ANNUAL TOWN MEETING WARRANT


FEBRUARY 3, 1930

To either of the Constables of the Town of Harwich in said County


GREETINGS :-


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and Town af- fairs to meet in the Exchange Hall, in said Town, on Mon- day, February 3, 1930 at nine o'clock a. m. there and then to act on the following articles :-


Article 1. To choose a Moderator to preside at said meeting.


Article 2. To choose on one ballott the following Town Officers and Committees :- Town Clerk for one year ; Town Treasurer and Tax Collector for one year; one Se- lectman and Overseer of Public Welfare and Board of Health for three years; one Assessor for three years; three Herring Committee for one year; three Contables for one year ; one School Committee for three years; one Trustee of Brooks Library for three years; one Park Commissioner for three years.


Article 3. To choose all other necessary Town Of- ficers and Committees.


Article 4. To hear the report of all Town Officers and Committees.

Article 5. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to borrow money in anticipation of the revenue of the current financial year and act fully thereon.


Article 6. To see if the Town will vote to raise and appropriate such sums of money as may be necessary to defray Town expenses for the ensuing year and act fully theron.

To see if the Town will vote to instruct its Selectmen to control, regulate and prohibit the taking of Eels, Clams, Quahaugs and Scallops within the Town limits, as provided in Chapter 91, Section 85, and acts and amendments there to of the revised Laws of Massachusetts, and to make any regulations in regard to such fisheries as may be deemed expedient and act fully thereon.


Article 8. To see if the Town will vote to main- tain Electric lights for lighting the whole of Ocean Grove for five months, begining June 1, 1930 and raise and appro- priate the sum of ($96.00) ninety-six dollars to defray the expense of same.


Article 9. To see if the Town will appropriate the sum of ($2,000.00) two thousand dollars for dredging and jetty work at Allens Harbor, providing the State will ap- propriate a suitable amount to go with same.


Article 10. To see if the town will vote to raise and appropriate a sufficient sum of money to top coat, or re- construct with bituminous concrete, the Sisson Road, so called, from the Parsonage corner at Harwich Centre to the State Highway at Sisson's Corner.

Article 11. To see if the Town will vote to raise and appropriate a sum of money not to exceed ($1,000.00) one thousand dollars under the provisions of sub section 21 of Section 1 of Chapter 371 of the Acts of 1921 and any and all amendments thereof and additions thereto for the em- ploying of a nurse through the Harwich Visiting Nurse Association, Inc.


Article 12. To see if the Town will vote to appro- priate the sum of ($50.00) fifty dollars for the benefit of the Harwich Port Library Association.


Article 13. To see if the Town will elect a Town Director for the Cape Cod Extension Service.


Article 14. To see if the Town will vote to accept a lung motor as the gift of Harwich Post, No. 292, of the American Legion and provide for its maintainence and location at the Fire Station, or some other suitable place, for the use and convenience of its citizens.


Article 15. To see if the Town will vote to raise and appropriate the sum of ($1,500.00) fifteen hundred dollars to harden with Bituminus Concrete, or other material, the Sidewalk on the north side of Main Street, West Harwich, beginning at the Dennis line, and extending Easterly as far as the money will go and act fully thereon.


Article 16. To see if the Town will vote to accept the road in West Harwich as laid out by the Selectmen, be- ginning at Earl road, and extending easterly to Brooks road, and to raise and appropriate the sum of ($300.00) three hundred dollars for making the road passable and safe.


Article 17. To see if the Town will vote to accept the road in West Harwich as laid out by the Selectmen, be- ginning at the Lower County road and extending Southerly

to Nantucket Sound. This is an extention of Pleasant street, so called, and to raise and appropriate the sum of ($350.00) three hundred and fifty dollars for grading and hardening of this road.


Article 18. To see if the Town will vote to make a Town ordinance for Main street, Harwich Port, under Chap. 357, Sec. 5 of the Acts of 1928 for one through way traffic from beginning and including Miles street at Beals Corner and extending to and including Snow Inn road, and act fully thereon.


Section 5. Stop Before Entering Through Street.


The following streets and parts of streets are hereby de- clared to constitute through streets for the purpose of this section:


Define streets and extent.


Beginning and including Miles street at Beals corner and extending to and including Snow Inn road, Harwich Port.


Every operator of a vehicle, street car or other conveyance traveling upon any street intersecting any through street above designated, shall bring such vehicle, street car or other conveyance to a full stop at the place where such street meets the prolongation of the nearest property line of such through street, subject, how- ever, to the direction of any traffic control sign, or signal, or any police officer at such intersection.


The operator of any vehicle who has come to a full stop as required above, upon entering the through street, as well as oper- ators of vehicles on such through streets, shall be subject to the usual right of way rule prescribed by law and applicable to vehicles at intersections.


The Chairman of the Board of Selectmen is hereby author- ized and required to place and maintain or cause to be placed and maintained on each and every street intersecting a through street designated above, and at or near the property line of the through street, appropriate signs upon the street (and in addition thereto may place and maintain any appropriate devices or marks in the roadway), such signs, devices or marks to bear the word "STOP" and to be located in such position and to be provided with letters of a size to be clearly legible from a distance of at least 100 feet along the street intersecting the through street. All such signs shall be illuminated at night or so placed as to be illuminated by street lights or by the headlights of approaching motor vehicles.

Article 19. To see if the Town will vote to raise and appropriate the sum of ($2,543.55) two thousand, five hun- dred forty-three dollars and fifty-five cents to reimburse the State Dept. of Public Works one half, of the amount expended for the protection of the West Harwich beach and act fully thereon.


Article 20. To see if the Town will vote to raise and appropriate the sum of ($10,000.00) ten thousand dollars to build a bridge over Herring River at Lower County road and finish the road. This work to come under Chap. 90 of the general laws where by the Town pays one quarter, the County one quarter and the State one half, total amount ($40,000.00) forty thousand dollars.


Article 21. To see if the town will vote to discontin- ue the collection of Garbage and Refuse in the condensed section of Harwich Port and act fully thereon.


Article 22. To see if the Town will vote to raise and appropriate the sum of ($15,000.00) fifteen thousand for the collection of Garbage and Refuse in the Town of Harwich from May 30, 1930 to May 30, 1931 and act fully thereon.


Article 23. To see if the Town will vote to authorize its Board of Selectmen to sponsor the Act filed in the Legis- lature seeking to amend the existing act relating to appro- priations by the Town for Public Amusements so that the Town can raise a sum not exceeding ($2,500.00) two thous- and five hundred dollars for said purpose instead of ($1,000.00) one thousand as now provided.


Article 24. To see if the Town will vote to raise and appropriate a sum not exceeding ($2,500.00) two thousand five hundred to be used by the Recreation Committee of the Town for promotion of Base Ball providing the Legislature amends the Acts of 1929, Sec. 1 of Chap. 272 enabling such action.

Article 25. To see if the Town will pass a by-law to provide for an appropriation, advisory or finance commit- tee, as required by Chapter 388 of the Acts of 1923, or to take any action relative thereto.


Voted : that the Town adopt the following by-law :


Section 1. There shall be an appropriation committee for the Town to which shall be referred all articles in any warrant hereafter issued for a town meeting. The selectmen, after draw- ing a warrant for a town meeting, shall immediately forward a copy thereof to each member of said committee, which shall con- sider all articles in the warrant and make such report, in print or otherwise, to the town meetings as it deems for the best interest of the Town. The said committee shall consist of nine persons to be appointed as provided in the following section.


Section 2. The moderator of the town meeting when this by-law is adopted shall, within thirty days after such by-law be- comes effective, appoint from the citizens of the town three per- sons whose term of office shall expire at the adjournment of the first annual meeting following the time when this by-law becomes effective; three whose term of office shall expire at the adjourn- ment of the second annual meeting following the time when this by-law becomes effective; and three whose term of office shall ex- pire at the adjournment of the third annual meeting following the time when this by-law becomes effective. Annually thereafter the moderator presiding at the close of an annual town meeting shall, within thirty days, appoint three members whose term of office shall expire at the close of the third annual meeting after their appointment. Said committee shall choose its own officers and shall, serve without pay.
