SELECTMEN'S REPORT.


In explanation of the statement of some of the expenditures given on the preceding pages, we would say that in the case of Mary Brown a suit was brought by the State Treasurer to recover for her support. The question of her settlement was the one in dispute, and it was a difficult question to determine. She became an inmate of the Reading Almshouse. It was thought best by the Board of Selectmen in office during the pendency of the case, in the uncertainty as to the result, not to urge a trial, but to keep the matter in abeyance, and make no claim against the Commonwealth for her subsequent support if the Commonwealth did not press its claim for her former sup- port. It remained in court several years under the charge of Mr. Bancroft, and a trial was avoided, though some prepara- tions were necessarily made for one, until it was finally dis- missed from the docket. It was afterwards restored to the docket, but has now been practically abandoned by the plain- tiff, and it is thought that no further legal measures can be taken by either party.


In the suit against the City of Malden (Penney Case), at the trial in the Superior Court, it was ruled that the action was barred by the Statute of Limitations even before the action of the town in the matter at the annual meeting held in April, 1883. This being a mooted question, however, and it being thought desirable that there should be a determination of the liabilities of towns in such cases, as well as a recovery of the amount due in this case, if possible, exceptions were taken to the ruling of the presiding Justice of the Superior Court and

The claim of Frank E. Roberts vs. Town of Reading was carried to the Superior Court and decided in favor of the Town. Judgment for $68.16 for costs against the plaintiff stands on record in Court.


The $30.00 paid in Pierce case was for Counsel which was not forwarded in season to be paid last year.
