SECT. 4. Whoever violates any provision of the preceding sections of this ordinance shall be liable to a fine not exceeding one' hundred dollars.
SECT. 5. No person shall proceed to erect or make alterations in the location or grade of any fence. wall or building, a part of which is to abut upon a public street, lane, square or alley, without first applying to the City Engineer for the lines and grade of the street, lane, square or alley upon which he intends to build. Such application shall be made at least fifteen days before the work is begun ; and the City Engineer shall within said time furnish the required lines and grade withont charge, if in his power so to do. In default of such application the city shall be discharged from all responsibility for damages resulting from such default.
SECT. 6. Whenever the City Engineer ascertains that any structure has been placed in violation of the preceding section. he shall at once give notice to the Mayor and Aldermen, in writing, of such violation ; and upon receipt of such notice the Mayor and Aldermen may forthwith issue an order to the party offending, directing that the structure be removed within the time therein specified ; and in case of non compliance, the Mayor and Alder- men shall direct that the incumbrance be removed at the expense of the delinquent.

RULES AND REGULATIONS.
RULE 1. Every tenement shall be provided with a suitable water-tight privy vault, or with a water closet connected with a water-tight under-ground drain of proper size to carry off the contents, and with a similar drain to carry off the waste water to a cess-pool.
No owner or occupant of any tenement or building shall permit any sewerage, filth, contents or drainage of a privy-vault, cess- pool, sink drain or other source of filth of said tenement or build- ing, to empty, enter, or drain into any street or drain of the City, or any brook, stream or pond of water.
Every privy-vault or cess-pool shall be built in a thorough and substantial manner, and located so that the inside of the.same shall be at least three feet from the line of any adjoining lot or street ; cess-pools must be of sufficient size to contain at least eighty cubic feet, and when not water-tight must be at least twenty feet from the cellar wall of any tenement or dwelling, and two rods distant from any well, spring or other source of water supply used for culinary purposes.
All drains, privy-vaults and cess-pools shall be kept in thorough repair.
Privy-vaults and cess-pools shall be emptied and cleansed at least once each year, and at such other times as may be necessary to prevent their becoming offensive, or whenever they are filled to a point within eighteen inches of the surface of the ground, and whenever required by the Board of Health or Health Officer.
If the occupant neglect to empty and cleanse any vault or cess- pool within forty-eight hours after notice to do so, the Board of Health may have the same emptied and cleansed, and the expense incurred in so doing shall be paid by the owner or occupant of the estate. Earth-privies or closets may be established where dry earth or ashes is added to the deposit vaults in sufficient quantity to absorb all moisture, and the entire contents are removed weekly.
RULE 2. No cess-pool or privy-vault shall be emptied except by a person especially authorized by a member of the Board of Health, or Health Officer, nor in any mode or time than that so authorized.
RULE 3. No person shall drive any cart or other vehicle, or carry any vessel containing night-soil or other offensive matter, in any street between the hours of four o'clock A. M. and ten o'clock P. M. between the first day of April and the following September inclusive, nor between the hours of five o'clock A. M. and nine

o'clock P. M. during the remainder of the year, except by permis- sion of the Board of Health.
RULE 4. Each family shall have a properly covered receptacle for swill or house offal.
RULE 5. Offal and swill shall be collected and carried in the street only by such persons as may be authorized by the Board of Health, and shall be carried only in closely covered carts, boxes or other tight vessels. Offal and swill shall be removed from every inhabited building not less than three times a week between the first day of April and the following November inclusive, and not less than twice a week during the remainder of the year.
RULE 6. No person shall boil, burn or decompose in the city, any bones or other refuse parts of neat cattle or other animals.
RULE 7. No animals affected with an infectious or contagions disease, shall be brought within the limits of the city. No diseased animal or its flesh shall be sold or offered for sale; and no decay- ing, diseased or unwholesome meat, fish, vegetables, fruit or other articles of food, shall be sold or offered for sale in the city.
RULE 8. All putrid, decaying or decayed animal or vegetable matter shall be removed from cellars and out-buildings on or before the first day of June in each year. No fish, slaughter- house offal or other decaying animal matter, contents of vaults. privies, or cess-pools, shall be permitted to remain upon land for purposes of fertilization, without being plowed in or otherwise rendered innocuous and inoffensive.
RULE 9. Every person in whose dwelling there shall occur a case of cholera, yellow-fever, small-pox or varioloid, shall immedi -! ately notify the health officer of the same, and, until instructions are received from the Board of Health or Health officer, shall not permit any clothing or other property that may have been exposed to infection to be removed from the house; nor shall any occu- pant take up a residence elsewhere without consent of the Board.
RULE 10. Any physician who may be called to any case of either of the diseases specified in the foregoing regulations, or to any case of Diphtheria, Scarlet Fever, Typhus or Typhoid Fever, Dysentery, Cerebro-Spinal Meningitis or Cholera Infantum, shall report such case immediately to the Board of Health or Health officer and receive instructions in regard thereto.
RULE 11. All persons affected with either of the diseases specified in Rule 9, and all articles infected by the same, shall be immediately separated from all persons liable to contract or com- municate the disease, and none but nurses and physicians shall be allowed access to persons sick of said diseases ; and no person, sick of any of said diseases shall be removed at any time except by permission and under the direction of the Board of Health ; but all persons infected of either of said diseases, who cannot be properly quarantined, may be removed according to law to such hospital or other place as the Board of Health may direct, and no person shall obstruct, hinder or oppose such removal.

RULE 12. When any person dies of either of the diseases mentioned in rule 9, or of diphtheria or scarlet fever, the body shall be buried in accordance with instructions of the Board of Health, and if placed in a receiving toinb shall be enclosed in a metallic coffin hermetically sealed.
RULE 13. All bedding and personal clothing or other personal property affected with contagion or infection by either of the diseases referred to in Rule 12, shall be at once properly cleansed and fumigated, destroyed, or otherwise treated as the Board of Health may direct.
RULE 14. No person or article liable to propagate a dangerous disease, shall be brought within the limits of the city, without special consent and direction of the Board of Health; and whenever it shall appear to any person that such person or article has been brought into the city, immediate notice thereof shall be given to the Board, specifying its location.
RULE 15. No child from any family in which a case of Small- Pox, Varioloid, Diphtheria, Scarlet Fever, Typhus Fever, .or Cholera shall occur, shall attend any school in this city until the expiration of four weeks from the commencement of the last case in such family, without a written permit from the Board of Health. Such length of time shall be certified in writing by a physician or some responsible member of the family ; the certifi- cate to be presented to the teacher of the school before the child is admitted.
RULE 16. All persons above two years of age, who have never been vaccinated, must be, immediately.
RULE 17. No teacher or other person shall be appointed to any position in any public school until he or she has furnished to the School Committee a certificate of a regular physician that he or she has been vaccinated within five years.
The School Committee are required to demand such certificates before making such appointments.
Attention is called to the following requirements of the General Statutes regarding vaccination :
CHAP. 26, SEC. 27. Every child must be vaccinated before two years of age.
SECTION 30. All incorporated manufacturing companies shall canse each new employee to be vaccinated on entrance unless proof is furnished of successful vaccination within five years. The same provisions apply to the keepers of almshouses in reference to each new inmate.
CHAP. 41, SEC. 8. The School Committee shall not allow any child to be admitted to or connected with the public schools who has not been vaccinated.
The Board of Health earnestly recommend that all children should be vaccinated before six months of age, and that all per- sons be re-vaccinated as often as once in five years.

RULES OF BOARD OF HEALTH.
RULE 18. The following regulations for the construction of house-drainage shall apply to all hotels, tenements, dwelling- houses and other buildings hereafter erected in the City of Newton.
SECTION 1. Material .- That portion of the house-drain which is outside of the building, and more than four feet from the foun- dation walls, shall be constructed of iron pipe or the best quality of drain pipe.
That portion of the house-drain inside the wall or under the building, and also that portion outside the building and within four feet of the foundation walls, together with the soil-pipe, shall be constructed of iron pipe with leaded joints.
The waste-pipes connecting with the conductors from the roofs, and all other pipes inside the building or outside within four feet of the foundation walls, shall be constructed of lead or iron, with leaded joints.
SECTION 2. Grades. The house drain and other pipe for the conveyance of sewage shall be laid with uniform grade, and a fall of not less than one inch in four feet, except in cases where the City Engineer may permit otherwise.
SECTION 3. Traps. The house-drain shall be provided with a trap which shall be located outside of all house connections.
Every pipe connecting a water-closet with a soil-pipe shall be trapped close to the connection with the water-closet.
All waste-pipes shall be trapped, each separately, and close to the connection with the bath, sink, bowl or other fixture.
SECTION 4. Ventilation. AH soil-pipes shall be carried at their full size through the roof and left open. A provision shall also be made for admitting air to the house-drain on the house- side of the main trap.

SECTION 5. Workmanship. The joints in the drain-pipe shall be carefully cemented under and around the pipe, and the joints in the iron pipe shall be run and caulked with lead.
All changes in direction shall be made with curved pipes, and all connections shall be made with Y branch-pipes.
All joints and pipes shall be made air-tight.
The whole work to be executed by skilful mechanics in a thorough, workmanlike manner, and satisfactory to the Board of Health.
SECTION 6 Plans. Before proceeding to construct any portion of the drainage-system of a hotel, tenement or dwelling- house, the owner, builder, or person contracting the same. shall . file with the City Engineer a plan thereof, showing the whole drainage-system, from its connection with the common sewer. or cess-pool, to its terminus in the house, together with the location of all branches, traps. ventilating pipes and fixtures.
RULE 19. Whoever shall violate any provision of these rules shall be liable to a fine not exceeding one hundred dollars, and a like penalty for every day after the first that an offence shall be continued.
