The case of Mary Nelson is one wherein she sues to recover $4,000 for injuries claimed to have been sustained by reason of falling on an alleged defective sidewalk on Old Colony street, February, 1895. This case is on the list at Dedham.
Bridget Dolan's suit is also for personal injuries sustained, she claims, by reason of an alleged defeet in the sidewalk on Hancock street near the corner of Walnut street, consisting of uneven snow and ice which occasioned her to fall. She has sued for $4,000 damages. Accident happened January 29, 1895, about 4.30 P. M.
Any information or fact in the possession of citizens who may read this report in reference to any claim or suit against the City, will be greatfully received by the Solicitor. Know- ledge of the condition of the particular sidewalks and streets where an accident occurs at the time of the accident or there- abouts, is always of value to the law officers in defending the City.
Mr. Cotter's suit is an action of contract to recover $4,081 with interest and costs, for professional services aud disburse- ments of himself, Mr. Jenney and Mr. Ormsby, in reference to bringing and arguing a bill for instructions before the Supreme Judicial Court in the matter of the Woodward Fund. The case is reported as that of the City of Quiney vs. the Attorney Gen- eral.
Mr. Cotter and Mr. MeAnarney presented to the Board of managers of the Woodward Fund a bill for services and dis- bursements in this matter for $4500, which included as well the services of Mr. Jenney and Mr. Ormsby. The question was raised as to whether or not the City Solicitor could legally charge for his services, whereupon Mr. Cotter withdrew Mr. McAnar- ney's name from the bill and presented the bill for $4,081.00 subsequently sued on. The suit has been referred to Andrew J. Bailey as Auditor, who will make a finding on all the facts. Both the City and Mr. Cotter reserve the right to determine the matter before a jury.

On behalf of the City I appeared before the Commissioners appointed by the Supreme Court under Sec. 10. Chap. 407, of the Acts of 1893 and Chap. 288 Sec. 8 of Acts of 1894 to ap- portion the cost of the Boulevard and Park reservation among the thirty-seven cities and towns comprising the Metropolitan Park District tor a term of five years. There were over a dozen hearings, all of which I attended and at my request the Com- missioners came to Quiney and viewed the City in reference to its sitnation to the Blue Hill Reservation.
The City of Quincy first advanced the theory, which was strongly opposed by Brookline and other cities and towns, that lue allowance should be made for losses to the cities and towns sustained by reason of the taking for public purposes taxable property within their respective limits, in offset to any particular benefit which they might derive by reason of proximity to any large reservation.
The Commissioners filed their report July 9th, 1895, in which they adopted this principle among others in making up their plan of apportionment and assessed Quiney .01358944 per cent for cost and maintenance of parks and .01060804 per cent for cost of boulevards.
I was informed by the Secretary of the Metropolitan Park Board that Quiney's contribution under this assessment would be about $417.93 per year for cost of parks, possibly as much more for maintenance and 835.46 per year as its share of the cost of boulevards.
The report of the Commissioners is now before the Supreme Judicial Court on appeal by Somerville and other cities and towns who were aggrieved by the plan of apportionment adopted.
I appeared before the Committee of the legislature on sewerage matters and had many conferences with Mayor Hodges, Mr. Rice, Mr. Pinkham, the representatives of Milton, Hyde Park, Dedham and the City of Boston in reference to different provisions of the bill which subsequently became a law and is known as Chap. 279, Aets of 1895, "An act to authorize the City of Quincy to construct a system of sewerage."
By the instructions of Mayor Hodges, I appeared before

the Legislative Committee on County Estimates and objected to the estimates submitted by the County Commissioners of Nor- folk County for County expenditures for 1895.
The Committee allowed the amounts asked for upon the as- sertion of Chairman Morrill of the Commissioners that the sums were needed and would be expended for the purposes specified. Subsequently in June and November the County Commissioners transferred $24,000 from different accounts to expenditures on Dedham Court House in violation of this understand- ing.
There has been pending before the Board of County Com- missioners since 1890, a petition by the City for the widening of the bridge and approaches over the railroad on Hancock street near the Atlantic Station. Owing to the fact that the personnel of the Board of County Commissioners had almost entirely changed since the views and hearings had taken place, new views and hearings had to be given.
I have had the County Commissioners out to view the premises and there has been one hearing. The matter has been temporarily suspended to enable the railroad's and city's engi- neers to agree upon plans for the construction of a new bridge. As soon as the plans are completed I will see that the views and hearings are given for the final adjudication by the Com- missioners.
During the past year there has been the usual number of claims made against the City for damages for injuries on high- ways and claims for damages done to real estate, which have not been sued upon and some of which have been settled by Mayor Hodges and myself, when upon an examination of the facts it seemed expedient so to do.
I have made my headquarters for the transaction of City business at City Hall. I desire to suggest the advisability of making provisions for the Solicitor, his papers and his library in any proposed plans for the remodeling of the offices.
When requested, I have submitted legal opinions in writ- ing to the Mayor and the City Council, and have also rendered

assistance to the heads of departments and Committees of the Council.
