TOWN CLERK'S REPORT


the valuable records may be certain of preservation. While it is true that these new things have cost the Town some money, yet it seems worth while, as it puts the office on a better and more efficient footing, more available, more lasting and more responsive to the public needs. I would also call attention to the fact that in this report I have made an inno- vation, which I hope will meet the approval of the people. You will find for the first time a complete published record of every death, marriage and birth which has occurred in the Town this year. I am doing this and making my report as complete and as full as lies in my power, because I have a firm belief that every public servant should make a strict accounting to the people, who are his masters and employers, of what transpires in his office. I am, therefore, taking ad- vantage of the opportunity afforded me of giving a careful account of my stewardship. In conclusion, permit me to say that during the past year I have endeavored to be a true and impartial servant of all the people of the town regardless of faction, click, or party, and I assure you it has been a very genuine pleasure to me to have been given the oppor- tunity of being associated with the sovereign people of the town in the administration of their government, and I most earnestly and sincerely thank you for that honor and that opportunity.

Selectmen's Report


Appointments :


The regular appointments have been made as required by law. Their names appear in the list of town officials.


School Street :


School Street has been rebuilt as ordered by County Com- missioners and is finished with the exception of shaping and rolling. We expect to finish the road within the county engi- neers' estimate of $3,500.00 of which sum the county will reimburse the Town the sum of $800.00 and engineers' ex- penses when the road is completed.


Concord Road :


The work of rebuilding Concord Road has been continued during the past year under the direction of the County Engi- neers, and is finished with the exception of shaping and rolling fron Training Field Road to the Railroad Crossing, and the building of about five hundred feet of railing.


Through the effort of one of our citizens, the Massachu- setts Highway Commission contributed the sum of $1,000.00 to be used on the improvement of Concord Road from Clay Pit Road to the Railroad Crossing with the understanding that the town and county expend each a like sum.


Sidewalk:


We found the sidewalks, in many places, in dangerous condition and have had them thoroughly repaired.


Electric Lights :


Four additional electric lights have been installed as follows:

SELECTMEN'S REPORT


Culverts:


The culvert on Pelham Island Road has been rebuilt with concrete of ample size to take care of the flow of water.


Town Hall:


The seats in Town Hall have been secured to floor, wall rail put on stairs, fire escape improved and repaired, electric lights installed on same, and other changes and repairs made as ordered by the state inspectors of buildings .. Water has been piped to sink in kitchen at Town Hall as per vote of the town.


We have settled the claim of Dr. Newhall of $139.00, for professional services rendered to a soldier's widow against the Town, contracted in 1911. We considered it was for the best interests of the Town to settle and have settled the claim for $75.00.


A telephone has been installed in Selectmen's room which we find to be very convenient for Town Officials to conduct a Town business at a very small expense ..


Considerable trouble and expense has been caused the past year by dogs, a large part of which was caused by dogs running wild in the north part of the Town. We have had them hunted and killed.


We have granted the Boston & Middlesex Street Railway Co. the right to become common carrier of baggage and freight in the Town under conditions as shown in the following order.

Order of the Town of Wayland Granting to the Middle- sex & Boston Street Railway Co. Permission to Carry Baggage and Freight


WHEREAS the Middlesex & Boston Street Railway Company has !presented to the Selectmen of the Town of Wayland a petition asking that said Board approve of its act- ing as a common carrier of baggage and freight upon its railway in said Town under and by virtue of Chapter 202 of the Acts of 1903, as amended by Chapter 441 of the Acts of 1904, and


WHEREAS notice has been given to all persons interested by publication of said petition as required by law, said publica- tion being at least fourteen days before the time appointed for said hearing, and


WHEREAS said hearing has been duly had and


WHEREAS the subject-matter has been duly considered by said Selectmen, it is hereby


VOTED :


That said Selectmen hereby approve of the exercise by said Middlesex & Boston Street Railway Company and its successors or assigns of the rights granted and permitted by said Acts to act as common carriers of baggage and freight, as petitioned for, upon and over its tracks located within the Town of Wayland.


This approval is upon the following regulations and re- strictions :----


FIRST :- Said Company shall not engage in the business of common carriers under the authority of said Acts and this approval until, and then only to the extent that, the Board of Railroad Commissioners, upon petition shall certify public con- venience and necessity require.


SECOND :- Said Company acting under said authority shall be subject to such regulations and restrictions as may

from time to time be made by said Selectmen with the approval of said Board of Railroad Commissioners.


THIRD :- Said Company shall also be subject to the pro- visions of all laws now or hereafter in force relating to common carriers so far as they shall be consistent herewith and with said regulations and restrictions.


FOURTH :- The exercise of the authority under said Acts by said Company shall not in any way alter or prejudice the duties and obligations of said Company imposed by law relative to the transportation of passengers upon its tracks within said Town, nor delay the cars for passenger service, nor reduce the facilities for such service.


FIFTH :- While acting as a common carrier, said Com- pany shall not run its baggage or freight cars at any time at a higher rate of speed than is consistent with public safety, or than it runs its cars for the transportation of passengers, and all such cars shall be provided with usual fenders and safety brakes and shall be in charge of an adequate number of em- ployees.


This order shall be construed to grant approval for the carrying and transportation of such kinds of packages, parcels, goods and merchandise, of such bulk, size, weight, and dimen- sions as are ordinarily carried and transported by express companies in wagons, upon and over highways and not for the transportation of heavy freight, nor of any articles, goods or merchandise dangerous to public travel or the safety and com- fort of passengers, such as dynamite or other explosives of a dangerous nature or such as would be likely to interfere with the conduct of its business as a common carrier of passengers.


SIXTH :- This vote is passed and approval given upon the express condition that the authority herein granted shall be exercised in conformity to such regulations, restrictions and by-laws as the Selectmen and the Town of Wayland may from time to time establish, subject to the approval of the Board of Railroad Commissioners.

SELECTMEN'S REPORT


SEVENTH :- This vote is passed and approval given upon the express condition that the authority herein granted shall be exercised by said Middlesex & Boston Street Railway Company on or before April 1st, 1915. Failure upon the part of said Company to exercise said authority by said date renders this entire franchise null and void.


This authority to act as common carriers may be revoked by the Selectmen for any violation thereof, subject to the approval of the Railroad Commissioners.
