PRESIDENTIAL PRIMARY, APRIL 25, 1944


The Presidential Primary was held at the Town Hall, Tuesday, April 25, 1944.


The meeting was called to order, the Warrant read and the Polls declared open at 3 o'clock P. M. by Lawrence R. Stone, a member of the Board of Selectmen.

The meeting was called to order by the Moderator, Oliver Wolcott, at seven- thirty-two o'clock in the evening, Monday, March 6, 1944.


The Rev. Fr. Edward McGlaughlin offered prayer.


Mr. John H. Perkins was recognized by the Moderator and addressed the meeting as follows: "It is with deep regret that the Selectmen have just been advised that a familiar figure will not be with us tonight, our genial Town Clerk, who has wisely followed the advice of his physician that he not attempt to come out tonight. This would have made twelve years he has served at the Town Meeting and we hope he will continue to improve. In the meantime Francis Whipple will carry on in his place."


Article I. "To bring in your ballots for :


Moderator for one year.


Town Clerk for one year.


Three Selectmen for one year.


Three Overseers of Public Welfare for one year.


Treasurer for one year. Tax Collector for one year.


One Surveyor of Highways for one year.


Tree Warden for one year.


Three Constables for one year.


One Assessor for three years.


Three members of the School Committee for three years. One Library Trustee for three years.


One Cemetery Commissioner for three years.

The above named officers to be voted for on one ballot on Tuesday, the fourteenth day of March, 1944 (March 14, 1944). The polls will be opened at 5:45 o'clock A. M., and may be closed at 4:00 o'clock P. M."


Moderator : "The first article for consideration this evening is Article II."


Article II. "To choose and appoint all other Town Officers in such manner as the Town shall determine."


Moved by Mr. John H. Perkins and seconded: That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor, and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately following and that Fred Berry, Jesse S. Mann, Carl C. Anderson and Ernest M. Barker be elected field drivers for the ensuing year.


Voice vote. Motion unanimously carried.


Moved by Mr. John H. Perkins and seconded : That William W. Bancroft, Timothy A. Moynihan, Ernest M. Barker, and Wendell W. Dodge be elected measurers of wood, lumber and bark for the ensuing year.


Voice vote. Motion unanimously carried.


Article III. "To hear the report of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action thereon."


Moved by Mr. Edward A. DeWitt and seconded: That the reports of the town officers, finance and advisory committee and all departmental reports, as printed in the annual Town Report, be received and placed on file.


Voice vote. Motion unanimously carried.


Article IV. "To raise and appropriate money for the Schools, Highways and all other expenses and determine the manner of expending same."


Moderator: "As has been my custom in previous years I shall read the items as listed by the Finance Committee. If anyone wishes to debate any item he or she will call "Pass" and we will take up that item after voting on the others seriatim."

Moved by Mr. Theodore A. Holland and seconded : That the various appro- priations considered seriatim under Article IV and approved and voted be adopted as a whole, and that the temporary increases in the salaries and wages of town officials and town employees provided for and granted therein, as recommended by the town finance and advisory committee, be and hereby are for the twelve months' period from this annual town meeting of March 6, 1944, up to and including the annual town meeting to be held in March, 1945.


It was voted unanimously : That the various appropriations made be adopted as a whole, and that the recommendations of the finance and advisory

committee providing for temporary increases in the salaries and wages of town officials and town employees for the twelve month period from this town meeting of March 6, 1944, up to and including the date of the annual meeting to be held in March, 1945, be unanimously approved and adopted.


Appropriations voted. Motion carried.


Article V. "To see if the Town will vote to raise and appropriate the sum of $1200.00 for the preservation of health and protection of persons and property, to purchase equipment, uniforms and supplies for auxiliary fire and police departments, air-raid wardens, first aid rescue squads, continuance of present town defense committee and other essential units of defense, to provide for the training of its citizens in first aid and other matters essential to civilian defense, and to provide for such other means as may be necessary in the national emer- gency for the protection of the people and property in the Town, or take any action thereon."


Moved by Dr. John King and seconded : That the Town raise and appro- priate the sum of one thousand dollars ($1,000.00) for the preservation of health and protection of persons and property, to purchase equipment, uniforms and supplies for auxiliary fire and police departments, air-raid wardens, first aid rescue squads, continuance of present town defense committee and other essential units of defense, to provide for the training of its citizens in first aid and other matters essential to civilian defense, and to provide for such other means as may be necessary in the national emergency for the protection of the people and property in the Town.

Article VI. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxation, to transfer the sum of $11,000.00 from the Excess and Deficiency Fund to Maturing Debt, or take any action thereon."


Moved by Mr. Ernest Stockwell and seconded : That the Town, subject to the approval of the Commissioner of Corporations and Taxation, transfer the sum of eleven thousand dollars ($11,000) from the Excess and Deficiency Fund to Maturing Debt.


Voice vote. Motion unanimously carried.


Article VII. "To see if the Town will vote to transfer from the -present Selectmen's Unemployed Appropriation to Selectmen's Appropriation the un- expended balance for unemployment raised and appropriated under Article VII of the warrant for the Annual Town Meeting held March 2, 1942, or take any action thereon."


Moved by Mr. John Hollister and seconded : That the Town transfer from the present Selectmen's Unemployment Appropriation to Selectmen's Appropria- tions, the unexpended balance for unemployment amounting to $1,043.51, raised and appropriated under Article VII of the warrant for the Annual Town Meeting held March 2, 1942.


Voice vote. Motion unanimously carried.

Article VIII. "To see if the Town will vote to acquire by purchase a one- half ton motor truck for the use and maintenance of the Hamilton Water Department and raise and appropriate a sum of money therefor, or take any action thereon."


Moved by Mr. Ernest Stockwell and seconded: That the Town raise and appropriate the sum of $1025.00 to be expended for the purchase by the Town of a new 1942 one-half ton motor truck for the use and maintenance of the Hamilton Water Department and that the Water Commissioners be and are hereby author- ized and empowered in behalf of the Town to negotiate and consummate such purchase.


Voice vote. Motion unanimously carried.


Article IX. "To see if the Town will acquire by purchase from Emily P. Mandell of Hamilton, a certain parcel of land with the buildings thereon. situated on the westerly side of Bridge Street, in said Hamilton, and adjoining the pumping station premises of the Hamilton Water System, containing substantially 40,000 square feet of land more or less. and raise and appropriate a sum of money therefor, or take any action thereon."


Moved by Mr. Percival D. Whipple and seconded: That the Town raise and appropriate the sum of $500.00 to be expended for the purpose of acquiring by purchase from Emily P. Mandell of Hamilton, a certain parcel of land with the buildings thereon, situated on the westerly side of Bridge Street. in said Hamilton, and adjoining the pumping station premises of the Hamilton town water system, containing substantially 40.000 square feet of land more or less, the boundaries thereof to be more particularly contained in the purchase deed, and that the Selectmen with full powers, including conditions, limitations and reservations. be and hereby are authorized and empowered on behalf of the town to negotiate and consummate such purchase.


Voice vote. Motion unanimously carried.


Article X. "To see if the Town will vote to raise and appropriate a sum of money for the maintenance of various streets, said money to be used in conjunction with any money which may be allotted by the State for this pur- pose. or take any action thereon."


Moved by Mr. Edward A. DeWitt and seconded: That the Town raise and appropriate the sum of $S00.00 for maintenance of various streets. to be expended by the Town for its share of said work, provided the State cooperates with the Town and contributes to the cost thereof. as provided for by Chapter 90 of the General Laws and Amendments thereto."


Voice vote. Motion unanimously carried.


Article XI. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxation. to transfer the sum of $3.000.00 from the Excess and Deficiency Fund to the Reserve Fund, or take any action thereon."


Moved by Mr. Edward A. DeWitt and seconded : That the Town, subject to the approval of the Commissioner of Corporations and Taxation. transfer the sum of three thousand dollars ($3.000.00) from the Excess and Deficiency Fund to the Reserve Fund.


Voice vote. Motion unanimously carried.

Article XII. "To see if the Town will vote to amend the vote passed under Article XVI at the annual town meeting March 1, 1943, providing for the sale by the Town in separate parcels of the premises situated at 45 School Street, East Hamilton, by striking out all the words contained in said vote beginning with the word "that" in the first line thereof and ending with the word "tran- saction" in the eleventh line thereof, and substitute therefor the following:


Voted: That the Town sell to the highest bidder, at public auction or at private sale, the premises 45 School Street, East Hamilton, containing substan- tially 7,883 square feet of land, more or less, with the buildings thereon, and that the Selectmen in their discretion be and hereby are authorized and em- powered in behalf of the Town with full powers to do any and all things neces- sary to consummate the transaction and execute and deliver the necessary deed or deeds therefor.


Moved by Mr. Sidney Hill and seconded: That this Article be indefinitely postponed.


Voice vote. Motion unanimously carried.

Article XIII. "To see if the Town will vote to have a committee of five, to be appointed by the Moderator, to study post-war problems as they may affect the Town of Hamilton and to report the result of their investigations with recom- mendations to the annual town meeting for 1945, or at a special meeting called earlier for such purpose if necessary."


Moved by Mr. John H. Perkins and seconded: That the Town have a com- mittee of five, to be appointed by the Moderator, to study post-war problems, as they may affect the Town of Hamilton, and to report the result of their investigations with recommendations to the annual town meeting for 1945, or at a special meeting called earlier for such purpose if necessary.


Voice vote. Motion unanimously carried.


Article XIV. "To see if the Town will vote to authorize the Selectmen to sell, execute and deliver a deed or deeds therefor, land of low value, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, property taken by the Town under tax title procedure as provided for under Chapter 60 of the General Laws and Amendments thereto, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action thereon."


Moved by Mr. Lawrence R. Stone and seconded : That the Town hereby authorizes the Selectmen to sell at public auction, and to execute and to deliver a deed or deeds therefor, land or lands of low value with the buildings thereon taken by the Town under tax title procedure as provided for under Chapter 60 of the General Laws and Amendments thereto, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town fourteen days at least before the sale, and provided also that the Selectmen or whomsover, they may authorize to hold such public auction may reject any bid which they deem inadequate.


Motion unanimously approved and adopted.

Article XV. "To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of revenue for the financial year beginning January 1, 1945, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a shorter period than one year, in accordance with Section 17, Chapter 44, General Laws and Amendments thereto."


Moved by Mr. Bernard A. Cullen and seconded : That the Town authorize hereby the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of revenue of the financial year beginning Jan- uary 1, 1945 and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a shorter period than one year, in accordance with Section 17, Chapter 44, General Laws and Amendments thereto.


Voice vote. Motion unanimously carried.


Article XVI. "To see if the Town will authorize the Collector to use all means of collecting taxes which a Town Treasurer, when appointed Collector, may use agreeable to Chapter 41, Section 37, General Laws and Amendments thereto."


Moved by Mr. John H. Perkins and seconded : That the Town hereby authorize the Town Collector to use all means of collecting taxes which a Town Treasurer, when appointed Collector may use agreeable to Chapter 41, Section 37, General Laws and Amendments thereto.


Voice vote. Motion unanimously carried.


Article XVII. "To act on any other matter that may legally come before said meeting."


Moved by Mr. John H. Perkins and seconded : That the meeting be adjourned until 5:45 o'clock A. M. on Tuesday, March 14, 1944.
