During the year one of the five notes of $700. each given by the Town has been paid and the proceeds have been in- vested in the Salem Savings Bank.


No income has heen received from the B. & M. Railroad stock, but the market value remains at about the same figure.


At the Annual Town Meeting of 1915 a vote was passed requesting the Trustees of the Burley Eund to petition the Leg- islature for authority to expend six thousand dollars of the

principal of that fund. The Trustees have not complied with that request because they are of the opinion that the Legislature can not rightly grant such authority. They believe that the Bur- ley Fund should be administered according to the terms of their charter, which expressly provides that "no part of the prin- cipal or capital sum thus accumulated shall ever be expended."


In view, however, of the action taken in the year 1906, when a similar request was made by the Trustees in accord- ance with a vote of the Town, and authority was granted to pay a part not exceeding one-half of the principal, the subject is en- titled to further consideration, in order to remove any uncer- tainty as to the matter, and to secure the adoption of a perma- nent policy.


At that time there was a very general impression that the will of the donor, William Burley, had itself been broken in ma- king a permanent fund out of the five hundred dollars which he had bequeathed to be expended annually at the rate of fifty dollars per year.


There is nothing in the records of the Trustees to dispute that claim. But the town records show that fifty dollars were expended annually for the term of ten years in order to carry out that intention. And the idea of making a permanent fund was agreed to by Mr. Burley's executors, who were residuary legatees as well, not for the purpose of defeating, but for the "purpose of extending and perpetuating the pious and benevo- lent intentions of the donor," as expressed in the preamble of the act by which the Trustees were incorporated.


It was even then foreseen that a doubt might arise thereaf- ter over the establishment of a permanent fund, and according- ly the following vote was passed in town meeting May 25, 1825: "Voted: That the Town bind itself by a solemn vote in com- pliance with the proposition of the Executors of the late William Burley, Esq., that the sum of fifty dollars a year for ten years to

come be applied for the purpose of teaching poor children to read and instructing them in the principles of the Christian re- ligion. It being understood, that when this shall have been fully carried into effect, the intention of the beneficent donor will have been completely answered."


The following vote was possed May 8, 1826: "Voted: That the sum of twelve hundred dollars be granted to be raised and assessed on the polls and ratable estates of the town for the purpose of schooling; that fifty dollars of the said sum be ap- plied and apportioned to the several parts of the town at the discretion of the School Committee 'for the sole purpose of teaching poor children to read and instructing them in the Christian religion.' agreeably to a former vote of the town, and the conditions of the contract between the town and the execu- tors of the late William Burley, Esq." And a similar appropria- tion was made annually until the year 1835.


In view then of these facts: that the matter of establishing the Burley Fund was fully discussed at the time: that all parties were agreed on the policy that was adopted: that it was pro- posed by the executors in order to perpetuate the benefit: that the details of administration were accepted by a vote in Town meeting: that it had the approval of the several members of the legal profession then living in the town: that the action taken ten years ago was based on a misapprehension of the situation on the part of the Trustees, and on the part of the Attorney General whose advice was sought and followed by the General Court, we are convinced that the terms of the charter should be adhered to as closely as in the case of trust funds generally: and that a deviation should made only when circumstances are so changed as to make a strict application of these terms imprac- ticable.


The income of the Caldwell Fund is available for the spec- ial benefit of school children of the "North District." The

bequest made by Miss Emeline Caldwell of Beverly was in the following words: "First: I give and bequeath to the Trustees of the Burley Education Fund in the Town of Ipswich the sum of $600., the income of which shall be applied by them and their successors for educational purposes, having special reference to the benefit of poorer children in that part of the Town of Ips- wich which formerly constituted the North District."

or a total amount of $10766.12.


And from the Caldwell Fund there has been expended in 1899, eighty-six dollars; in 1901, thirty-five dollars.


These payments show that the Burley Fund has been far from an idle investment, and if it shall be allowed to accumu- late, as it was originally intended, until the whole annual income can be expended, it will furnish a very considerable contribution to the Town's expenses. Frank T. Goodhue
