CITY SOLICITOR


Report of City Solicitor

City Council, City of Newburyport.


Gentlemen-In accordance with the provisions of the city ordinance relative to the office of City Solicitor, I have to submit herewith my report for the year 1937.


CASES TRIED.


The case of Winthrop P. Davis vs. City of Newburyport was one of the cases listed for trial at the sitting of the Superior Court here in the city in September. Mr. Davis was suing the City in contract for services performed in his capacity as City Messenger but based his suit on services rendered as a janitor. After a two day jury trial, a directed verdict was rendered in favor of the City on a motion presented by me.


The case of Arthur Sullivan vs. City of Newburyport was tried before a jury at Salem and after trying the case for a day, it was settled. This was a suit for wages as janitor in the New High School and the case was settled for services performed only for the time the school was occupied by the school children. Mr. Sullivan had worked at the New High School for two or three weeks before the school was occupied and felt he was entitled to be paid for that time but the settlement figure excluded this period of time.


George A. Fuller Company vs. City of Newburyport was a controversy over extra work performed in the construction of the New High School. This matter went before an arbitrator and he ruled that the Fuller Company was entitled to around $8,000 against their figure of over $13,000 and he further ruled that the architect should pay Fuller about $4,000 of the $8,000 due. This was not a final settlement of this matter because the arbitration proceedings was a condition precedent to an action at law for the collection of the extras if the court should find in favor of the Fuller Company. No final action was taken in this case up to the period I served as City Solicitor. Numerous hearings were held before the arbitrator both in this city and in Boston.


EASTERN AUTO PARTS INC., vs. BOARD OF ASSESSORS.


This case was tried before the new Tax Appeal Board at Boston and I ap- peared and defended the case for the Assessors. This was an appeal from the refusal of the board of assessors to abate a tax for the year 1936 assessed to the Eastern Auto Parts on personal property owned by it in the City. The final ruling on this case was that the City should abate in the sum of $57.88.
