BUILDING FUND.
In the winter of 1809-70, the following paper was signed by ten members of the society :
" We, the undersigned, members of the Historical and Philosophical Society of Ohio, hereby agree annually, for ten years, to contribute toward a building fund for such society the sums set opposite our respective names, and to pay over the same, within the month of December each year, to the trustees appointed to receive and manage the said fund, by them to be invested, with all interest accruing therefrom, until the thirty-first day of December, 1879, unless it shall sooner be otherwise determined by the vote of subscribers hereunto, representing three-quarters of the whole amount subscribed. CONSTITUTION AND BY-LAWS
OF THE
Historical and Philosophical Society of Ohio.
CONSTITUTION.
ARTICLE I.
The object of this Society shall be the collection and preservation of everything relating to the history and an- tiquities of America, more especially of the State of Ohio, and the diffusion of knowledge concerning them.
ARTICLE II.
The Society shall consist of corporate, corresponding, and honorary members. Corporate members must be resi- dents of the State of Ohio, and shall be entitled to vote and serve as officers. Honorary members, of whom not more than five shall be elected in any one year, may be per- sons in any part of the world, eminent for literary or sci- entific attainments, and shall be entitled to participate in the meetings, but not to vote or hold office.
ARTICLE III.
The officers of the Society shall be a President, two Vice- Presidents, a Corresponding Secretary, a Recording Secretary, a Treasurer, a Librarian, and five Curators-all of whom shall be chosen annually by ballot, and shall hold office for one year or until their successors shall have been chosen. They shall severally perform the duties appertaining to their

respective offices, and together constitute an Executive Board. The Executive Board shall meet at least once in each month for the transaction of business-six members constituting a quorum-and shall have power to enact by- laws, appropriate funds and receive donations, and shall be charged with the financial management and general con- duct of the affairs of the Society, subject, however, to any instructions the Society may give, and shall report at the annual meeting.
The Recording Secretary shall be ex-officio Secretary of the Board.
ARTICLE IV.
Candidates for membership, either corporate or honorary, shall be proposed at any meeting of the Executive Board, and, if recommended by the Board, may be elected at the next meeting of the Society-three negatives excluding.
ARTICLE V.
Each corporate member elected shall subscribe to the Constitution and pay the sum of ten dollars, and thereafter the annual fee of ten dollars each year, commencing with the first Monday of December following. Any member may become a member for life on the payment of one hundred dollars. All moneys received for life membership to be funded, and only the interest thereof to be used for the purposes of the Society.
ARTICLE VI.
There shall be an annual meeting of the Society on the first Monday in December, for the election of officers for the ensuing year, the reception of reports from the Executive Board, the Secretaries, the Treasurer, and the Librarian, and for the transaction of other business. There shall, be-

sides, be such other regular meetings of the Society as the Exceutive Board may each year determine. Special meetings may be called by the President or by the Executive Board. Six members shall constitute a quorum.
ARTICLE VII.
The Library, Cabinet, and other collections shall be kept in Cincinnati, and the Executive Board shall prescribe rules regulating their use.
ARTICLE VIII.
A member may be expelled by a vote of three-fourths of the members present at a meeting of the Society; but charges in writing shall first have been submitted to the Society at least one month, and a copy of such charges furnished to the accused at least three weeks previous to the meeting at which the vote shall be taken.
ARTICLE IX.
There shall be no alteration in this Constitution, unless the proposed amendments shall have been submitted in writing to the Executive Board at least one month before a meeting of the Society, due notice given in one or more of the daily papers of Cincinnati, and such amendments be adopted by a vote of three-fourths of the members present at a meeting of the Society held pursuant to such notice.

1. The President shall preside at all meetings of the So- ciety and of the Executive Board, and shall present the annual report of the Board, as required by Article VI. of the Con- stitution. He may call meetings of the Society and of the Board at any time.
2. In the absence of the President, the Vice-Presidents, in the order of seniority, shall perform his duties. The order of seniority of the two Vice-Presidents shall be determined by lot, drawn by one of the Executive Board selected for that purpose at their first meeting after election.
3. The Corresponding Secretary shall conduct the corre- spondence of the Society, and shall have present at cach meet- ing of the Executive Board, copies of all letters he has written, and the originals of all letters he has received, since the last meeting, and the same shall be open to the inspection of the Board, and shall be preserved by the Corresponding Secretary, who shall be responsible for their safe-keeping. He shall report annually to the Society, as required by Article VI. of the Constitution.
4. The Recording Secretary shall keep the records of the Society and of the Board, and the same shall at all times be open to the inspection of any member of the Society. The Recording Secretary shall notify all new members of their election, and shall give notice of all meetings of the Society and of the Board, and shall call a meeting of the Society or of the Board upon the request, in writing, of any six members

thereof. He shall be responsible for the safe-keeping of all records and papers committed to his charge. He shall report annually to the Society, as required by Article VI. of the Constitution.
5. The Treasurer shall keep the money and accounts of the Society, and shall pay all bills audited by the Executive Board. His accounts shall be open to the examination of any member of the Board, and his account-books shall be pro- duced. for that purpose at all meetings of the Board. He shall report annually to the Society, as required by Article VI. of the Constitution.
6. The Librarian shall have the charge and control of the Library and Cabinets of the Society, subject to the rules for their use that may from time to time be adopted by the Executive Board. He shall make a correct and complete catalogue of all books in the Library, or that may be added to it, and shall number and label each book. He shall report annually to the Society, as required by Article VI. of the Constitution.
7. The Curators shall have the charge of the rooms of the Society. They shall provide for the officers whatever they may respectively need in their offices, and shall have the general control and direction of the expenditures of the Society, subject to whatever instructions the Executive Board may from time to time give to them, and subject also to the restriction that they shall expend no money for books, pamphlets, or anything that would belong to the Library or the Cabinets.
8. The Executive Board shall meet regularly on the second Tuesday of every month. The order of business at all meet- ings of the Board shall be-

The Board shall pass at any regular meeting, by ballot, upon new members proposed. 10. At the regular monthly meeting of the Society, and at other times in the convenience of the Librarian, books shall be delivered by the Librarian, to be taken from the rooms for

11. There shall be seven standing committees as follows : BIOGRAPHY. GENEALOGY AND LOCAL HISTORY.
INDIANS. SLAVERY. TRAVELS. WARS. STATE OF OHIO.
To be appointed annually by the President at the first meeting of the Executive Board. Each committee shall consist of one member, who may associate with himself as many others as may desire to join him. Each committee shall prepare a list of all published works upon its subject, and shall report in writing, to the Librarian, at least one month previous to each annual meeting of the Society.

Resolved, That whenever a member shall fail to pay bis dues within the fiscal year for which the same are payable, the Treasurer shall notify him that unless he shall pay such dues within one month thereafter, he shall cease to be a member of the Society.

GENTLEMEN :
I have the honor to submit to you the following report as Librarian for the year ending December 6, 1875 :
The number of volumes in the Library is now 5,414, and of catalogued pamphlets 17,394, against 4,967 volumes and 15,856 pamphlets at the date of the last annual meet- ing. The increase of the Library has been 447 volumes and 1,538 pamphlets, against 344 volumes and 3,356 pam- phlets in the preceding year. The contributions numbered 607 volumes and 3,829 pamphlets, or, compared with those of the preceding year, show 278 fewer volumes and 1,152 fewer pamphlets. The number of contributors was 137. A few volumes have been purchased, as the funds of the Society have increased enough to justify the appropriation which was made of $50 for books on Ohio, and of $50 for books on the Rebellion. I have expended of these appro- priations $83.65-nearly all, however, on books relating to this State.

The Society has not yet succeeded in securing a site for a building, although many efforts were made to that end during the year. An application is now pending with the University Trustees for license to the Society to build a Library Hall on the MeMicken upper lot.
The general course of the year has been a quiet and steady growth of the Library. A list of the contributors to this growth is appended to this report.

The use of the Library remains small, although a little larger than in any previous year of my administration. One volume was withdrawn during the year for use in . Indianapolis, Ind.
The gifts, during the year, included Judge Hall's own copy of MeKenney and Hall's History of the Indian Tribes of North America, 3 vols., Philadelphia, 1837-44, given by

his wilow, Mes. James Hall; Native Races of the Pacific States, II. H. Bancroft, 5 vols., New York. 1874-76; The Olden Time, Neville B. Hallowell, 1832; History of Discovery and Settle- ment of the Valley of the Mississippi, 2 vols., John W. Monette, New York, 1846-48; Catalogue of the Library of the Boston Athenaeum ; and many other valuable works.
A list of the contributors to the Library and to the Cab- inet is appended to this report. In value the accessions to the Library during the year are probably greater than in in any previous year.
During the early part of the year I had the services of a boy ; but, after an interval, he was replaced by an assist- tant. upon whose engagement I congratulate the Society. Miss E. H. APPLETON was secured toward the end of Sep- tember. She brings to her duty unusual qualifications and a rare zeal. Her salary is fixed at $500 per year.
The efforts of the Society to secure a lot of land or a building have not been successful. Negotiations with the Trustees of the Cincinnati University promised very fairly at one time ; but the erection of the Bellevue House in the immediate neighborhood of the site desired by the Society, induced the members to drop the subject with the Univer- sity Trustees, who were strongly inclined to accede to the Society's wishes. The funds of the Society have accumu- lated somewhat during the year; and their increase repre- sents the only approach really made toward a Library Hall.
The Library is catalogued and arranged, so far as the present confined space will permit arrangement. No shelf numbers are yet given to the volumes, as they are not needed in so small a library as this, and would probably

need to be changed whenever the books are removed to a proper building.
The Library is insured for $3,000. A larger insurance is desirable, to cover the books and pamphlets fully.
