John Newman, administrator of the estate of Antepas New- man of Wenham, deceased, presented an order from the General Court allowing him to sell real estate for the payment of debts, and upon testimony of Capt. John Corwin and Mr. Daniell Epps that it was necessary, court approved of the sale of land to Thomas Fisk .*


Upon motion made to this court by Mr. Timothy Lindall for explanation of the court order of Nov., 1681, concerning the appraisal of Robert Starr's part of house and land, court de- clared that they were to divide the estate of house and land as equally as possible into three parts. The house not being divisible, they were to make the portions equal by land.


John Beasely, Feb. 24, 1682-3, acknowledged judgment to Mr. Timothy Lindall in fish, before the Worshipful William Browne and Bartholmew Gedney, Esqrs.

Execution, dated Dec. 7, 1682, against Isaac Reade, to satisfy judgment granted Andrew Tarvice, June 27, 1682, at Salem court, signed by Hilliard Veren,* cleric, and served by Henery Skerry,* marshal of Salem, said Reade agreeing to deliver 4 1-2 bushels of Indian corn to Tarvise, 2 cords of wood at Mason's house in the town, and 3s. worth of wood to the marshal.


Execution, dated July 1, 1682, against William Dutten, to satisfy judgment granted John Lambert, sr., June 27, 1682, at Salem court, signed by Hilliard Veren,* cleric, and served by Henery Skerry,* marshal, who also appointed Marshal Webbe of Boston, his deputy.

Inquest, dated Oct. 14, 1682, upon the death of John Cole returned by Ensign William Buswell, Mr. Georg Goldwin, Sargt. Henry True, Abra. Morell, Joseph Nortn, John Osgood, Mr. John Stockman, Eph. Winsley, Philip Grely, Andrew Grely, Moses Gill and Steevn Flanders, "we found him Lying upon his back in the open marsh he had been wanting three days before we found him in wch tim ther had ben 2 cold nights his age was about 90 years by the wetnes of his clothes & other signes we Judged that he had sliped in to a creek & gott out againe his hate he had left upon a stump on the upland we saw no wound about him so that all things considered according to the best of our understanding we Judg that his death was occasioned by the cold overcoming him." Examination of several persons taken at Marblehead, Sept. 12, 1682, by the jury empannelled by constable Elias Hendly of Marblehead upon the death of one Robert Phillipson, late Seargeant of Pemmaquid, who came along in the sloop Susanna, James Cooke, commander, "and died here suddenly as he came ashoare befor he entered into any house in this towne:" James Cooke, John Butler and Thomas Creach testified that Philipson came aboard the sloop at Boston about two or three o'clock in the morning and they knew of no difference with any one on board neither did they see him eat or drink anything but a dram out of the same bottle they drank from. Cooke and Creach were with him when he died, "and being first taken wt the mes- senger of death as he came along the streets he cryed out I faint and the Lord help me and died halfe a quarter of one hower affter." Richard Norman and James Dennis testified that they saw no violence. The jury, Richard Knott,* Ambroas Gall,* John Legg,* James Dennes,* John Peach, Thomas Dixey," Edward Berry,* Thomas Smith,* John Curtis,* Elazer Ingls,* William Hine* and Archbald Ferguson,* returned that he died a natural death.

SALEM QUARTERLY COURT


Dan. Ladd, sr., Thomas Whittier, George Browne, Robert Ford and Josiah Gage, selectmen of Haverhill, Nov. 26, 1682, approved of Sergt. John Jonson to keep a house of public enter- tainment for strangers.


John (his mark) Williams and William Hollis,* certified that about the middle of August, 1682, they were upon the watch in Salem and on the court of guard and that Edward Lewen had his bosom full of pears twice and Nathanill Churly his pocket full, also that Wm. Hollis carried home two or three of the pears to his wife, who said she knew they were Mr. Batter's pears because she used to wash at his house. They were presented for robbing orchards.

Petition, dated Nov. 28, 1682, of John Legg,* James Dennes* Richard Reith,* Richard Knott,* Thomas Pitman,* selectmen of Marblehead the past two years, who being "informed of the necessitous state of Mr Thomas Elbridges family left in the Towne with his eldest daughter Elizabeth, who had their de- pendance upon & subsistence by a liberty granted from the Countrey to sell by retaile Rum &c to the aboused Mr. El- bridge, wee did at yt time give allowance to his sd daughter, and in her behalfe request the Court to give liberty to her till such time as her father should either come or take off the children from her, upon which she had a permitt or sufferance from the Court to doe the same provided she kept good orders; which to the best of our observation she hath accordingly done, and hath still two of the children with her."

Jonathan Wade,* "being an aduenturer and participant with the patentes and undertakers concerning this Colonie of the masachusets, and for the carying on of the great ocasions there- of, was encited unto, and did lay down, in the yeare 1629 in January or february into the common stock 50li and into the Joint stock 10" or more for which they pmised land here upon our ariuall, and allso that there should be a deuision of the stock and fence at the end of seuen yeares. The abouesaid Jonathan Wade hauing found out land seuerall times, that was free from any former grant, and desired confirmation of it to him, he was denied, and the land hath bene giuen to others, and for the division of the stock to the aduenturers he canot understand of any deuision but certainly he neuer yet had any of said diuision, but others cary away the whole, so that he now begeth of this government, being long out of the use of his money that the money may be returned to him with due interest as is alowed unto others, upon borowing of money."
