The Commonwealth of Massachusetts


Essex ss. To either of the Constables of the Town of Middleton, in tha County of Essex :


GREETING :


In the name of The Commonwealth of Massachusetts, you are hereby directed to notify and warn the in - habitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Town Hall in said Middleton on the fourteenth day of March next, at eight o'clock in the evening, then and there to act on the following articles :


ARTICLE 1. To authorize tha Selectmen to appoint such other Town Officers as are required to be chosen annually.


ARTICLE 2. To hear 'and act on Committee Reports.


ARTICLE 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1950, and to issue a note or bonds therefor, payable within one year, and to renew such note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.


ARTICLE 4. To see if the Town will vote to form a Public Welfare District, joining with Boxford and Tops- field, in accordance with the provisions of Sections 44, 45 and 46 of Chapter 117 of the General Laws. ARTICLE 5. To see if the Town will vote to raise and appropriate $2,600.00 for the purpose of maintain- ing a common public welfare office and employing suitable persons to assist the Board of Public Welfara of Middleton in carrying out the provisions of Chapters 117, 118, 118A and 122 of the General Laws. ARTICLE G. To see what action the Town will take to defray the Town axpenses for the ensuing year,


ARTICLE 7, To see if the Town will vote to raise and appropriate the sum of $2,000.00 for Chapter 90 High- way construction on Essex Street; said sum to be used in conjunction with any money which may be allotted by the State and County for this purpose.


ARTICLE 8. To see if the Town will vote to raise and appropriate the sum of $2,000,00 for Chapter 90 Maintenance, said funds to be used in conjunction with any money alloted by the State for this purpose ARTICLE 9. To see if the Town will vote to raise and appropriate the sum of $4,800.00 for Chapter 81 Highway work ; said money to be used in conjunction with any money allotted by the State for this purpose. ARTICLE 10. To see if the Town will authorize the Board of Assessors to use such free cash in the Treasury as they, in their best judgment, feel is warranted, and is approved by the Commissioner of Corporations and Taxation, for the purpose of reducing the tax rate,


ARTICLE 11. On petition of the Finance Committee to see if the Town will vote to appoint a committee to investigate the advisability of selling or leasing the operations of the Electric Light Department.


ARTICLE 12. To see if the Town will vote to appropriate the sum of $225.00 to be used by the Tree War- den to remove trees on Maple Street opposite the Essex Sanatorium.


ARTICLE 13. On petition of South Middleton Improvement Association, [Incorporated, to see if the Town will vote to have the School bus re-routed through River Street in order to pick up the High School students, and appropriate money for the same.


ARTICLE 14. On petition of Esther L. McColley and twelve (12) others, to see if the Town will vote to ac- cept Highland Road from Maple Street to Pine Street, an approximate distance of 300 feet, and Pine Street from Highland Road to Grove Street, an approximate distance of 350 feet.


ARTICLE 15. On petition of Harold E. Tyler and forty-five (45) others, to see if the Town will vote to ex- tend street lights on Lakeview Avenue (off North Main Street) and appropriate a sum of money for the same.


ARTICLE 16. On petition of Barbara M. MacQuarrie and twenty-two (22) others, to see if the Town will vote to install street lights on Peabody Street and appropriate a sum of money for the same.


ARTICLE 17. On petition of Electric Light Department to see if the Town will vote to accept the sum of $3,000.00 from the earnings of the Electric Light Department,


ARTICLE 18. On recommendation of the Planning Board to see if the Town will appropriate the sum of $300.00 to remove one side of stone abutment of the old railroad right of way, and gravel in low area on Oak Road.


ARTICLE 19. On recommendation of the Planning Board to see if the Town will vote to have a special com- mittee appointed by the Moderator consisting of the Chief of the Fire Department, Highway Surveyor, Chief of Police, a member of Finance Committee, a member of the Planning Board and two other qual- ified impartial voters of the Town, with no department having more than one representative on committee, to investigate and make recommendations as to best location, type of building and cost to adequately house the fire, police and road equipment, and to report to Town before September 30, 1950. Further recom- mend that the sum of $200.00 be appropriated to meet necessary expenses of committee.


ARTICLE 20. To see what action the Town wishes to take with regard to accepting Chapter 54, Sect. 103A of General Laws, the effect of which would make Chapter 54, Sections 86 to 103 inclusive and Chapter 56, Section 27 and Section 34 dealing with absentee ballots applying to regular Town elections.


ARTICLE 21. On petition of Elmer P. Morrill, Chief of Fire Department to see if the Town will vote to appropriate the sum of $4,000.00 for the purchase of an 800 gallon tank truck, booster pump, reels, hose and necessary equipment for the Fira Dapartment.[


ARTICLE 22, On petition of Clarence Osgood, Moth Superintendant, to see if the Town will vote to pur- chase a power sprayer and appropriate the sum of $2,000.00 for same, agreeable to the Moth Superintend- ant.


ARTICLE 23. To hear and act on the report of the committee appointed by the Moderator at the annual town meeting of 1949 to investigate additional school facilities.


ARTICLE 24. To see if the Town will vote to raise and appropriate a sum of money to build an addition to the Howe-Manning School and to originally equip and furnish the same; and to provide for the rais. ing of such sum of money by taxation, by appropriation from available funds in the treasury, or by the issue of bonds and notes in accordance with the provisions of Section 7, Chapter 44 of the General Laws. and of the special act entitled "An Act Authorizing the Town of Middleton to Borrow Money for the Con- struction of an addition to the Howe-Manning School," enacted by the General Court of 1950; or to take any other action relating thereto agreeable to the petition of the committee to investigate school facilities. ARTICLE 25. To see if the Town will vote to authorize the Moderator to appoint a school building com- mittee, or to authorize the existing committee to investigate additional school facilities to act as a school building committee, to build an addition to the Howe-Manning School and to originally equip and furnish the same, to enter into all necessary contracts for this purpose, and to exercise on behalf of the Town all other powers necessary and incidental to the principal authority to build, equip and furnish such addition ; or take any other action relating thereto, agreeable to the petition of the committee to investigate ad- ditional school facilities.


ARTICLE 26. To see if the Town will vote to conform with tha requirements of Chapter 166, Section 32 of the General Laws as amendel regarding the appointment of the Inspector of Wires by the Select- men.


To transact any other business that may lawfully come before this meeting.


You are hereby ordered to notify and warn said qualified voters to meet at the Town Hall, on Monday, March 20, next for the following purposes, viz : [To choose by ballot] the following Town Officers for tha ensuing yesr :


Moderator, Town Clerk, three Selectmen, one Assessor for three years, Town Treasurer for three years, one member of the Board of Public Welfare for three years, and one member for one year, Highway Surveyor, Tax Collector, Tree Warden, Constable, Superintendent of Burials, ona Electric Light Commissioner for three years, one member of the School Committee for three years, two Trustees of the Flint Library for three years, one Cemetery Commissioner for three years, and one for ona year, Custodian of Town Hall, one member of the Planning Board for five years.


The polls will be open at 6:00 A. M. and shall be closed at 6:00 P. M.


And you are directed to serve this Warrant, by posting up attested copies thereof at the Town Hall, Post Office, and Store at Howe Station, in said Town, seven days at least bafore the time of holding said meeting.


HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clark, at the time and place of meeting, as aforesaid.
