Annual Town Meeting, March 5, 1900


WARRANT.


ESSEX, SS: To either of the Constables of the Town of Andover. GREETING :


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Andover qualified to vote in town affairs, to meet and assemble in the Town House, in said Andover, on Mon- day, the fifth day of March, 1900, at eight o'clock, A. M., to act on the following articles:


Article 1st. - To choose a Moderator to preside at said meeting.


Article 2nd. - To choose Town Clerk, Treasurer, Col- lector of Taxes, three members of the Board of Selectmen, Assessors and Overseers of the Poor for one year, one mem- ber of the Board of Health for three years, three members of the School Committee for three years, one Trustee of the Memorial Hall for seven years, one Trustee of the Cornell Fund for three years, one Park Commissioner for three years, one member of the Board of Public Works for three years, one Tree Warden for one year, one or more Auditors of Accounts, Constables, Fence Viewers, Field Drivers, Sur- veyors of Lumber, a pound keeper, Fire Wards, and any other officers the town may determine to choose.

Article 3rd. - To take action on the following question : " Shall licenses be granted for the sale of Intoxicating Liquors in this town?"


Article 4th. - To determine what sums of money shall be appropriated for Schools, School-houses, School-books and Supplies, Highways and Bridges, Macadamized Roads, Side- walks, Removing Snow, Horses and Drivers, Street Lighting, Town Officers, Public Works, Sinking Fund for Memorial Hall Notes, Fire Department, Town House, Almshouse, Re- pairs on Almshouse, State Aid, Military Aid, Relief out of Almshouse, State Tax, County Tax, Abatement of Taxes, Interest on Bonds, Funds and Notes, Redemption of Bonds, Voted Oct. 21, 1889, Notes Payable, Printing and Stationery, Miscellaneous, Memorial Day, Insurance, Spring Grove Cem- etery, Hay Scales, Park Commission, Public Dump and other town charges and expenses.


Article 5th. - To see if the Town will authorize the issue of twenty thousand dollars of Sewer Bonds for construction purposes on petition of the Board of Public Works.


Article 6th. - To see if the Town will appoint a com- mittee to readjust the grades of the streets and appropriate a sum of money therefor on petition of the Board of Public Works.


Article 7th. - To see if the Town will purchase the land adjoining the Town Farm owned by J. C. Foster of Oakland, Cal , and known as the Brick Yard property (containing about twenty-two acres) and appropriate a sum of money therefor on petition of T. F. Pratt and others.


Article 8th. - To see if the town will locate and maintain three incandescent lamps on Main street in Scotland District,

one near B. F. Holt's, one at four-corners near the late resi- dence of John B. Abbott, one at four-corners near Wm. H. Carter's, and appropriate a sum of money therefor on pe- tition of Newton Jaquith and others.


Article 9th. - To see if the Town will locate and main- tain an incandescent lamp on Lowell street near James H. Kibbee's, and appropriate a sum of money therefor on pe- tition of C. H. Kibbee and others.


Article 10th. - To see if the town will put all shrubs and bushes on the roadsides in charge of the Tree Warden on petition of the Park Commissioners and others.


Article 11th. - To see if the Town will appropriate a sum sufficient to place a marker of the Society of the Sons of the American Revolution, at the grave of each revolutionary soldier or sailor buried in this town, the expense not to ex- ceed one dollar each, on recommendation of the above named society.


Article 12th. - To hear and act upon the report of the Selectmen in regard to appropriating a sum of money suf- ficient to widen Chester street in Ballardvale, beginning at a point on Lowell street and running southwesterly about six hundred feet.


Article 13th. - To see if the Town will vote that official ballots shall hereafter be used in town elections according to section 360, Chapter 548 of the Acts of 1898, on petition of B. M. Allen and others.


Article 14th. - To see if the Town will vote to lower the bed of Roger's Brook, so called, and appropriate a sum of money therefor on petition of A. P. Richardson and others.

Article 15th. - To see if the Town will appropriate one hundred and fifty dollars to lower the Culvert on School street between the residences of Mrs. Esther H. Byers and E. K. Jenkins.


Article 16th. - To see if the Town will accept and adopt the new town Seal as recommended by the State Commis- missioner of Public Records.


Article 17th. - To act on the reports of the Town Officers.


Article 18. - To see if the Town will revise and accept the list of names of Jurors prepared and posted by the Se- lectmen.


Article 19th. - To fix the pay of the Firemen for the en- suing year.


Article 20th. - To determine the method of collecting the taxes for the ensuing year.


Article 21st. - To determine the disposition of unex- pended appropriations.


Article 22nd. - To authorize the Treasurer to hire money for the use of the Town in anticipation of Taxes, upon the approval of the Selectmen.


Article 23rd. - To determine the amount of money to be raised by taxation the ensuing year.


Article 24th. - To transact any other business that may legally come before the meeting.

Pursuant to the foregoing Warrant, I, the subscriber, one of the Constables of the Town of Andover, have notified the inhabitants of said town to meet at the time and place, and for the purposes stated in said Warrant by posting a true and attested copy of the same on the Town House, on each School house, and in not less than five other public places, where bills and notices are usually posted, said Warrants have been posted two Sundays.

At a legal meeting of the inhabitants of the Town of An- dover qualified to vote in town affairs, convened at the Town House in said Andover on the 5th day of March, 1900, at eight o'clock in the forenoon, agreeably to the requirements of the foregoing Warrant, and after reading part of the same by the Clerk it was

Voted, That the matter of Street Lighting be under the same Committee as last year as follows : William G. Gold- smith, Barnett Rogers, John L. Smith, John W. Bell, Colver J. Stone.


Voted, That fifteen hundred dollars be appropriated for the Town House and a committee of three be appointed by the Chair to look into the matter and report at a future meeting. The Chair appointed as that Committee William S. Jenkins, Jacob W. Barnard and John N. Cole.


Voted, That a Finance Committee of fifteen, as last year, be appointed by the Chair to make recommendations for next

year, and that it consist of one member of the Board of Selectmen, one member of Board of Public Works ; one mem- ber of the School Committee ; one member of the Engineers of the Fire Department. the Highway Surveyor, and the re- mainder from the citizens at large. The Chair appointed the following persons as that Committee: John L. Brewster. School Committee: John L. Smith. Public Works : Samuel H. Boutwell. Selectmen : Lewis T. Hardy, Fire Department ; Joseph T. Lovejoy, Highways ; E. Kendall Jenkins, John W. Bell. Bancroft T. Haynes, Arthur Bliss. Barnett Rogers. Howell F. Wilson. Walter S. Donald. George T. Eaton, Peter D. Smith and Edgecomb J. Rowe.


Took up Article 5.


Voted. That the Treasurer be and he is hereby authorized to issue the bonds of the Town to be designated on their face as the Andover Sewer Loan to the amount of twenty (20) thousand dollars in addition to the amount heretofore issued, for this purpose, the proceeds to be used for the purpose of constructing a system of sewers for the Town as author- ized by Chap. 386, Acts of 1895. and Chap. 139 Acts of 1897.


The bonds hereby authorized shall be twenty (20) in num- ber and shall be of the denomination of one thousand (1000) dollars each. They shall be numbered from one hundred and eleven (111) to one hundred and thirty (130) both numbers inclusive, they shall bear date of June 1st. 1900; and mature and be paid June 1st., 1905 ; they shall bear interest at the rate of four (4) per centum per annum and the interest shall be paid semi-annually on the first day of June and December of each year : they shall have coupons attached to them providing for the payment of said interest at the times aforesaid ; the principal and interest of said bonds shall be payable at some convenient bank or office in the City of Boston. Said bonds shall be signed by the Town Treasurer and countersigned by the Board of Public

Works as required by law in this behalf, and shall be issued from time to time as the proceeds may be required by the Board of Public Works. They shall be sold by the Treasurer to the highest bidder therefor in proposals to be solicited by him from bankers and others.


For the purpose of paying the principle of said bonds at their maturity, a sinking fund is hereby established in ac- cordance with the provision of law in this behalf, and the Treasurer is hereby authorized and required to pay into said sinking fund whatever premium may be received from the sale of said bonds in excess of their face value and there shall be raised by taxation and contributed annually such sums as shall be sufficient with the excess from receipts from assessments and payments, together with the accumu- lations thereof, to pay the principle of said bonds at their maturity, but said sinking fund shall remain inviolate and pledged to the payment of said bond and not to be used for any other purpose.

Voted, That the Board of Public Works have charge of the matter of readjusting the grades of the streets, and that the sum of two hundred dollars ($200) be appropriated for that purpose.

Voted, That the Selectmen be authorized to purchase the Brick Yard property, if, in their judgment it is desirable, at a price not to exceed twelve hundred dollars ($1,200).

Moved, That all shrubs and bushes on the road sides be put in charge of the Tree Warden.

Voted, That fifty dollars ($50) be appropriated for the purpose of placing a marker of the Society of the Sons of the American Revolution at the grave of each Revolutionary Soldier and Sailor buried in the Town, to be expended under the direction of the local chapter, Daughters of the Revolu- tion.

Moved, That official ballots shall hereafter be used in Town elections according to Section 360, Chapter 548 of the Acts of 1898.

Voted, That the matter of lowering Rogers' Brook, so called, be referred to the Board of Park Commissioners and the Board of Public Works, to report at the next Annual Town Meeting.

Voted, To report the matter of lowering the culvert on School Street to the Highway Surveyor.

Voted, To adopt the new Town Seal as recommended by the State Commissioner of Public Records.

Voted, To accept the report of the Town Officers. Mr. J. Newton Cole, for the committee appointed to look into the methods of book-keeping employed by the Town, reported that they found the system very good, but suggested the dis- continuance of making an order on the Treasurer for each bill, and instead, making one order for the total footing of each department. It was also suggested that all bills be en- tered and ready for payment by noon of pay day.

Voted, That the pay of Firemen be the same as last year, twenty-five dollars per year.


Took up Article 20.


Voted, That the Tax Collector be paid a salary of one thousand dollars as Town Clerk, Tax Collector, and Clerk of the Selectmen, Assessors and Overseers of the Poor, and all fees collected be turned into the Town treasury.


Took up Article 21.


Voted, That all unexpended appropriations be turned into the Town treasury.

Took up Article 22.


Voted, That the Treasurer be authorized to hire money for the use of the Town in anticipation of taxes, upon the ap- proval of the Selectmen.


Took up Article 23.


Voted, To raise eighty-seven thousand dollars (87,000.00) by taxation the ensuing year.


Took up Article 24.


Voted, That the meeting be dissolved.


The meeting was dissolved at 4.30 o'clock P. M.


The foregoing is a true copy of the Warrant and the Offi- cer's Return thereon, also a true record of the doings of the meeting.
