REPORT OF THE TOWN CLERK


For the Year Ending December 31, 1942 RECORD OF THE ANNUAL TOWN MEETING January 19th, 1942, With Its Adjournments


Article 1. To choose all necessary Town Officers, the following officers to be voted on one ballot, viz: a Moderator for one year, Town Treasurer and Collector of Taxes for two years, two Selectmen for three years, two members of the School Board for three years, one member of the Planning Board for five years, one member of the Board of Assessors for three years, two members of the Finance Committee for three years.


The Polls will be open at 12 o'clock noon for vote on the foregoing Article and will not be closed before 8 o'clock P. M.


Meeting called to order at 11:45 A. M. in Precinct 1 by Warden Allan, Precinct 3 by Warden Cushman, and in Precinct 2 by Moderator Clark. In Precinct 2 the warrant was read by the Town Clerk.


Precinct 1-Robert C. West, Leila M. Allan, Inez M. Chandler, Maurice J. Guerin and Paul Green. These were sworn in by Warden B. J. Allan. Mr. Allan had previously been sworn in by Town Clerk Thomas.


Precinct 2-Sylvanus L. Brett, William Keenan, Jr., Abraham G. New- kirk, Laura Norris, Esther Robidoux, Arthur Massicott, John Touhy, Ellen J. Gaudette, Peter D. Gravelin, Willard A. Dunham, Theresa M. Pillsbury, Annie C. Healey, Louise Cashon, Siegfried Lindstrom and A. Wilbur Fill- more. These were sworn in by Moderator Clark.

An amendment was made under Highway Wage account changing the figure from 9,000.00 to 12,000.00. The vote on this was Yes 180, No 19.

An amendment was voted on American Legion account, splitting the $250.00 appropriation into two accounts, Armistice Day $150.00 and for Observation $100.00.


Due to the fact that under unclassified an item for unpaid 1940 and 1941 bills in the amount of $962.17 appears thereon, a count vote was taken with the result Yes 237, No 0, therefore a unanimous vote.


Article 3. To see if the Town will vote to authorize the Town Treas- urer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning Janu- ary 1, 1942, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accord with Section 17, Chapter 44, General Laws.


Voted that the Town Treasurer be authorized with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1st, 1942, and issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 4. To hear the report of any committees or officers of the Town to appoint any committees or take any action relative thereto.


Percy Churbuck read report listed on front page of budgets as the , report of Finance Committee pertaining to budget for ensuing year.


Allan M. Hale, Chairman of Committee appointed at special meeting held May 19, 1941, reporting for this committee, read his report which in effect was that they do not recommend acceptance of the Planning Laws in General Laws, Chapter 41, Section 81A, and amendments thereto. Voted that report of this committee be accepted, that committee be thanked and discharged.


Voted that a Committee of Five be appointed by the Chair to investi- gate the question of establishing a retirement fund for Municipal Em- ployees and to study the salaries of same.


Committee appointed: Charles S. Carver, Manuel Sylvia, William H. Crapo, Lewis F. Harding, John V. Sullivan.


Benjamin C. Shaw made a verbal report for committee appointed a year ago to study plans for safeguarding the mementoes of the G. A. R. Hc stated that there was one remaining member of the G. A. R. and that it was not desired by him that any change be made in the custody of these mnementoes.


Article 5. To see if the Town will vote to raise and appropriate for the use of the Plymouth County Trustees for County Aid to Agriculture, a sum not exceeding two hundred dollars ($200), and choose a Town Director for one (1) year, as provided in Sections 41 and 45 of revised Chapter 128 of the General Laws, or take any action relative thereto.


Voted to raise and appropriate for the use of the Plymouth County Trustees for County Aid to Agriculture, the sum of two hundred dollars ($200.00) and choose as Town Director, H. Arthur Standish, for one year, as provided in Sections 41 and 45 of Chapter 128 of the General Laws, and amendments thereto.

Article 6. To see if the Town will vote to raise and appropriate a sum of money for the purpose of repairing and operating Road Machinery; and act anything thereon.


Voted to raise and appropriate the sum of one thousand five hundred dollars ($1,500.00) to be applied to the Road Machinery Account for the purpose of repairing and operating road machinery.


Article 7. To see if the Town will vote that the income from sales of gas and electricity to private consumers or for gas and electricity sup- plied to municipal buildings or for municipal power and street lights, be appropriated for the municipal light plant, the whole to be expended by the Manager of Municipal Lighting under the direction and control of the Board of Selectmen for the expense of the Plant for said fiscal year, as defined in Section 57 of Chapter 164 of the General Laws, and that, if said income shall exceed said expense for said fiscal year, such excess shall be transferred to the construction fund of said plant and appropri- ated and used for such additions thereto as may thereafter be authorized by the Board of Selectmen, and act thereon.


Voted that the income from sales of gas and electricity to private con- sumers or for gas and electricity supplied to municipal buildings or for municipal power and street lights, be appropriated for the Municipal Light Plant, the whole to be expended by the Manager of Municipal Lighting under the direction and control of the Board of Selectmen for the expenses of the Plant for said fiscal year, as defined in Section 57 of Chapter 164 of the General Laws.


Article 8. To see if the Town will vote to accept the Abisha Clark property deeded the town by the late William G. Boynton, and to act any- thing thereon.


Voted to accept without payment of any purchase price the following described parcels :


Parcel 1-Land near Easterly side of Everett Street.


Parcel 2-Land on the Southerly side of Mayflower Avenue.


Parcel 3-Known as lots 7, 8, 9, 10 on plan of Luther Dean.


Parcel 4-Parcel No. 5 in deed of Abisha T. Clark.


Parcel 5-Land on Northwest side of Wood Street.


Parcel 6-Lots 37, 38, 39, 40, 72, 73, 74, 75 on plan of Hillside Park.


Parcel 7-Land on Northerly side of Wood Street.


Parcel 8-Known as "Heater Lot", being Parcel No. 14 in Deed of Abisha T. Clark.


Parcel 9-Parcel No. 16 in deed of Abisha T. Clark located on Easterly and Southerly side of the Nemasket River.


Article 9. To see if the Town will vote to accept the provisions of Chapter 710 of the Acts of 1941 entitled "An act relative to the Registration and Operation of certain Bicycles," and act anything thereon.


Voted that the Town of Middleboro accept the provisions of Chapter 710 of the Acts of 1941 entitled, "An Act Relative to the Registration and Operation of Certain Bicycles."


Article 10. To see if the Town will vote to accept Bartlett Street as laid out by the Board of Selectmen, and act anything thereon.

Article 11. To see if the Town will vote to accept Lois and Margerie Streets, as laid out by the Board of Selectmen, and act anything thereon.

Article 12. To see if the Town will vote to extend the Water Mains on Center Street from Crowell Street to Cross Street, a distance of about 3600 feet, on Cross Street from Centre Street to Taunton Street, a distance of about 1700 feet, on Taunton Street in a westerly direction from Centre Street about 1000 feet, raise and appropriate a sum of money for the same by loan or otherwise, or take any action relative thereto. (By Request)


The motion on this article was lost by a vote of Yes 15, No 43.


Article 13. To see if the Town will vote to raise and appropriate a sum of money for the purpose of installing a two way radio broadcasting set for the use of the Police and Fire Departments or take any action relative thereto.


Voted to raise and appropriate the sum of two thousand dollars ($2,000.00) for the purpose of installing a two way radio broadcasting set for the use of the Police and Fire Departments.


Article 14. To see if the Town will vote to extend the water main on Cherry Street from its present terminus near the house of George Leland, , southerly along Cherry Street crossing East Grove Street to the residence of Ernest M. and George E. Busby, raise and appropriate a sum of money for the same by loan or otherwise, or take any action relative thereto. (By request.)

Article 15. To see if the Town will vote to extend the water mains on Everett Street from North Street to Cross Street, a distance of approxi- mately 3400 feet, the appropriation to be raised by loan or otherwise in accordance with Chapter 44 of the General Laws, and act anything thereon.

Article 16. To see if the Town will vote to raise and appropriate the sum of twenty-three hundred dollars ($2300.00) to be used for the maintenance and reconstruction of Perry Street, Miller Street, and Smith Street, said sum to be expended in conjunction with State and County funds, as provided by Chapter 90 and amendments of the General Laws, and to take any action thereon.

Article 18. To see if the Town will vote to accept a triangular shaped piece of land now or formerly owned by Alton Rogers and located at the intersection of Centre Street and Lane Street for highway purposes and to take any action thereon.


Voted to accept without payment of any purchase price triangular shaped piece of land at the intersection of Centre Street and Lane Street.


Article 19. To see if the Town will vote to raise and appropriate a sum of money for the purpose of purchasing a strip of land for highway purposes, said land being located at the intersection of Lane and Centre Streets and now or formerly owned by Waronika Drewinsky, and to take any action thereon.

Article 20. To see if the Town will vote to raise and appropriate a sum of money for the purpose of paying land damages incidental to Chapter 90 Highway Construction on Fuller Street, and to take any action thereon.

Article 21. To see if the Town will vote to raise and appropriate a sum of money by loan or otherwise for the purpose of continuing W.P.A. and act anything thereon.


Voted to raise and appropriate the sum of five hundred dollars ($500.00) for the purpose of financing the Works Projects for the year 1942, said appropriation to be spent under the direction of the Board of Selectmen.


Article 22. To see if the Town will vote to accept Lincoln Street as laid out by the Board of Selectmen and act anything thereon.

Article 23. To see if the Town will vote to authorize the Selectmen to accept a parcel of land to be used for street purposes on Lincoln Street, so called, said parcel to be deeded to the Town of Middleboro by the owner or owners of the land which parcel was formerly owned by the heirs of Everett T. Lincoln, and act anything thereon.
