The treaty ceding California and New Mexico to the United States was dated at the city of Guadalupe Hidalgo, February 2d, 1848; rati- fied by the United States, March 16th, 1848; exchanged at Queretaro, May 30th, 1848, and proclaimed by the President July 4th, 1848. Organ- ized as a State, December 15th, 1849; admitted in the Union on the 19th day of September, 1850.

State Elections.
The term of the present State officers commenced the 2d day of De- cember (being the first Monday), 1867, and will expire the first Monday in December, 1871.
The General Election for State and County officers is held on the first Wednesday in September; for State officers, every fourth year; for. County, every second year. The Judicial Election, for the various ju- dicial officers of the State and Counties, is held on the 3d Wednesday in October, every second year, commencing with 1863. The provision of the Constitution requiring the special judicial election, has been under consideration, and the voters at the last General Election expressed their. willingness to change it so that the judicial officers may be elected at the General Election in September, and thereby save the unnecessary expense of one election. This amendment will likely be adopted.
The Presidential Election, being provided for by Congress, takes place on the same date throughout the United States-the first Tuesday in November every four years.

(n) J. W. Mandeville was candidate for the office of Controller, 1857. A short time before the election, too short, in fact, to substitute another's name on the ticket, he accepted the office of U. S. Surveyor for the State of California. He received a majority of votes but never qualified. On the 28th of April Governor Weller appointed A. R. Meloney. George W. Whitman refused to surrender the office, on the ground that he held over until his successor was elected and qualified, and that Mandeville was elected ; hence, the Governor had no power to appoint. Moloney appealed to the Courts and final decision in his favor was rendered July Term of the Supreme Court. Meloney was elected at the general election for 1858.
(o) Milton S. Latham resigned on the 14th of January, 1860, to be elected to United States Senate.
(p) John G. Downey became Governor for balance of the term.
(g) Quinn elected President of the Senate, made vacant by the accession of Lieuten- ant Governor John G. Downey to the Executive Chair.
(r) Meloney refused to surrender the office on the ground that he was elected in 1858 and of right could hold two years. Brooks became relator vs. Melony, and the Supreme Court decided in favor of Brooks, January Term, 1860.
(s) The Legislature of 1861 made the office of State Librarian separate from Secre- tary of State, and gave the appointing power to a Board of Trustees, March 8th, 1861. The Board to consist of five members-the Governor, Chief Justice of the Supreme Court to be ex-officio members ; J. R McConnell, J. W. Winans and Solomon Hey- denfeldt appointed members of the Board. That Board appointed W. C. Stratton Librarian for four years. The Legislature of 1863-4 virtually legislated John R. McConnell and Heydenfeldt out of the Board by. appointing Dr. HI. W. Harkness and Dr. J. F. Morse in their places. Before Stratton's term expired, J. F. Morse resigned his position on the Board of Trustees, and the Governor appointed B. B. Redding to fill the vacancy. About the time for the Board to hold an election for Librarian, Stratton raised the question as to the eligibility of the Chief Justice as a member of the Board of Trustees, and caused proceedings to be instituted to test the matter. The Court sustained his position ; (30 Cal., p. 160.) In the meantime the other members of the Board failed to agree upon the appointment of Librarian, and the Governor appointed Jerome Madden ; Stratton refused to surrender the office, and proceedings were commenced against him in the nature of quo warranto, Madden relator. The Court decided in favor of Stratton (28 Cal., p. 383), and he continued to hold the position.' The Legislature of 1865-6 amended the former statute and appointed the Attorney General ex-officio member of the Board of Trustees, and also J. W. Winans, H. W. Harkness, C. G. W. French and W. C. Belcher. On the 27th March, 1866, the. Board re-elected W. C. Stratton for the term of four years. The Legislature of 1865-6 created the office of Deputy Librarian, and Albert Hart was by the Board of Trustees appointed to the position.

(u) Appointed Adjutant General by Governor Low on the Ist of May, 1864 ; resigned 30th November, 1865. Robert Robinson appointed Ist December, 1865. Robinson held the position till Evans served his term out as Senator, and he resigned. The Governor re-appointed Evans, who continued in office until the appointment of J. M. Allen by Governor Haight.
(Note 2.)-Edwin R. Campbell appointed and commissioned State Registrar the 10th of May, 1858. The law relative to the office was amended 1859, and finally repealed 1860. He resigned, however, before the repeal of the law.
(Note 3.)-The office of Adjutant General, Librarian and Deputy Librarian are held by appointment.

(a) Resigned October, 1851. H. C. Murray appointed to vacancy ; elected Novem- ber, 1852, for unexpired term to January, 1856; re-elected September, 1855, for full term ; died 18th September, 1857. S. J. Field appointed and served on that term till 1st January, 1858. Peter H. Burnett, serving on S. Heydenfeldt's term, which expired January, 1858, was appointed on Murray's term ; and acted till 2d October, 1858, wben Joseph G. Baldwin, who had been elected by the people, qualified. He served till the expiration of the term, January Ist, 1862. Edward Norton elected his successor for a full term.
(b) Resigned April, 1852. A. Anderson appointed to vacancy. Alexander Wells elected in 1852 for the unexpired term to January, 1854, and again elected Septem- ber, 1853, for full term. Judge Wells died October 31st, 1854. Charles H. Bryan appointed to vacancy, and continued till October, 1855, David S. Terry having been elected for the unexpired term. Terry resigned September 20, 1859. W. W. Cope, who had been elected to succeed Judge Terry, was appointed to the vacancy, which expired January 1st, 1860. W. W. Cope commenced January 1st, 1860, for the full term.
(c) Elected September, 1851, as successor to Judge Hastings, for the term of six years from January Ist, 1852. After the resignation of Judge Lyons, Heydenfeldt was the senior on the Bench, and in point of fact was Chief Justice. However, the records do not show that he ever acted as such. The Legislature of 1862 gave him leave of absence for six months, and authorized. the Governor to appoint to supply the temporary vacancy. Alexander Wells was appointed. The legality of this appointment was contested before the Supreme Court. Being only two Judges eligi- to sit on the case, each one holding a different opinion in the matter, of course the question could not be determined. Judge Heydenfeldt, in the meantime, returned, and entered upon the duties of the office. He resigned January 13th, 1857. Peter H. Burnett appointed to vacancy. Jannary 1st, 1858, S. J. Field qualified for full term. Resigned in 1863. E. B. Crocker appointed, and was on the Bench the April term of that year. Upon the resignation of Judge Field, W. W. Cope be- came Chief Justice. He acted in that capacity and Judge Norton and E. B. Crocker Associates, until the amendments of the Constitution were ratified and took effect.
(d) Was elected under the new Constitution; drew the short term, and was Chief Justice till January, 1866. Re-elected for full term, to commence December 2d, 1867.
(e) W. D. Harriman resigned August 3d, 1867, and Wm. G. Wood was appointed by the Governor the same day.
(f) Elected Judicial election October, 1867 ; term commence January 1st, 1868.
(g) The Legislature of 1865-6 made the Clerk of the Supreme Court a salaried office, and fixed the salary at $4,000. The fees of the Clerk of the Supreme Court are paid into the General Fund of the State. Each case is charged $20. The Legis- lature of 1867-8 fixed the salary of his deputy at $1,800 per annum. B. A. Mardis of Tuolumne County was appointed to the position.

State Boards.
Board of Examiners .- This Board examines all demands against the State and upon its order the amount due, or supposed to be due is paid. It is composed of his Excellency H. H. Haight, Secretary of State H. L. Nichols, and the Attorney General Jo. Hamilton.
Board of War Examiners -The Adjutant General, Surveyor General and the Attorney General.
Board of Military Auditors .- The duties of the Board are to consider claims growing out of military matters and things appertaining thereto. The members are the Commander-in-Chief of the State, Adjutant Gen- eral and Surveyor General.
Board of Stamp Commissioners .- Governor H. H. Haight, Treasurer Antonio F. Coronel and Attorney General Jo. Hamilton.
Board of Harbor Commissioners .- James H. Cutler, James Laidley and S. S. Tilton (res San Francisco). Robert C. Stearns, Secretary (res San Francisco). Tilton's term of office expired by limitation last November. In December the Governor appointed John H. Baird It is probable a case will arise for the Courts to determine as to which is entitled to the office.
