We whose names are underwritten being partners in the division of land at the easterly end of the town, called the second division have agreed and divided said land ourselves acording to a grant of our town bearing date march 5th 1705 and the bounds of each persons share are as followeth. Viz to Benjamin Edwards and Morde- ca Larcom the one half of said division beginning at a stake and heap of stones which is the northerly corner of said division and is allso the easterly bounds of the first division and from then Southerly across the rocks to a red oak stub marked with stones about it standing by the fence of Samuel Cornings Meadow; and from thence to the Eastward by said cornings meadow fence to a wil- low bush, thence turning westward to a stake and heap of stones, from thence northerly to a stake an heap of stones about it a little to the South ward of the pond that is to the westward of john coys house, and from Said stake Eastwardly to a great Stump by said Coys hog pen by the highway and from thence northwardly by the high- way side to the stake first mentioned. And the other half of said division belongeth to Rice Knowltin, is bounded from a stump standing by John Coys hog pen at the highway side and so by the highway Southerly to a stump with a stake in it at the southerly end of Turnip Bridge which is the corner bounds of said division, and thence on a line to the head of raccoon Meadow and so taking the Edge of the meadow north westwardly untill it com- eth to the Willow bush which is said Larcom and said- Edwards bound and so it is bounded upon the northwest and thence Northeasterly upon the bounds of said ed- wards and larcom as they are above expressed. and in confirmation of all that is above written we the above

We the above named Benjamin Ed- wards and Mordeca Larcom have divided our half of the above mentioned division as it butted and bounded as above said to each of us, our share parted and bounded as followeth. to Benjamin Edwards, his part of the Easterly, and of their above said lots joining to the high- way leading to John Coys and goeth on the line between the first and second division untill it cometh to a great Hemlock tree marked on the east side with B E, and on the west side L M and from thence turning Southerly upon a Straight line to a black ash tree marked on four sides and so on a Straight line untill it meeteth with Rice Knowltons bounds line and the remainder of the above said Edwards and Larcoms part of the said division west- ward of Benjamin Edwards line above mentioned and home to Samuel Cornings meadow according to the bounds above express said Mordeca Larcoms part of the said divi- sion. And whereas the town voted that every one should have an equal share, yet the said Benjamin Edwards hath the greatest share, in consideration that the Said Edwards doeth allow the said Larcom a highway over his part. of said division for carting or drawing either foward or back- ward through fence of said Larcom as he shall have occa- sion to improve his lot and for five pounds in money in hand paid to the said mordeca larcom all which is in full satisfaction and in confirmation of all the above written we have hereunto set our hands the day and year above said.

joining to his own and near Lords Hill in satisfaction for his damage done by laying out a highway over his land to go from Wenham to Beverly where it is now used, and allso for his acre of swamp drew to him by town vote, beginning at Lieut John Porter northeast corner of his 40 acres and so on a Straight line towards the South- west to a stake at the corner of his fence and then turn- ing upon the fence four poles to a red or black oak tree marked from thence westerly to John Batchelders corner bounds and so bounding southwesterly on said Batchelder and Theophilus Rix 19 poles wide to a stump marked and set about with stones, thence running east twenty seven poles to a stake near his own corner bounds and so including all the common between the bounds above men- tioned and his own land containing about five acres be it more or less


Allso then laid out to William Fairfield about one acre and one half of common land adjioining to that which the Selectmen laid him out march 20th 1704, being six poles and 1-4 in breadth. next the Herrick land, and five poles and 3-4 upon a square line at Lieut Porters line which is in Satisfaction to said Fairfield for four pounds five shillings and eight pence paid by said Fairfield to Joseph Batchelder in full satisfaction to said Batchelder for the highway laid over his land by the selectmen Oct 31st 1704 as by the town records may appear. Allso then laid out to Charles Gott Junr. an acre and 23 poles of land adjoining to that which Theophelus Rix had of the town for the highway on the north west side of it and bounded on John Batchelder northward ten poles and one quarter and by the other common land westwardly seven- teen poles and Southwardly upon Josiah Hacker, untill it cometh to Goodman Rix's land eleven poles, which land is in satisfaction for goodman Perkins his highway laid out over said Gotts land by the Selectmen April 30th 1706 at a meeting of the selectmen April 30th 1706 then laid . outt a highway over land of John Gott Junr to accom- modate John Perkins to come to the country road begin- ing at the country road near said Gott Barn and so along the westerly side of said Gotts Orchard about 14 foot

in breadth, being in the same place as it is now bounded where said Gott and Perkins use the way, they claim as purchased of Mr. John Newman, which goeth from the country road to said Gotts own land, and then one pole in breadth on the easterly side of his land untill it cometh to the land of Capt. Fisk Senr. and then turning upon said Gotts land one pole wide over to goodman Perkins his own land, which way so staked and paid for is only for the particular use of said Perkins and his successors useing of that living and passing through gates or bars where there is occasion for fencing the fee simple of the land remains in said Gott as it did before. We whose names are underwritten being propritors in the division in our commons settlements both at the east end of our town and allso in that in our great swamp. Viz Joh Barr in the first division in the great swamp and Josiah Hacker in the first division of land so called in the neck. We the above mentioned have mutually agreed for our selves and for our heirs and do hereby make and exchange of our above said rights each with the other that is to say, all the right title or interest does belong to the said John Barr in the first division in said swamp shall belong to said hacker, and all the right title or in- terest which does belong to Josiah Hacker in the first division at the east on the neck shall of right belong to said John Barr here by we do empower each other as above said to act agree or divide with those who are pro- pritors in said division wherein we have now interested each other as we ourselves might have done and in con- firmation of all above written we have hereunto set our hands this 31st day of October 1706 Attest William Fairfield

Pursuant to a grant' of our town, bearing date March 5 1705-6 We whose names are underwritten being partners and propritors in common in that division at the east end of our town have mutually agreed and divided said division according to the above said grant as followeth - viz - First to Benjamin Edwards two eights in the right of John Dennis adjoining to the second division, being the easterly side of said first division laying the whole length of said Edwards his land of said second division and 14 pole upon the highway to a stake and heap of stones, and at the Southwesterly end - next the meadow 10 poles and twelve feet in breadth to a stake and heap of stones and so on a straight line to the Stake at the high- way before mentioned. The second part to Thomas Ed- wards one Eighth bounded upon the above said straight line, from which is said Benjamins bounds and 6 poles wide at the highway to a small red Oak tree, marked and at the other end at the meadow 6 poles wide to a stake with stones about it and so on a straight line to the red Oak - The third to Ebenezar Batchelder one eigth bounded upon Thomas Edwards, his above said line and at the highway 6 poles wide to a little birch marked and at the meadow 6 poles wide to a stake and heap of stones, and so on a line to the birch at the highway. The fourth to John Barr one eighth bounded at the highway six poles and eight feet and so on a straight line to a stake at the meadow 6 poles from Ebenezar Batchelders bounds. The fifth to Samuel Kemball Jun- one eighth bounded by the highway seven poles is a stake and heap of stones and so on a line to a stake and heap of stones at the meadow six poles from John Barrs bounds -


The sixth to John Batchelder one eighth, bounded upon the highway seven pole and fourteen feet to a stake and heap of stones and so on a line to the meadow to a stake and heap of stones 6 poles from Samuel Kimball's bounds. The seventh to Isaac Hull one eighth bounded upon the highway ten poles and seven feet wide to a Maple marked, and then turning Southwesterly to the meadow to the corner bounds of said division. As divided to six of the above named, as followeth First to John Batchelder at

the highway seven poles and 12 feet wide to a stake and heap of stones, and so on a straight line to the tree, which is the corner bounds of said division at the meadow.


The second to Ebenezar Batchelder, seven poles and 12 foot wide at the highway, and so turning on a line to the above tree, being an angle.


The third to John Barr bounded at the highway seven poles and twelve foot to a stake and heap of stones and so to the abovesaid corner tree on a line -


The 4th to Samuel Kimball at the highway seven poles and 12 foot wide, and so to the above said tree, as the other.


The fifth to Thomas Edwards seven poles and 12 foot at the highway to a stake and heap of stones, and so on a line to the corner tree as the other


The sixth to Isaac Hull at the highway to the corner bounds of said division and so to the other corner tree at the meadow including the rest of said division - And we subscribers have mutually agreed each with the other for our selves and our heirs forever- That it shall be lawful for every one of ourselves or our heirs from time to time forever here after to pass over each others lot or share in said division for the useing and improving of our several shares and to have no other claim or restraint in each others lot or share as it is above divided and bounded. At a meeting of the free holders and commoners of Wen- ham Nov 19th 1706 being duly warned and notifieid that. Joseph Fowler and Zacheus Goldsmith have com- menced an action against them at the next inferior court of common pleas to be holden at Salem on the last tues- day of this Instant November and it was then agreed and voted that our said commoners would defend any cause

and to that end made choice of Capt. Thomas Fisk, Lieut John Porter and William Fairfield or any two of them to appear in the said court of common pleas with full power and in the name to answer, defend and act from court to court in their said cause untill the same be ended. Know all men by these presents that whereas the com- mittee in the february the third 1703 did lay out to John Sewart, Theophelus Rix, Jonathan Moulton and John Moulton about 4 acres of swamp according to a grant of the town in that swamp lying between Capt Fisk Farm and Josiah Porters Meadow which swamp layeth in com- mon and undivided amongst them. I the above named John Moulton do hereby acknowledge that for and in con- sideration of fifteen shillings to me in hand paid by Theophelus Fisk of Wenham the receipt whereof I do acknowledge to have had and received, have sold and set over unto the said Theophelus Fisk and his heirs forever all my rigt and title and interest laying in partnership as aforesaid according to the bounds thereof as they are entered in our town book to him the said Theophelus, to have and to hold, to use, occupy and improve, either divided or undivided as I myself might lawfully do, with- out any lawful let suit or denial made by me or my heirs or any person from, by, or under me, and in confirmatin of what is above written I have hereunto set my hand this eleventh day of December in the year of our lord 1706

Thomas Edwards in the fourth division in the swamp in the right of Wil- liam Knowlton and Tobias Trow, in the fifth division at the east end of the town, We the above said persons do hereby make and declare an exchange of our rights each with the other and do hereby for ourselves and our heirs agree each with the other, interchangeably so assign our said rights and interests and that it shall be lawfull for the said Edwards to use and improve and defend with the propritors of said division and that the said Trow

At a meeting of the selectmen April 30th 1706, Then william rogers Chosen and appointed to keep school in Wenham for the year ensueing. We whose names are underwritten being met together to renew the bounds of our towns to which we belong viz. Wenham and Beverly and have mutually agreed and renewed the several bounds and run the lines thereof. as they stand entered in Wen- ham town books which are standing bounds between our said towns. witness wereof we have hereunto set our hands this 7th of May 1706

At a legal Town Meeting of the inhabitants of Wenham Aug. the 16th 1706 the question being put to the town whether the selectmen should allow their Representative for sabbath days as allso for such time as he was at home about other business and did not attend at general court, and it was voted in the negative.

At a meeting of the selectmen Nov 24th 1706 -- A coun- try tax being made was committed to Constable william rogers for the paying of the Province treasurer accord- ing to his warrant amounting to sixty six pounds four- teen shillings as allso a town rate then made was then committed to him amounting to sixteen pounds sixteen shillings and three pence which together with two pounds three shillings overplus in said country tax for the which he had warrants to collect the whole in both and pay to the town treasurer for defraying the town charges, the whole in both amounting 19:00:01


Feb. 19 1706-7 At a meeting of the Selectmen - William Rogers is allowed - out of the towns money in his hands for collecting all the rates this year - 1: 5:00.

A country rate made Augt 2nd and committed to Con- stable Thomas White to pay the province treasurer ac- cording to his Warrant amounting to sixty one pounds, six shillings, as allso a town rate for defraying the town charges with a warrant to coll at the same and pay into the treasurer which town rate amounts to 15:00:00

Town Clerk At a meeting of the Selectmen nov 19th 1706 then agreed with Robert Symonds Senr to keep our part of the meeting house and ring the bell tell the twenty third day of next July about which time his year is up with us and to thirty shillings paid him for his sevices by the town.


At a meeting of the selectmen February 19th 1706-7 Samuel Kilham and Thomas Tarbox for their work about the Territ of our Meeting house, and there remains of the three pounds - fifteen shillings still due to them one pound twelve shillings of which one pound and five shill- ings belongs to the Ipswich men to pay back to our town-


At a meeting of the Selectmen March 4 - 1706. then accounted with Capt. Thomas Fisk as treasurer for the year 1706 and allowed him ten Shillings to pay Abraham Tillson for hanging the bell and there is due to the sum of six shillings. Then allso accounted with william rog- ers, Constable for What the selectmen have received of him as by orders may appear and we have received for the towns use 17:02:11.


March 4th 1707 at a General town Meeting of the inhabi- tants of Wenham, Voted and agreed that our present ministers Salary agreed upon by our town formerly for time to come shall be paid in money except the butter on condition that he does give the town a general acquit- ance from his beginning with us unto the present day : as a town they are allso now to pay it without his trouble or damage for time to come. know all men by these presents that I do hereby for myself, my heirs executors administrators and assignees forever firmly and absolutely aquit discharge and exonerate the town of Wenham from all former debts dues or demands as they are a town, upon acpt of my yearly salary due to me by formrer contracts or any part thereof, from my beginning with them unto this present day, reserving my right of so much time as

As allso then made and committed to Constable Thomas White a list in his ward for performing abovesaid duty - amounting to thirty one pound and one Shilling and 7 pence and twelve cords and three feet of wood with warrant to collect and pay in the same.
