GENTLEMEN,-In acknowledging receipt of your Company's cheque, in pay- ment in full of the sum of $5,000, covering the amount called for in Policy No. 33,650, in the Penn Mutual Life Insurance Company, of Philadelphia, on the life of the late Colonel B. W. Hoyt, of Epping, N. II., it seems right and proper that we should place on record the facts involved in the payment of this amount, as well as our grateful sense of appreciation of the just and equitable provisions of the policy contract, and also the promptness and courtesy which have character- ized your conduct in the matter.
The policy was issued by your Company on the thirtieth day of April, 1883. But two annual payments of $256.35 each have been made, and thirty per cent of those by premium note. When the third annual payment became due, in April, 1885, Colonel Hoyt neglected to pay, and the Policy lapsed for non-pay- ment of premium. After Colonel Hoyt's death, upon an examination of his ef- fects, this Policy was found, and inquiry was made whether it possessed, under the lav's relating to non-forfeiture, a certain paid-up value. It was found that the Policy provided for the issuance of a " paid-up " Policy after two full annual premiums had been paid, provided application was made within sixty days from the date of payment. Colonel Hoyt had made no application ; consequently no paid-up value existed, and under ordinary circumstances the Policy would have been of no value. But another feature peculiar to the " Penn Mutual" was brought to notice, wherchy it is agreed that if no application is made for a "paid-up" Policy, then the full legal reserve shall be applied to extend the Policy in force for as many years and days as it will pay the premium.
We werc informed that under this admirable and equitable feature of the Policy it was still in force to its full amount, and would be paid, less the amount of the unpaid annual premium, with interest. This has now been done ; and we note that if this Policy had been issued by a Massachusetts company, the bene- ficiaries would have : eceived, under the Massachusetts non-forfeiture law, three hundred and ninety-eight dollars ($398), being its full paid-up value, instead of $5,000, less one premium of $236.35. with interest of $12.10, from which was deducted a dividend of $40.85, making the net amount received, $4,772.40.
We feel that the peculiar circumstances connected with this case justify us fully in making this detailed statement, and close with our most hearty con- gratulations to you personally, in representing a Company which gives not only "Insurance which does Insure," but also adds every feature which is desirable to its contracts in the line of securing to its policy holders all the rights and equities to which they are honestly entitled
