W HEREAS in and by an Aft made and pass'd in the Eightb Year of the Reign of Queen ANNE. Entituled, An Act to prevent Nu- fances by Hedges, Wears, and other Incumbrances, Obftructing the Paffage of Fifh in Rivers ; All fuch Incumbrances inthe Rivers are difallowed and forbidden without the Approbation of the Courts of General Seffions of the Peace in the rofpsdlive Counties, and Ordered to be Demolished and Pulled down, But no Penalty is provided in the faid Adt :


Wherefore, for the more effectual Preventing fuch Nufances ;


Be it Enacted by the Lieutenant Bobernout, Council Pend and Repretentatibes,in General Court Allembied, and by the maki Authority of the fame, That whofoever after the Publication of this Wear Act, fhall fet up, erect, or make any Wears, Hedges, Fifh Garths, "Stakes, the P to obl Kiddles, or other Incumbrances whatfoever on or a-crofs any River for of Fif Straitning, Obftructing or Stopping the natural, ufual, or common Paffage of the Fifh, in the Spring, or other proper Seafons of the Year, without the Ap- probation of the Court of General Seffions of the Peace, fhall for every fuch Offence forfeit and pay the Sum of Ten Pounds; to be Sued for and Recovered by Plaint, Bill or Information in any of His Majefties Courts of Record within the County, where the Offence is committed; One half thereof to be to him that fhall inform and fue for the fame, and the other half to the Poor of the Town or Towns, where fuch Incumbrances have been made or fet up.
