An Ordinance Entitled Zoning Ordinance for the City of Newburyport
CITY OF NEWBURYPORT

An ordinance to promote the health, safety, morals, convenience and general wel- fare of the community by regulating the use, construction, repair, alteration, height, location, and area of buildings and structures and the use of premises in the City of Newburyport pursuant to General Laws, Chapter 40 and any and all amendments and additions thereto.
Be it ordained by the City Council of Newburyport as follows:
Section I. Definitions.
In this by-law the following terms shall have the meanings hereby assigned to them :
1. Words used in the present tense include the future; the singular number includes the plural and the plural the singular; the word "lot" includes the word "plot"; the word "building" includes the word "structure."
2. A "family" is any number of individuals living together as a single housekeeping unit.
3. A "lot" is a single tract of land held in identical ownership throughout and which is bounded by streets, ponds or waterways or by land of other owners.
4. A "corner lot" is a lot at the junction of and fronting on two or more intersecting streets twenty (20) feet or more in width.
5. A "dwelling" is any building used in whole or in part for human habitation.
6. The "height of a building" is the vertical distance measured at the center line of its principal front from the established grade, or from the natural grade if higher than the established grade, or from the natural grade if no grade has been established, to the level of the highest point of the roof beams in the case of flat roofs or roofs inclining not more than one inch to the foot, and to the mean height level between the top of the main plate and the highest ridge in the case of other roofs. (The "established grade" is the elevation of the street grade as fixed by the City.) The "natural grade" is the ele- vation of the undisturbed natural surface of the ground adjoining the building.
7. A "front yard" is a space across the full width of the lot and extending from the front line of the building located on such lot to the front line of such lot.
8. A "rear yard" is a space across the full width of the lot and extending from the rear line of the building located on such lot to the rear line of such lot.
9. A "side yard" is a space extending from the front yard to the rear yard between a building and the adjacent side line of the lot on which said building is located.
Section II.
Establishments of districts for the purpose of this by-law. The City of Newburyport

is hereby divided into five classes of districts, as follows: 1. General residential districts; 2. Agricultural districts; 3. General business districts; 4. Highway business districts; 5. Industrial districts.
Section 111. Boundaries of Districts.
1. The boundaries between districts are as shown upon said Map. Where zone lines apparently follow property lines they shall be so interpreted. Where a boundary is in- dicated upon a street, the line shall be the center line of the street. Where a boundary is indicated otherwise than above, it is determined by its location on said Map. Where a boundary is indicated approximately parallel to a street, it shall be taken as parallel thereto, and if there is any variance between the scaled distance between the boundaries and the side line of the street and the distance as marked in feet upon the Map, the latter shall govern.
2. Where a district boundary line divides a lot, as existing at the time this by-law takes effect and the major portion of said lot is in the less restricted district, the regula- tions relating to that district may extend as well to such portion of said lot as is not more than thirty (30) feet within the more restricted district.
Section IV. Regulations in General Residential Districts.
In a general residential district, no building or presmies shall be used for any in- dustry, manufacturing or commercial purpose, or for any other purpose except one or more of the following .:
1. General family dwelling.
2. Church and parish house.
3. Schools, library, museum and other purpose of an educational character, hospital, sanitarium, and other medical institution. But not a correctional Institution or place of detention :
4. Public or semi-public institution of a Charitable or Philanthropic character.
5. Club.
6. Public park, playground, recreational building.
7. Real estate sign not over six square feet in area, advertising the sale, rental or lease of the premises on which it is maintained, and not referring to other premises. 8. Any use accessory to the foregoing, as defined in Sec. XXII.
Section V. Regulations in General Residential Districts.
1. Nothing in this section shall prevent the alteration into a two or more family house of a single house existing at the time this by-law takes effect.
2. Alterations to the exterior of any house or structure shall not include over- hanging balconies or overhanging outside stairways on either sides or front.
3. Any front room in any house may be used by the owner or occupant of said house as a small store for the sale of food, clothing or small wares. But in no case shall the owner or occupant be allowed to build any projection beyond as a bay, or addition, which shall project beyond the front or side of said building to be used for the purpose of a store, sale, or store rcom, for the storage of goods to be sold on the premises. In this dis- trict small shops or accessory buildings shall be allowable for persons engaged in trade for the storage of material or equipment, also piles of material may be allowed exteriorly when said piles are not of such a nature as in the opinion of the Board of Appeals to constitute a nuisance.
Section VI. Prohibitions in the General Residental District.
1. Single residences may have a garage for the occupancy of two cars, any building

or structure otherwise than a single residence may have one garage for the use of each tenant, but in no case shall this be construed to mean in the aggregate more than six single garages.
2. No gasoline stations.
3. No row houses.
4. No three decker houses, so-called.
Section VII. Regulations in Agricultural districts.
1. Same regulations as in general residential districts.
2. Also farm market garden, nursery and greenhouse including the sale of natural products raised on the premises, and of articles manufactured on the premises from such products.
Section VIII. Area Regulations.
1. In a general residential district there shall be provided for each principal building a lot frontage of not less than fifty (50) feet.
2. In an agricultural district there shall be provided for each principal building a lot frontage of not less than seventy-five (75) feet.
Section IX. Height Regulations.
In a general residential or agricultural district no building shall exceed a height of two and one-half stories or thirty-five (35) feet to the highest point thereof.
Section X. Yard Specifications.
1. In a general residential or agricultural district no building or part thereof shall extend nearer any street line than twenty (20) feet, except that no building need be set back more than the average of the set backs of the buildings on the lots adjacent thereto on either side, a vacant lot or a lot occupied by a building set back more than twenty (20) feet being counted as though occupied by a building set back twenty (20) feet.
Section XI.
2. No principal building in a general residence or agricultural district shall have a side wall nearer to any lot line than ten (10) feet, and no sheds, shops or other accessory buildings in these districts shall have a side wall nearer than five (5) feet to any lot line.
3. No principal building in a general residential or agricultural district shall have a rear wall nearer than thirty (30) feet to any rear lot line.
4. And no shop or shed or other accessory building shall have a rear wall nearer than five feet to any rear lot line.
Section XII.
No driveway or other means of access for vehicles other than an accepted street, shall be maintained or used in a general residence or agricultural district for the servicing of a commercial or industrial building located in a business or industrial service.
Section XIII. Business Districts.
In a General or Highway Business district, no building or premises shall be used for manufacturing or industrial enterprises or their accessories, except such as are clearly in- cidental to a retail business lawfully conducted on the premises and such as would not be prohibited in an Industrial district, or for any other purpose except one or more of the following:
