The following is the full text of the law which applies to every policy issued by the BERKSHIRE 011 or after January 1, 1881, and which secures to each member the full benefit of all payments made by him. This is done without any action on his part, and no surrender of the policy within a given time is necessary. By the operation of this law the policy becomes a paid-up as shown by the preceeding table of examples. The amount secured at the ages omitted in the tables can be easily approximated.
The Limited Forfeiture Law of 1880. [CHAP. 232.]
AN ACT limiting the Forfeiture of Policies in Life Insurance Companies.
Be it enacted, etc., as follows :
SEC. 1. No policy of life or endowment assurance issued by any company incorporated or organized under the laws of this Commonwealth shall become forfeited or void for non-payment of premium after two full annual premiums shall have been paid thereon, in cash or note, or both; but upon default in any subsequent premini payment such policy shall become subject to the conditions hereinafter ex- pressed.
SEC. 2 In case of default in the payment of a third or any subsequent annual preminm on any pol- icy issued as aforesaid, then such policy, without further negotiation or stipulation, shall be binding upon the company for an amount of paid ap insurance which the then net valne of the policy, less any indebtedness of the assured to the company and a surrender charge as hereinafter provided will pur- chase as a net single premium for life or endowment assurance, maturing or terminating at the same time and in the same manner as provided in the original policy contract; that is to say, no condition of the policy contract, other than for the payment of premiums, shall be affected by the provisions of this act; nor shall any change be made in the terms of said contract on account of default in premium pay- ment, after two full annal premiums have been paid as provided in section one of this act, except as herein set forth. The net value of the policy, including all dividend additions declared thereon at the date of said default, shall be ascertained according to the combined experience or actuaries' rate of mortality, with interest at four per cent, per annum; and from such value shall be deducted any indebtedness of the insured to the company, or notes held by the company against the insured, and a surrender charge to be determined as hereinafter provided.
SEC. 3. 'Said snrrender charge shall be determined as follows: Assuming the rate of mortality and interest aforesaid. the present value of all the normal future yearly costs of insurance, which by its terms said policy is exposed to pay in case of its continuance, shall be calculated, and eight per cent. of this sum shall be the legal surrender charge.
SEC. 4. Whenever after the payment of two annual premiums as aforesaid the insurable interest in the life of the insured has terminated. the net value of the policy, subject to the conditions named in section two of this act, shall be a surrender value payable in cash: Provided, also, that upon the termination of such insurable interest the holder of any policy upon which by its terms no further premiums are payable, may upon any anniversary thereof claim and recover in cash from the company a surrender value computed as aforesaid; and provided, further, that upon policies of prudential or industrial insurance, on which the premiums are five cents per week and upwards, but not exceeding fifty cents, the said surrender value shall in all cases be payable in cash.
SEC. 5. The insurable interest named in section four of this act shall be construed to have termi- nated when the insured has no minor or dependent child; and his wife, if he has one and any living beneficiary or beneficiaries named in the policy shall join in the application for surrender thereof.
SEC. 6. The provisions of chapter one hundred and eighty-six of the aets of eighteen hundred and sixty-one shall not apply to any policy issued subsequent to the thirty-first day of December, eighteen hundred and eighty.
Sec. 7. This act shall take effect on the first day of January, cighteen hundred and eighty-one [Approved April 23, 1880.
This law absolutely secures to every member the equity allowed on policies on which payments are discontinued.
It does not require any action on the part of the assured to secure its benefits.
All policies on which payments of premium are discontinued, will mature at the time named in the contract.
Policies for the whole term of life will mature at death.
Endowment policies will mature at the end of the term specified.
The sum payable is proportionately reduced, but the amount is fixed by the law, and it is for the largest amount that any actuary has ever claimed should be allowed as an equitable consideration to a member discontinuing the payment of premiums.
Other valuable privileges are conferred, and it is believed by the officers of the Company that the law taking effect January 1, 1881. leaves no benefit to lapsing members unconferred which a reasonable prudence will permit.
Policies of previous date to January 1, 1881, are governed by the non-forfeiture law of 1861, under which the BERKSHIRE has paid many thousands of dollars on claims which, under the laws of other states, would have been entirely worthless.
The BERKSHIRE has the benefit of twenty-nine years of successful experience.
It issues all approved forms of Life and Endowment policies.
Its business is conducted on the mutual plan, thus enabling members to get their insurance at cost.
It aims to afford all that is desirable in Life Insurance.
