For purposes of general information, it may be proper to state in this connection some of the laws, rules and regulations con- cerning the registration of births, marriages and deaths in Mas- sachusetts.


(General Statutes-Chap. 21.)


DUTIES OF TOWN CLERK.


SECTION 1. The clerk of each city or town shall receive or obtain, and record and index the following facts concerning the births, marriages and deaths therein, separately numbering and recording the same in the order in which he receives them, des- ignating in separate columns :


In the record of births, the date of the birth, the place of birth, the name of the child, (if it have any,) the scx and color of the child, the names and places of birth of the parents, the occupation of the father, and the residence of the parents, and the date of the record ;


In the record of marriages, the date of the marriage, the place of marriage, the name, residence, the official station of the per- son by whom married, the names and the places of birth of the parties, the residence of each, the age and color of each, the condition of each, (whether single or widowed,) the occupation, the names of the parents, and the date of record ;


In the record of deaths, the date of the death, the name of the deceased, the sex, the color, the condition, (whether single, widowed or married,) the age, the residence, the occupation, the

place of death, the place of birth, the names and places of birth of the parents, the disease or cause of death, the place of burial, and the date of the record.


DUTY OF PARENTS.


SECTION 2. Parents shall give notice to the clerk of their city or town of the births and deaths of their children ; every householder shall give like notice of every birth and death hap- pening in his house ; the eldest person next of kin shall give such notice of the death of his kindred. Whoever neglects to give such notice for the space of six months after a birth or death, shall forfeit a sum not exceeding five dollars.


DUTY OF PHYSICIANS.


SECTION 3. Any physician having attended a person during his last illness, shall, when requested within fifteen days after the decease of such person, forthwith furnish for registration a certificate of duration of the last sickness, the disease of which the person died. and the date of hls disease. as nearly as he can state the same. If any physician refuses or neglects to make sueh certificate, he shall forfeit and pay the sum of ten dollars to the use of the town in which he resides.


DUTY OF SEXTON OR UNDERTAKER.


SECTION 4. Every sexton, undertaker, or other person hav- ing charge of a burial ground. or the superintendent of burials having charge of the obsequies or funeral rites preliminary to the interment of a human body, shall forthwith obtain and re- turn to the clerk of the city or town in which the deceased resi- ded or the death occurred, the facts required by this chapter to be recorded by said officer concerning the deceased, and the per- son making such return shall receive from his city or town the fee of ten cents therefor.


The clerk, upon recording such facts. sball forthwith give to the person making such return, a certificate that such return has

been made, which certificate such person shall deliver to the per- sou having charge of the interment, if other than himself, be- fore the burial. Any undertaker violating any of the provisions of this act, shall be punished by a fine of twenty dollars for each violation of the duties herein prescribed, to be imposed by any court of competent jurisdiction.


Nothing herein contained shall exempt any sexton or other person named in the fourth section of the twenty-first chapter of the General Statutes from the provisions and penalties pre- scribed in said section in cases where an undertaker appointed as provided in this act is not employed in charge of the obse- quies.


Parents and other relatives of children born, or of persous deceased, and the occupiers of tenements in which any births or deaths may take place, should report, as soon after the event as may be, every case of birth which may occur, and such cases' of death, if any, as may not have been duly returned by persons having charge of the burial &c.


By compliance with the foregoing requirements of law, they will render important aid to the town clerk, in securing the facts connected with births and deaths. The importance of per- fect accuracy in the collection of facts and preparation of re- turns cannot be overestimated.


OF PARTIES LIVING IN THE STATE AND MARRY- ING OUT OF IT.


When the marriage of persons one or both of whom reside in this State, is solemnized in another State, the parties must with- in seven days after their return, file with the clerk of the town in which either of them resided, a certificate or declaration of the marriage, with all the particulars required by law. Penalty for neglect, $10


Blanks for return of births and deaths may be had at the Town Clerk's office.


All returns should be made on or before the first day of Jan- uary in each year.
