public way of Durham avenue, so called, as shown on a plan on file in the office of the Town Clerk entitled "Plan of Durham Avenue, Appleton, Stopford and Gibney Streets, Hamilton, Mass., for acceptance, Nov. 22. 1941. Morse, Dickinson and Goodwin, Engineers, Haverhill, Mass.," and that the town raise and appropriate the sum of Thirteen Hundred and Fifty ($1350.00) Dollars therefor."

Article 20. Moderator: "To see if the Town will vote to authorize the formation of a committee of eight, of which the chairman of the Board of Selectmen. chairman of the Finance and Advisory Committee. chairman of the Planning Board, Members of the School Committee. president of the Hamilton Parent-Teachers' Association and Superintendent of Schools shall be members (and of which committee the chairman of the school committee shall be designated chairman pro tem, for organization), for the purpose of studying the immediate and urgent needs of additional pub- lic school facilities in the town and securing expert advice and raise and appropriate a sum of money to defray expenses or take any action thereon."

Gordon Love and duly seconded : "That a commit- tee of eight, consisting of a member of the Board of Selectmen, chairman of the Finance Committee, chairman of the Planning Board, members of the School Committee, president of the Parent-Teachers Association and superintendent of schools (and of which committee the chairman of the school committee shall be designated chairman pro tem for the purpose of organization) be appointed by the moderator for the purpose of studying the immediate and urgent needs of additional public school facilities and requirements in the town and securing expert advice thereon and making a report of their activities and recommendations not later than the next annual Town Meeting and that the sum of Two Thousand ($2000.00) Dollars be transferred from the Excess and Deficiency Account to defray the expenses thereof."

Article 21. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for the purpose of extending the water mains on Essex Street from Miles River Road to Woodberry street or take any action thereon."
Moved by Mr. Earle B. Tucker and duly seconded: "That the Town raise and appropriate the sum of Five Thousand ($5000) Dollars for the purpose of extending the water mains on Essex Street from Miles River

Road to Woodberry Street, the work to be done under the direction and supervision of the water commissioners."
