Purchaser shall give Seller a series of promissory notes of even date herewith as evidence of the amount due for above instalments but not as payment thereof, and the negotiation or discounting of said notes or any of them, shall not be deemed payment nor shall it change or affect the obligations of Purchaser hereunder.
Title to said Motor Vehicle shall not pass to Purchaser until all of said notes, together with all interest, costs and other charges due hereunder are fully paid in cash.
The loss, injury or destruction of said Motor Vehicle shall not release Purchaser from payment of said notes, or any of them, nor shall renewals or extensions of the time of payment on said notes or any of them release Purchaser from this agreement. Any equipment, attachments, accessories or repairs placed upon said Motor Vehicle shall become a component part thereof and shall be included in the term Motor Vehicle as used herein.
Purchaser SHALL NOT USE OR PERMIT SAID MOTOR VEHICLE TO BE USED FOR TAXICAB PURPOSES nor for hire until he gets title hereunder.
Purchaser shall use and house said Motor Vehicle in a careful and prudent manner and in strict conformance with all laws relating to or governing said Motor Vehicle, and agrees not to use or permit said property to be used in violation of any statutes, laws or ordinances prohibiting the use of said property in transporting, carrying or holding intoxicating liquor. Purchaser shall make all necessary repairs to keep said Motor Vehicle in first class condition, and if said Motor Vehicle is not kept in first class condition, Seller may make such repairs as are necessary and add the costs thereof to the amount due Seller hereunder. Purchaser shall keep said Motor Vehicle free and clear of any and all liens, charges, taxes, assessments and encumbrances of any nature whatsoever. Purchaser agrees to insure and keep insured until all of said notes have been paid, the above described Motor Vehicle in a good and solvent insurance company against risk of fire and theft in a sum not less than 80 per cent of the list price F. O. B. factory mentioned above; loss or damage payable to the holders of said promissory notes, Seller, and /or Continental Guaranty Corporation as their interest may appear.
