Selectmen's Report.


May 7th, 1898, certain bills were presented to us by the Road Commissioners, for payment. We refused to pay these bills, believing that a vote passed at a special Town Meeting, held April 7th, 1898, excluded the same.


We finally agreed with the Road Commissioners to submit a copy of that vote and these unpaid bills to an Attorney.


The following is his opinion of the same.


TAUNTON, MASS , MAY 9, 1898. To the Selectmen of the Town of Dighton. S


GENTLEMEN :-


I am asked for my opinion with reference to who should be employed to labor on the highways of the Town of Dighton under the vote of said town passed Monday, April 4th, 1898. The vote passed was as follows :


"That the compensation for labor on the highways be the same as last year, and that none but citizens of the town be employed."


A citizen is an inhabitant of a city, and is so defined in most of the dictionaries. Speaking more strictly a citi- zen is one who, under the Constitution of the United States. has a right to vote for representatives in Congress, and other public officers, and who is qualified to fill offices in the gift of the people.


In my opinion, there can be no doubt that the word "citizen" as used in this vote is not to be given its strict

technical meaning, but its more liberal meaning, of "inhabi- tant" or "resident." The word "citizen" being followed and qualified by the words "of the town," and the wording of the whole vote being taken into consideration, I believe that under it any resident or inhabitant of the town could be employed upon its highways, and that it was the at- tempt so far as the vote appears, to encourage home labor and discourage the employment in the town work of people who do not live within the town.


If the attempt was to prevent the employment of some foreign born residents of the town, who were not nat- uralized, I do not believe under the vote passed that the attempt was successful.


Substituting for the words "citizen of the town" the words "Dighton Citizens" it seems to indicate that the town's people should be employed instead of the people of other towns, in the labor on the town roads.


The Road Commissioners under this vote have in my opinion, the right to hire any resident of the town to labor on its highways.
