Article 85. To see if the Town will vote to amend its By-Laws by accepting and adopting the following amendment after Section 1 of Art- icle 8, a new section known as section 2: On all contracts for construction, reconstruction, alteration, repair or development at public expense of any building, road, bridge or physical property where the amount in- volved is two hundred dollars ($200.00) or more, the Board, the Depart- ment, the Committee or official in charge of the expenditure of such amount shall be required to submit the awarding of same to competitive public bidding and no expenditure shall be permitted of two hundred dollars ($200.00) or excess thereof unless the same shall have been award- ed upon public bid and all bids opened publicly.

Article 93 .- To see if the Town will accept the layout of Ayer Lane leading from a northerly end of a formerly laid out Town Way in a southerly direction to Flake Yard Road, as reported and recommended by the Selectmen under date of January 25, 1952, and to authorize and instruct the Selectmen to take by purchase or eminent domain the lands, or interest in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this purpose.

Article 94. To see if the Town will accept the layout of Harbor Road leading from Route 28 in a southerly direction to land of Harriet Baker Hyde and J. W. Scarborough, as reported and recommended by the Selectmen under date of January 25, 1952, and to authorize and in- struct the Selectmen to take by purchase or eminent domain the lands, or interest in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this purpose.

Article 95. To see if the Town will accept the layout of Woodland Road leading from Bank Street in an easterly direction to Bay View Road, as reported and recommended by the Selectmen under date of January 25, 1952, and to authorize and instruct the Selectmen to take by purchase or eminent domain the lands, or interest in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this purpose.

Article 96. To see if the Town will accept the layout of Bay View Road leading from Route 28 in a southerly direction to land of one Davison, Van Buren and Cleveland, as reported and recommended by the Selectmen under date of January 25, 1952, and to authorize and instruct the Selectmen to take by purchase or eminent domain the lands, or interest in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this puropse.

Article 97. To see if the Town will accept the layout of Sea Breeze Avenue leading from Wyndemer Bluffs Road in an easterly and north- erly direction to Park Street, as reported and recommended by the Selectmen under date of January 25, 1952, and to authorize and instruct the Selectmen to take by purchase or eminent domain the lands or interest in the lands, within said layout, and to raise and appropriate a sufficient sum of money for this purpose.

Special Town Meeting


AUGUST 1, 1952


THE COMMONWEALTH OF MASSACHUSETTS

To either of the Constables of the Town of Harwich, in said County, Greetings :---


In the name of the Commonwealth of Massachusetts, you are here- by directed to notify and warn the inhabitants of said Town qualified to vote in elections and town affairs, to meet in Exchange Hall in said town on Friday, August 1, 1952 at 8:00 P. M. then and there to act on the following articles :-


Article 1. To see if the Town will vote to authorize the Selectmen on behalf of the Town if Harwich to lease from Chase Street Village Inc. for a public parking area paying rent at the rate of not more than 1 dollar per annum, a parcel of land in the rear of the Eldredge Block (so called) on Main Street in Harwich Port and to transfer from avail- able funds the sum of 1 dollar for the payment of rent for the first year, and to act fully thereon.


Article 2. To see if the Town will vote to transfer from available funds a sufficient sum of money to improve and maintain the public parking area described in the motion voted on in the preceding article, and to act fully thereon.


Article 3. To see if the Town will vote to authorize the Selectmen on behalf of the Town of Harwich to lease from Cape Interstate Inc. for a public parking area paying rent at the rate of not more than 1 dollar per annum, a parcel of land in the rear of the Modern Theater, Main Street, Harwich Port and to transfer from available funds the sum of 1 dollar for the payment of rent for the first year, and to act fully thereon.


Article 4. To see if the Town will vote to transfer from available funds a sufficient sum of money to improve and maintain the public parking area described in the motion voted on in the preceding article, and to act fully thereon.


Article 5. To see if the Town will vote to instruct the Park Com- missioners, the Board of Selectmen and all other town officials to desist from issuing licenses for any and all concessions (so called) on Town owned beaches and adjacent parking areas and to revoke any such licenses now in force, and to act fully thereon.


Article 6. To see if the Town will vote to instruct the Selectmen to release any interest the town might have in the land now owned by

Helen E. McIvor on Uncle Venies Road in South Harwich and to execute the necessary instruments in order to clear the title to said land and to act fully thereon.


Article 7. To see if the Town will vote to transfer from available funds a sum of money for Veterans Benefits and to act fully thereon.


On Friday evening, August 1, 1952, a few people gathered in Exchange Hall at 8:00 P. M. but as the number of voters assembled was much be- low the required quorum of 107, no legal meeting could be held and at 9:30 P. M. the Moderator by virtue of an acclamatory vote of the few present, proclaimed the special town meeting would again assemble at 8:00 P. M. Friday, August 8, 1952, to act upon the same warrant.


On Friday at 8:00 P. M. about 17 legal voters assembled in Exchange Hall to hold a postponed special town meeting. As no quorum was present at 8:15 P. M. the Moderator, under a motion properly moved and seconded ordered the meeting postponed until Thursday evening, August 14th. at 8:00 P. M.


On Thursday evening August 14, 1952, 50 voters assembled in Ex- change Hall for the postponed town meeting. No quorum being present the meeting was dissolved without date.

Special Town Meeting


November 20, 1952


Article 1. To see if the Town will vote to transfer from Surplus Funds the sum of two thousand dollars ($2,000) to Veterans' Benefits and to act fully thereon.


By unanimous vote it was voted to transfer the sum of $2,000. from Surplus Funds for this article.


Article 2. To see if the Town will vote to transfer from Surplus Funds the sum of six thousand dollars (6,000.) in order that the Water Commissioners for the Town of Harwich may make a survey for addi- tional wells and necessary tests and act fully thereon.


By unanimous vote it was voted to transfer the sum of $6,000. from Surplus Funds for this article.
