AN ORDINANCE ENTITLED AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "TRAFFIC ORDINANCE"


Whereas certain cars parked on streets and ways, interfere with the plow- ing and removing of snow from streets and ways thereby place in jeopardy the health and safety of the people or the peoples property, therefore, this ordinance is hereby declared to be an emergency ordinance, necessary for the immediate preservation of the health and safety of the people or their property and shall take effect immediately upon its passage.


BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWBURYPORT AS FOLLOWS: Article 5 of Chapter Thirty-One of the Revised Ordinances of the city of Newburyport is hereby amended by inserting at the end thereof the follow- ing clause :


Section 13: The Superintendent of Streets or other officer having charge of ways for the purpose of removing or plowing snow or removing ice from any way, is hereby authorized to remove, or cause to be removed, to some convenient place, including in such term a public garage, any vehicle in- terfering with such work, and for imposing liability for the cost of such removal, and of the storage charges, if any, resulting therefrom, upon the owner of such vehicle.

AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED "TRAFFIC ORDINANCE"


BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWBURYPORT AS FOLLOWS : Article 5, section 7, is hereby amended to read as follows:


No person shall park a vehicle for longer than one hour between the hours of seven A. M. and five P. M. during week days on both sides of Merrimac Street between Warren and Oakland Streets.


There shall be no vehicle parking, or live parking, on Merrimac Street, both sides, between Broad and Tyng Streets, during the period from four forty-five P. M. to five-fifteen P. M. week days.


No person shall park a vehicle for longer than one hour on Carter Street between Merrimac and Monroe Streets on week days, except Saturdays, be- tween the hours of seven A. M. and five P.M.

AN ORDINANCE ENTITLED AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "TRAFFIC ORDINANCE" BY ADDING THE FOLLOWING PARAGRAPH TO ARTICLE 1, AND AMENDING ARTICLE 5 OF CHAPTER 31 OF THE REVISED ORDINANCES OF THE CITY OF NEWBURYPORT BY INSERTING AT THE END THEREOF THE FOLLOWING CLAUSE:


Be it ordained by the City Council of the City of Newburyport that the traffic ordinances be and hereby amended as follows:


By adding the paragraphs set forth below at the end of Article 1, of existing ordinances.


(z) "Person" - The word "person" shall mean and include an individual, firm, co-partnership, asociation or corporation.


(AA) "Parking Meter" - The words "Parking Meter" shall mean any mechan- ical device, not inconsistent with the provisions of this regulation, and placed or erected on any public way within the City of Newburyport for the regulation of parking. Each parking meter installed shall in- dicate by proper legend the legal parking time established by this ordi- nance and when operated shall at all times indicate the balance of legal parking time permitted and at the expiration of such period shall indi- cate illegal or overtime parking.


(BB) "Parking Meter Zone" - The words "Parking Meter Zones" shall mean and include any street or portion thereof upon which parking meters are installed and in operation and upon which parking of vehicles is permitt- ed for a limited time subject to compliance with the further provisions of this regulation.


(CC) "Parking Meter Space" - The words "Parking Meter Space" shall mean any space within a parking meter zone, adjacent to a parking meter which is duly designated for the parking of a single vehicle by lines painted on the surface of the street adjacent to or adjoining each parking meter: and


By including in Article Five and at the end thereof the following:


No person shall park a vehicle for a period of time longer than one hour, between the hours of nine o'clock A. M. and six o'clock P. M. on any of the streets hereinafter designated in this section, or as may hereafter be fixed by ordinance on any day, except that on Fridays, and on days prior to legal holidays, the limited parking time shall apply be- tween the hours of nine A. M. and nine P. M. This restriction shall not apply on Sundays or during the hours of legal holidays during which busi- ness establishments are required by law to remain closed.

ORDINANCES


In accordance with the foregoing, parking meter zones are hereby est- ablished in the following streets or parts of streets:


PARKING METER ZONES


Lower side of State Street from Garden Street to Market Square.


Upper side of State Street from Harris Street to Market Square.


On lower side of Green Street from Merrimac Street to Telephone Office.


On upper side of Green Street from Merrimac Street to Baptist Church.


Oh southwesterly side of Pleasant Street from State Street to Titcomb Street.


On northeasterly side of Pleasant Street from State Street to Titcomb Street.


On Inn Street on northwesterly side from Bartlett Street to Fleasant Street.


On Inn Street on southeasterly side from Market Square to Pleasant Street.


Sec. 14. A The Public Safety Committee is hereby empowered, with the approval of the Mayor to contract, in accordance with provisions of Chap- ter 40 as amended by Chapter 442 of the Acts of 1947, for the acquisition and installation of parking meters provided for by this ordinance and to maintain said meters in good workable condition.


B The Public Safety Committee is hereby authorized and direct- ed to install parking meters within the areas described in this ordinance or cause the same to be so installed. The meters shall be placed at in- tervals of not less than 20 feet apart and not less than 12 inches nor more than 24 inches from the face of the curb adjacent to individual me- ter spaces. Meters shall be so constructed as to display a signal show- ing legal parking upon the deposit therein of the proper coin or coins of the United States as indicated by instructions on said meters and for such period of time as is or shall be indicated by said instructions. Said signal shall remain in evidence until expiration of the parking pe- riod designated at which time a dropping of a signal automatically or some other mechanical operation shall indicate expiration of said park- ing period.


C The Public Safety Committee is hereby authorized and di- rected to establish parking meter spaces, in such parking meter zones, as are herein specified, or as may be hereafter fixed by ordinance, and to indicate the same by white markings upon the surface of the highway.

ORDINANCES


D Whenever any vehicle shall be parked and adjacent to a park- ing meter, the owner or operator of said vehicle shall park within the space designated by street marking lines and, upon entering such space shall immediately deposit in said meter the required coin of the United States for maximum legal parking period both as indicated or shown on the meter and if so required set the mechanism in motion.


The fee for the maximum parking time shall be five (5) cents or one (1) cent for each proportionate period of said maximum limit, as shown on the meter.


(1) It shall be unlawful for any person to deposit or cause to be deposited in a parking meter any coin for the purpose of per- mitting the vehicle of which he is in charge to remain in a parking space beyond the maximum period of time allowed in a particular zone.


(2) It shall be unlawful for any person to park a vehicle within a parking meter space unless such vehicle is wholly within the painted lines adjacent to such meter.


(3) It shall be unlawful for any unauthorized person to temper with, break, injure or destroy any parking meter or to deposit or cause to be deposited in such meter any slugs, device or metallic substance or any other substitute for the coins re- quired.


E Operators of commercial vehicles may park in a metered space without depositing a coin for the period not to exceed 30 minutes for pur- poses of loading or unloading. Parking in excess of this time limit with- out depositing the proper coin shall be deemed a violation of the provi- sions of this ordinance.


F The City Marshal is hereby designated as the person authori- zed to collect monies deposited in parking meters or to cause the same to be so collected. Such monies shall be deposited forthwith with the City Treasurer in a separate account to be known as the City of Newburyport Parking Meter Account.


G All fees received by said Treasurer of the City of Newbury- port from the operation and use of parking meters shall be used as auth- orized by Statute 1947, Chapter 442, and the General Laws. H It shall be the duty of police officers to enforce the pro- visions of this section.


I Any person who violates any parking provision of this ordi- nance shall be subject to the penalities provided by Chapter 90, Section 20A of the General Laws and any violation shall be punishable as may be provided by law.

AN ORDINANCE ENTITLED AN ORDINANCE TO ABOLISH IN ITS ENTIRETY SEC- TION 7, OF THE ORDINANCES WITH REFERENCE TO THE PUBLIC LIBRARY.


Be it ordained by the City Council as follows:


Section 7 of the rules of the Public Library is hereby abolished and the following is established under the heading of section 7 as follows:


Section 7. The people of Newbury and West Newbury over the age of fourteen are entitled to all the privileges of the Public Library provided said towns pay their proportionate part of the expenses of operating said Library, said pro- portionate part shall be appraised and apportioned by the Trustees of said Public Library.
