EARLY TOWN VOTES 1641 - 1642


The single leaf measuring 712 by 111/2 inches, somewhat frayed on the outer margin, on which the following record is written, was presented to the Connecticut Historical Society, with other manuscripts of an early date, in June 1842 by Sidney Stanley of Tolland. It is evidently from a lost volume containing the record of the earliest orders or votes of the town of Windsor. The orders or votes are in the handwriting of Dr. Bray Rosseter, the town's first recorder, and would appear to have been consecutively numbered from the first; a method followed by the same recorder in making his entries in the Windsor Town's Law Book. Orders numbers 28 to 32 are written on the obverse and numbers 33 to 39 on the reverse page of the leaf. Missing words or letters have been added in brackets.


This leaf was first printed in December 1894; but less than a dozen of the copies then printed were ever distributed.


Tho: fford hath allowed foe much land behind the meade at Podancke wch was ff[or]merly graunted bray Roffeter & Richard Vore, in 28 liew of the remaynder of meade pmifed mrs Tilly: to the valew of eleuen pounds, the ground to be valued at one fhilling p acre, vntill it amounts vnto the fumme aforefd.


Octob. 4th 1641.


Its ordered that noe man fhall fill any tymber within the lybertyes [of] the plantation for Pypeftaues or any other vfe intending to fell 29 or fend them o[r] it out of the towne, wthout fpeall allowance, eyt[her] from the towne or the feuen men, and this order to be in force vn[til] it be appealed.


Its ordered that all cornefeilds fhallbe in there fences repayre[d and] foe maynteyned both winter & fommer, firmely as it fhallbe iud[ged ] fuffycient by the ourviewers of the fence, and if any trefpaff come 30 [by] the infufficiency of the fence, by the fd fence to be fatiffyed. & in cafe the fd insufficient fence, be not repayred within t[he] warning, puided it be feaceable, they shall pay one fhilling p [day] for eury dayes neglect.


Its farther ordered that if any fwine be found wthin any corne [feild] & pounded, that the fd hogs fhall pay eightpence p hogg [accord- ing] to a former order, they ar to be kept in the pound tw[o] dayes [with] warning to the [owner?], and if he [redeam?] them not by 31 compof[ition] or paymt in that tyme, the hogs fhallbe lyable to be f[old for] the trefpas, and returning the remaynder to the owner, and i[f] the Hayward neglect any time or wth a[ny] pfon to re- quire leuy, or by compofition to receive fatiffaction according to the [tenor] of this order the fd Hayward fhall pay fiue shillings for eu[ery] fuch neglect, wch is in the power of eyther of the feuen men [to] exact it of him.

Its ordered that thofe men that ar appoynted to view the fences abo[ut] the cornefeilds they fhall immediately attend there office and ch[arge] and in cafe they proue neligent in there office videt: to ouerview [the] fences at leaft once in two m[on]eths, and to prfent at euery towne meeting of the seuen men, wether defectiue 32 or not, they fhallbe lyab[le] to five fhillings on euery default, and in cafe any fence be inf[uffi]cient after warning, and three dayes expyred according to the form[er] order, eyther the viewers of the fence fhall mend it or caufe it [to] be mended vnder the forefd penalty, and for there fatisfaction [to be] payd out of the forfeyture allowed in the order that is concer[ning] the fence:


Its ordered that Robert Winchell & richard Wellar for the northfide of the Riuulett fhallbe Hayward [s], and George Phelps for the fouthfyde, & they fhall prfently be in office, vppon all occafions as 33 they fee fitt they fhall goe through all the cornefeilds in charge & pound all hogs they find, and for there pay at 8d p hogge, they fhall receiue eyther in mony or corne at 2$ 8d p bufhell, & the fd pay fhallbe made by the owners of the Swyne eyther prfently or fub- fcribe for the certayne paymt thereof before the hoggs be deliud out of pound :

Its ordered that the way betwixt Henry Styles & James Eggleftons there homelotts downe to the greate riuer, fhallbe allow[ed] for a publicke highway for horfe & droue to Agawam & the Bay, and 34 from thence to the bridge & foe by the head of Plimouth meade downe to Harteford.

Aprill 4th 1642.


Its ordered that there fhallbe a highway betwixt mr Witchfeilds, & mr Marfhalls homelotts, to paff from the highway before the little meade weft aboue mr Witchfeilds, and then to croff the homelotts northward vntill they fall into the highway that goes vnto the mill, the common fence of the aforefd highway to be made & meynteyned 35 wholy by mr Witchfeild, John Moore, Tho; Moore, mr Branker, mr Nowell Tho: Mrshfeild mr Williams & Richard Vore, puided allfo that if the aforefd pfons can agree to allter the fd way, & fettle it betwixt mr Whitings & S[amu]el Allens homelotts wth all thofe [pfons] that haue intereft in the fame, they haue liberty therevnto.


Its ordered that the gate going into the greate meade, as allfo the 36 gate going into the little meade before mr Warehams fhallbe kept fhutt, & in cafe any leaue them open, they ar to pay Is for euery fuch default, 4ª whereof is to be payd to the pfon tha[t shall] dis- couer the fame, the reft to be returned into the tow[ne. ]


Its ordered that there fhall be a pound made on the fouth of the 37 Riuulett at a puplicke charge & mr Porter & Bray Rofseter to haue power to pris any to the worke.


Its ordered that noe cattle fhallbe free to goe in any meades yt ar planted, on this fyde of the greate riuer or ouer the greate Riuer 38 from the fifteenth of march to the fifteenth of October, or an[y] meadowes that ar for graff, vnleff the fd Cattle ar kept by a keep[er] or in clofed ground in a mans owne ppriety, in cafe any cattle ar found, or pued wthin the forefd tyme wthout fpetiall attendance according to the tenor of this order they are to pay 8d p head for euery fuch default, all former orders revoked concerning this pticular.

The two documents here printed were probably among the manu- scripts presented to the Society in June 1842 by Sidney Stanley of Tolland.


The earlier of the two is written on both sides of a folio leaf in the hand of Matthew Grant. In addition to the list of Windsor free- men the paper gives the names of those who were, probably in 1669, inhabitants of "mafaco," now Simsbury ; lists of Windsor deputies for 1674 and 1676, also a list of persons voted for in the autumn of 1675 for election as assistants the following spring.


The second and later list is written on one side of a folio leaf in an unidentified hand.
