ARTICLES, BY-LAWS, RULES AND REGULATIONS OF THE CEMETERY DEPARTMENT.
ARTICLE I. The ordinances of the City of Boston relating to the Cemetery Department shall apply to the conduct and manage- ment of this department.
ART. II. The Trustees of the Cemetery Department shall organize on the first Monday in May. At this meeting there shall be chosen a Chairman, a Secretary, a General Superintendent and custodians of the several grounds. A majority of the Commission shall constitute a quorum.
The regular meetings of the Commission shall be held on the fourteenth day, except when same comes on Saturday or Sunday, when it shall be held on the Friday preceding, and on the fourth Monday of each and every month at 3.30 o'clock P.M.
Other meetings to be called by the Chairman, as he may deem advisable.
ART. III. The Chairman shall preside over the meetings of the Commission and shall designate the hour and place thereof.
He shall sign the deeds of conveyance of lots and bonds given for the perpetual care of the same ; he shall sign and approve the bills, pay-rolls, and sign such orders as are necessary to permit interments and removals of bodies, and the opening and closing of cemeteries ; he shall make the annual and other reports to the City Council, and perform such other duties as are required by the ordinances of the city ; all bills on account of the department shall be approved by him before they are presented to the city for payment ; in the absence of the Chairman his duties shall be per- formed by such Commissioner as he delegates to act in his absence ; such delegation shall be in writing, and shall specify the specific action or actions delegated.
ART. IV. THE SECRETARY. The Secretary shall notify and attend all meetings of the Commission and perform all clerical work, and keep the records, plans and papers of said Commis- sion ; the Secretary shall keep such books as directed by the Board, showing transactions concerning the various cemeteries under this Commission, and shall prepare and record in books

kept for the purpose all deeds of conveyance of lots or bonds given for the perpetual care of the same ; the Secretary shall have charge of all the plans, books, catalogues and other papers of the Commission (except as hereinafter provided), and shall perform such other duties as may, from time to time, be delegated by said Commission.
ART. V. THE GENERAL SUPERINTENDENT. The General Superintendent shall reside on the premises known as Mount Hope Cemetery, and under the direction of the Commissioners shall have the custody of said cemetery and the general super- vision of all the cemeteries and burying grounds under the control of this Commission; he shall keep the various cemeteries and burying grounds in a condition satisfactory to the Commissioners ; shall have the authority, under the direction of the Trustees having same in charge, to engage and discharge workmen, and to order and arrange their respective duties; said Superin- tendent shall keep in books provided for the purpose, of which he shall be the custodian, regular and accurate records of all inter- ments in, and removals from, Mount Hope Cemetery, and said records shall include the names and ages of all persons interred, and also the place and date of their interment; he shall see that all the regulations made by the Commission in regard to inter- ments and the construction of tombs, monuments and fences are complied with; he shall see that the rights of the city and the regulations of the Commissioners are respected and complied with by all persons employed on any of the grounds under the control of the Commission, and by individual proprietors; he shall fulfil all contracts made with proprietors for the care and decoration of lots, for their permanent care, and perform such other duties as the Commission may require; he shall have full power to remove from Mount Hope Cemetery, and other cemeteries and burying grounds within the control of this department, improper and disorderly persons, to abate nuisances, and to remove rubbish and unnecessary and unsightly decorations or adornments; a general report of all transactions of Mount Hope Cemetery, with proper vouchers, also the number of interments made for the preceding month, shall be rendered by him; he shall also, from time to time, inspect the other cemeteries and burying

grounds within the charge of this Commission, and shall report monthly their condition, and make such recommendations as he deems advisable in reference to the same to the Commission.
The compensation of the General Superintendent shall include the use of the dwelling-house connected with Mount Hope Ceme- tery, and he may also cultivate such portions of the grounds of Mount Hope Cemetery and keep such domestic animals for his own use as the Commissioners may designate; and may be removed for cause by the vote of a majority of the Commissioners.
ART. VI. The Commission shall establish an office, wherein the Board can hold its meetings, and which shall be open to the public daily (Sundays and holidays excepted). The records of the department, under the control of the Secretary, shall be kept at such office, and the keys of the various cemeteries and bury- ing grounds shall also be kept there. The office shall be equipped in a suitable manner for the purposes of its work, and at said office the Secretary of said Board shall be located.
. COMMITTEES.
The Chairman shall at the meeting succeeding the meeting of organization appoint each one of the Commissioners a Committee of One, who shall visit, from time to time, such cemeteries and burying grounds as shall be designated by the Chairman in said appointment, and shall report to the Board of Commissioners, when required, the state and condition, with recommendations concerning the same, of such cemeteries or burying grounds as are designated.
The Commissioners as a whole shall act as a Committee on Accounts, who shall in executive session of the Board consider all bills on the fourteenth day of each month, after which the bills shall be approved by the Chairman and one Commissioner.
There shall be a Committee on Grounds and Greenhouses, con- sisting of three Commissioners, who shall consider the treatment and care of the grounds, greenhouses, trees, avenues, and paths in the cemeteries, and whose duty shall be to make such recom- mendations to the Board in reference to care, alterations, repairs and improvements therein as they shall deem expedient.
There shall be a Committee on Employees and Pay-rolls, con-

sisting of one Commissioner, and a Committee on Purchases and Supplies, consisting of one Commissioner, whose duties shall be to make such recommendations to the Board in reference to the matters pertaining to their respective committees as they shall deem expedient.
It shall be the duty of all committees to make reports to the Board, from time to time, with such recommendations as will enable the Board to pass upon the same, with due regard to the circumstances and for the best interests of the administration of the department.
INTERMENTS.
No interment shall be made in the cemeteries or burying grounds under the control of this Commission until such a per- mit as may be required by the laws of the State, or of the city or town from which the deceased may be brought, together with an order from the proprietor of the lot or tomb in which the interment is to be made, or from his legal representative, shall be obtained. Such permit, when the interment is to be in Mount Hope Cemetery, shall be sent to the Superintendent of Mount Hope Cemetery, and if in other cemeteries, to the person or per- sons designated by this Commission; but in no event until the fees have been paid.
No removal of bodies from the cemeteries or burying grounds in charge of this department will be permitted, except as provided by the laws of the State, city or town, and in the manner pre- scribed by the Board of Health, or an order from the Commis- sioners of the Cemetery Department.
Until otherwise ordered, the fees for digging a grave and making an interment in same, or making an interment in a pri- vate tomb, shall be according to the following schedule:
For a person 10 years of age and over $5 00
For a person under 10 years 3 00
Soldiers (in need) 2 50
Each additional body interred in a grave at the same
time, 10 years and over 1 00
Under 10 years 50
Deposit in receiving tomb (see article on receiving tomb), 10 00

LOTS.
Lots shall be laid out by the Superintendent in Mount Hope Cemetery and in Evergreen Cemetery, subject to the approval of the Commissioners, and every lot so laid out shall be marked with a stone number. The erection of fences, memorial stones, tombs, planting of trees, shrubs, and plants, and the adornment of lots shall be under the supervision of the Cemetery Commis- sion, who shall have the right of determining the suitability of the same, and, in the event that they deem the same unsuitable, to remove or abolish the same.
SALES AND CONVEYANCES.
No deed of any lot shall be issued to more than one grantee, nor to any person as trustee, executor or administrator, except by vote of the Commissioners.
BURIALS IN SINGLE GRAVE SECTIONS OF MOUNT HOPE AND EVERGREEN CEMETERIES.
No more than two adults, or one adult and two children under five years of age, will be allowed to be interred in one grave in the single grave sections of Mount Hope Cemetery and Evergreen Cemetery, without the consent of the Cemetery Commissioners, for which a payment of $5, $15 and $20 each, according to loca- tion, in Mount Hope Cemetery, and $15 each in Evergreen Cem- etery will be required.
When a grave shall become vacant by the removal of the bodies, the right of burial shall terminate. But in case the owner becomes a purchaser of additional rights in another section in the ceme- tery, the price previously paid shall be allowed in part payment. Rights of burial are not transferable in Section F of Mount Hope Cemetery.
No inclosures nor posts will be permitted in any of the single grave sections.
The base measurements for headstones must not be over two feet six inches in length and one foot two inches in width.
No raised mounds will be permitted in the single grave sections without permission of the Board of Cemetery Commissioners.

Rights in not more than two graves will be sold to one person at one time.
Deeds will be issued at time of purchase. In event of purchasers or their agents neglecting to supply the name for deed within sixty days, the Cemetery Department will hold the grave in trust, and will so record it, after which no interments therein or removals therefrom shall be made until a deed is issued.
RECEIVING TOMB.
Bodies may be deposited in the receiving tomb at Mount Hope Cemetery, or at Evergreen Cemetery, on the payment of ten (10) dollars to the Superintendent. If, within four months after such deposit, the body shall be interred in another part of the same cemetery, no further charge shall be made for such inter- ment; but if the body shall not be removed from the tomb within the period above specified, the General Superintendent may cause the body to be interred in such place as shall be designated by the Commissioners. But the Superintendent, under the direction of the Commissioners, may allow the body to remain a longer time, on the payment, in advance, of three (3) dollars per month for an adult and two (2) dollars per month for a child.
MONUMENTS, STONES, FENCES, ETC.
Proprietors have a right to erect on their lots monuments and stones of appropriate character. Tablets or other devices of wood, fences of wood or iron, or hedges are not permitted.
No grave or tomb shall be opened for an interment or removal by any person except by order of the Commissioners or Super- intendent.
FUNERALS.
Early notice should be given to the Superintendent at Mount Hope Cemetery of funerals which are to be held in that cemetery, and in other instances to the custodians or the Secretary of the Commissioners.
At least twenty-four hours' notice shall be required.
VISITORS.
Mount Hope Cemetery, Evergreen Cemetery, Bennington Street Cemetery, the Dorchester North and South and Copp's Hill

Burying Grounds (the latter from May 1 to November 1) shall be kept open daily, Sunday included, from eight o'clock A.M. to sunset. All other cemeteries shall be kept locked, and the keys thereof shall be in the custody of the Chairman, or of such per- son as he shall designate to hold the same. Visitors desiring to obtain admittance to such cemeteries or burying grounds shall make application to the Chairman or Secretary of the Commis- sion, or to the Commissioner in charge thereof, who shall, in his discretion, under such provision or circumstance as he deems expedient, allow said cemetery or burying ground to be opened to the inspection of the applicant. Lot holders and owners of tombs in said cemeteries or burying grounds shall have a right to visit the same, within reasonable time after notice of their desire to the Chairman or Secretary of the Commission.
RULES AND REGULATIONS.
1. Mount Hope Cemetery, Evergreen Cemetery, Bennington Street Cemetery, the Dorchester North and South, and Copp's Hill Burying Grounds, as aforesaid, shall be open to visitors at all seasonable hours.
Persons desiring to visit the other burying grounds may do so by making application at the office of the Cemetery Department in City Hall.
2. No horse is to be driven within the cemeteries or burying grounds under this department faster than a walk, and no horse shall be left in the grounds without a keeper except by the con- sent of the custodian in charge, who may designate places where the horse may be fastened or secured.
3. No bicycles or automobiles allowed on the grounds.
4. Visitors must at all times be orderly, and will not be per- mitted to walk on the flower beds, upon the grass or the graded lots or borders.
5. All persons are prohibited from gathering flowers, cutting or breaking any tree, plant or shrub, carrying or eating luncheon in any of the grounds of this department, and no one shall be allowed to write upon or to otherwise deface any sign, monument, fence or structure, within the control of this department.
6. No slab, monument, marker, or other structure shall be

erected in or removed from any of the said cemeteries without the permission of said Commission or some person delegated by it to act in the premises.
7. The Superintendent or custodian in charge of the cemetery is authorized to remove all persons who violate any of these regulations.
