REPORT OF THE TOWN CLERK


To the Citizens of Hamilton:


I submit herewith my seventeenth annual report as Clerk of the Town of Hamilton.


During the year 1960 the elections and town meetings consisted of the Annual Town Meeting and Election held March 7 and 15 respec- tively; the Presidential Primary held April 26; a Special Town Meeting held July 25; the State Primary held September 13, and the State and Presidential Election held November 8. A detailed report of each is printed in the town report as part of the Town Clerk's report.


A list of births, marriages, and deaths recorded during the year is also included as part of the Clerk's report. In many cases the record of a birth in another community is not received in time to be included in the town report. In such cases, the birth is recorded as received in the office and becomes a record in the town as well as the community of birth even though it is not printed in the town report.


Like most other town departments, the work in the Clerk's office increases with the growth of the town. Since 1957 the keeping of the accounts of the water department has been under my supervision, with Mrs. Dorothy Barnes doing the work of the water accounts as well as assistance to other town officers and boards. Since September 1958 Mrs. Sarah Trussell has been doing general office work of the clerk's office as well as assisting other town officers and boards. Although under the supervision of the town clerk, and charged to the budget of the town clerk's department, the nature of the duties performed by both Mrs. Barnes and Mrs. Trussell classify their duties as general government clerks.


I take this opportunity to express my sincere appreciation to all the townspeople, town officials, and all others who have assisted me in my duties during the year. Also to Mrs. Barnes and Mrs. Trussell for the efficient and loyal service in their work.

The Moderator, Mr. Paul F. Perkins Jr., opened the meeting at eight fifteen o'clock (8:15) in the evening on Monday, March 7, 1960.


Reverend James R. Whittemore offered the invocation.


Moderator: "The first business of the evening is Article 2: "To choose and appoint all other Town Officers in such manner as the Town may determine."


Moved by Mr. Lawrence Lamson and duly seconded: "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor, and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately following."

Moved by Mr. Lawrence Lamson and duly seconded: "That Harold M. Dodge, George Morrow, William W. Bancroft and Ernest M. Barker be elected field drivers for the ensuing year."

Article 3. Moderator: "To hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any other action thereon or relative thereto."


Moved by Mr. William F. Mackenzie and duly seconded: "That the reports of Town Officers and of the Finance and Advisory Committee and all other committees as printed or inserted in the Town Report for 1959, be received and placed on file."


Voice vote. Motion unanimously carried.


Article 4. Moderator: "To raise and appropriate money for Schools, Highways, and all other Town expenses and determine the manner of expending the same."


Mr. John Garland: "The Finance Committee has reviewed carefully the operating expenses of all Town Departments and has given attention to the special article. As you know, there are growing pains of operating expenses of all Town Departments. The town has grown from 2,760 in 1950 to 4,100 in 1955 when the state census was taken. There is no tax relief immediately on the horizon, largely as a result of school expense requirements. Over the past year the cost of living increased over 1%. As you have undoubtedly observed other towns have been more liberal in their wage scale and with this in mind we are recommending a raise of 6%. This will come in the neighborhood of $5,000 which is roughly 50¢ on the tax rate. The budget shows an increase of $80,000 over the 1959 budget. 1959 showed an increase of $107,000 over 1958. The total for the present year is $900,000 as compared to $820,000 last year. Of the additional increase $35,000 is expense of teaching and there is an increase of $10,000 in operation of plant. Altogether, these two additions, along with the regional school, represents $70,000 of the budget. The Highway Department has higher maintenance costs. We recommend a basin cleaner. We have had to borrow equipment from Manchester in the past. The remaining increases are pretty well spread over the other

departments. We recommend Chapter 90, the purchase of the new fire truck, $2,000 for tests increasing water supplies, $2500 for mosquito spraying. We recommend the amount for the communication center which is vital. A Public Works Department under the correct management represents an economy. We do not recommend Article 8 or 9. Article 9 is simply an installment version of Article 8 and is more costly and has little or no merit. This is the same which you quite decisively defeated last year. We certainly see no reason to reverse our thinking on this matter. We still feel $90,000 is an excessive amount and also do not feel that the Town of Hamilton needs to adorn itself in such an elaborate fashion. The Regional School will further our expenditures, the Water Department will be asking for more money to finance their facilities. Surely we recognize the Library's problem but we do not feel this is the solution. In the final analysis the decision is in your hands. In closing, if you follow our recommendations the 1960 tax rate should not increase over $5.00 per thousand. Along with our information and that given to us by the Assessors it could mean a new tax rate of roughly $61.00."

Article 5. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Construction, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence Stone and duly seconded: "That the Town raise and appropriate the sum of $3,500 for Chapter 90 Highway Con- struction on Bridge and Walnut Streets to be expended for the Town's share of the work, and that available funds be used to carry on the work until the Town is reimbursed for the State and County share of the work."


Voice vote. Motion unanimously carried.


Article 6. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Maintenance of various streets in town, or take any other action thereon or relative thereto."


Moved by Mr. William Mackenzie and duly seconded: "That the Town raise and appropriate the sum of $1,000 for Chapter 90 Highway Maintenance on various streets, to be expended for the Town's share of the work and that available funds may be used to carry on the work until the Town is reimbursed for the State share of the work."


Voice vote. Motion unanimously carried.


Article 7. Moderator: "To see if the Town will vote to purchase a new Fire Truck and equipment for use by the Fire Department, provide for the turning in of the present Dodge fire truck toward the purchase price thereof, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence Lamson and duly seconded: "That the Town purchase a Farrar booster tank fire truck for use by the Fire Department, that the present Dodge booster tank truck be turned in on account of the purchase price of the Farrar truck, that the Town raise and appropriate the sum of $8,000 therefor, and that the Selectmen be authorized and empowered on behalf of the Town to take all such action as they consider expedient to consummate such transactions."

Article 8. Moderator: "To see if the Town will vote to authorize the Library Trustees to construct, originally equip and furnish a new library building to provide complete library facilities, and for said pur- poses (a) to employ an architect and let contracts and (b) to transfer to the custody and control of the Library Trustees from the School Committee and the Board of Selectmen a parcel of land on Bay Road on which said Library shall be located, such parcel being of approximately 40,000 square feet, and being bounded approximately 200 feet on Bay Road and approximately 200 feet deep, and lying between the new Fire House and the Elementary School, as more fully shown on a plan on file with the Town Clerk; and for the foregoing purposes to raise and ap- propriate a sum of money, and to determine the manner in which the appropriation is to be raised, whether by borrowing, by taxation, by transfer of available funds, or otherwise, or take any other action thereon or relative thereto."


Moved by Mr. John Neary and duly seconded: "That the Library Trustees be authorized to construct and originally equip and furnish a new library building to provide complete library facilities, and for said purposes to employ an architect and let contracts; that said library be located upon the parcel of land on Bay Road of approximately 40,000 square feet, being bounded approximately 200 feet on Bay Road and approximately 200 feet deep and lying between the new Fire House and the Elementary School, as more fully shown on a plan on file with the Town Clerk, said parcel not being needed by the Selectmen for police or fire purposes, or by the School Committee for school purposes; that the care, custody, management and control thereof be transferred to the Library Trustees; and for the foregoing purposes that the Town raise and appropriate the sum of $90,000., and to meet such appropriation, the sum of $3,000. be transferred from the Excess and Deficiency Account, and the sum of $87,000. be borrowed, and that the Town Treasurer with the approval of the Selectmen, be and he hereby is authorized to borrow said sum of $87,000., to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the applicable provisions of Chapter 44 of the General Laws of Massachusetts; and that the Board of Library Trustees, the Town Treasurer and the Selectmen be and each hereby is authorized to do all acts and things necessary or convenient for attaining said loan and carrying out such work with full power in the premises."

Moderator: "It has been moved and seconded that no action be taken under Article 9. Is there any discussion?"

Article 10. Moderator: "To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or eminent domain for water purposes a parcel of land belonging to Massachusetts Audubon Society and others of approximately six and one-half (61/2) acres."


Moved by Mr. Richard Smith and duly seconded: "That the Town authorize the Board of Selectmen to acquire by purchase or eminent domain for water purposes a parcel believed to belong in part to Massa- chusetts Audubon Society and in part to persons unknown, of approxi- mately 61/2 acres, as shown on a plan on file with the Town Clerk, located Westerly of Highland Street near Pleasant Pond, and adequate rights of way thereto, and for the foregoing purposes the sum of $100 is hereby appropriated, and that the Board of Selectmen hereby is authorized to do all acts and things in the name and behalf of the Town necessary or convenient to carry out such acquisition."

However, if the motion is passed unanimously the necessity of having a rising vote and counting the vote will be avoided. Therefore, the chair will first call for a voice vote to determine whether there is any opposition to the motion.

Article 11. Moderator. "To see if the Town will vote to raise and appropriate a sum of money for the purpose of exploring for additional water for the Town's water system."


Moved by Mr. Richard Smith and duly seconded: "That the Town raise and appropriate the sum of $2,000 for the purpose of exploring for additional water for the Town's water system, including the hiring of engineers, the making of tests and the purchase of equipment for the foregoing purposes."


Voice vote. Motion unanimously carried.


Article 12. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for mosquito control in the Town, the work to be done under the direction of the Board of Selectmen."


Moved by Mr. Lawrence Stone and duly seconded: "That the Town raise and appropriate the sum of $2,500 for mosquito control in the Town, the work to be done under the direction of the Selectmen."

Article 13. Moderator: "To see if the Town will vote to transfer the sum of $4,000 from the Overlay Reserve Account to the Finance Committee Reserve Fund."


Moved by Mr. Thomas Stevenson and duly seconded: "That there be transferred from the Overlay Reserve Account the sum of $4,000 to the Finance Committee Reserve Fund."

Article 14. Moderator: "To see if the Town will vote to transfer the sum of $1,000 from the Cemetery Sale of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery."


Moved by Mr. John Walke and duly seconded: "That there be transferred from the Cemetery Sale of Lots and Graves Fund the sum of $1,000 to the Cemetery Account for improvements of the Town Ceme- tery."

Article 15. Moderator: "To see if the Town will vote to authorize and approve the Board of Assessors to use available funds or "free cash" in an amount not to exceed the sum of $30,000 in determining the tax rate for the year 1960."


Moved by Mr. Thomas Stevenson and duly seconded: "That the Town authorize and approve the Board of Assessors to use available funds or "free cash" in an amount not to exceed the sum of $30,000 in determining the tax rate for the year 1960."


Voice vote. Motion unanimously carried.


Article 16. Moderator: "To see if the Town will vote to establish a radio communication center in the town under Federal Communication Commission license to be operated under the direction of the Selectmen and to enter into an agreement with the Town of Wenham whereby said town may be served by said center by tying in its radio facilities with the center, for which service the Town of Wenham will pay the Town of Hamilton substantially one-half the cost of operating and maintaining said communication center."


Moved by Mr. Lawrence Lamson and duly seconded: "That the Town establish a radio communication center, to be located on the second floor of the Fire House of the Town, to be operated under Federal Communication Commission license under the direction of the Selectmen,

and in connection therewith that the Selectmen be authorized to purchase and maintain radio and incidental equipment for the communication center and for use in town vehicles and installations, and to establish an organization for the operation of the communication center on a 24-hour basis, and to enter into an agreement with the Town of Wenham whereby said town may be served by the communication center by tying in its radio facilities with the Center, for which services the Town of Wenham will pay the Town of Hamilton substantially one-half the cost of operat- ing and maintaining the communication center, and for the foregoing purposes, to raise and appropriate the sum of $9,500 for incidental equip- ment for operating and maintaining the communication center."
