HELD MARCH 4, 1946 AND OF THE ANNUAL TOWN ELECTION HELD MARCH 12, 1946

The Moderator, Mr. Oliver Wolcott, opened the meeting at seven- thirty o'clock in the evening (7:30 p. m.) Monday March 4, 1946.
Rev. Edward J. McGlaughlin lead the meeting in prayer.
Moderator: "The first business of the evening is Article II :
Article II. "To choose and appoint all other Town Officers in such manner as the Town shall determine."
Moved by Mr. Edward A. DeWitt and duly seconded: That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor, the field drivers to be nominated and elected first and the measurers of wood, lumber and bark immediately thereafter.
Voice vote on motion. Motion unanimously carried.
Moved by Mr. DeWitt and duly seconded: That Fred Berry, Carl Anderson, William W. Bancroft and Ernest M. Barker be nominated Field Drivers.
Moved by Mr. DeWitt and duly seconded: That the nominations be closed and a white ballot be cast for each by the Moderator.
Voice vote. Motion unanimously carried. The Moderator declared he cast a white ballot for each.
Moved by Mr. DeWitt and duly seconded: That Timothy A. Moyni- han, Jesse S. Mann, Ernest M. Barker and Wendell W. Dodge be nomin- ated as Measurers of Wood, Lumber and Bark.
Moved by Mr. DeWitt and duly seconded: That the nominations be closed and a white ballot be cast for each by the Moderator.
Voice vote. Motion unanimously carried. The Moderator declared he cast a white ballot for each.

Article III. "To hear the report of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action thereon."
Moved by Mr. Theodore A. Holland and duly seconded: That the reports of the Town Officers and of the Finance and Advisory Committee as printed in the Annual Town Report for 1945 and all other committees be received and placed on file.
Voice vote. Motion unanimously carried.
Article IV. "To raise and appropriate money for Schools, Highways and all other town expenses and determine the manner of expending same."
Moderator: "As in past years I will read the appropriations recom- mended by the Finance Committee and if debate is wished on any item call "Pass" and that item will be considered after the others are voted as a whole."

Nightingale and duly seconded: That the various appropriations considered seriatim as amended be approved and adopted as a whole and that the temporary 15 percent increases in the basic salaries and wages of town officials and town employees fixed by the town, recommended by the Finance Committee in 1945, be continued from March 5, 1946 to March 4, 1947.

Article V. "To see if the Town will vote to transfer to School Vo- cational the sum of $500.00 from the unexpended balance in the appro- priation of $500,00 for the purchase from Emily P. Mandell of Hamilton of a certain parcel of land situated on the westerly side of Bridge Street in said Hamilton raised and appropriated under Article 9 for the annual town meeting held March 6, 1944, or take any action thereon."
Moved by Mr. John Hollister and duly seconded: That the Town vote to transfer to School Vocational the sum of $500.00 from the unex- pended balance in the appropriation of $500.00 for the purchase from Emily P. Mandell of Hamilton of a certain parcel of land situated on the westerly side of Bridge Street in said Hamilton raised and appropriated under Article 9 for the annual town meeting held March 6, 1944.
Voice vote. Motion unanimously carried.

Article VI. "To see if the Town will vote to transfer the sum of $2,000.00 from the Excess and Deficiency Fund to Town Hall Repairs, or take any other action thereon."
Moved by Mr. Theodore A. Holland and duly seconded: That the Town vote that the sum of $2,000.00 be transferred from the Excess and Deficiency Fund to Town Hall Repairs.
Voice vote. Motion unanimously carried.
Article VII. "To see if the Town will vote to raise and appropriate a sum of money for the maintenance of various streets, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose ; or take any other action in relation thereto.
Moved by Mr. John H. Perkins and duly seconded: That the Town vote to raise and appropriate the sum of $800.00 for the maintenance of various streets. said money to be used in conjunction with any money which may be allotted by the State or County, or both for this purpose.
Voice vote. Motion unanimously carried.
Article VIII. "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Fund a sum of money for the improvement of Asbury Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, or take any action in relation thereto.
Moved by Mr. Lawrence R. Stone and duly seconded : That the Town vote to raise and appropriate the sum of $4,000.00 for the improvement of Asbury Street, to be expended by the Town for its share of said work, provided the State or County, or both, cooperates with the Town and con- tributes to the cost thereof, as provided for by Chapter 90 of the General Laws and Amendments thereto, and that available funds may be used while carrying on the work until the town is so reimbursed.
Voice vote. Motion unanimously carried.
Article IX. "To see if the Town will vote to transfer the sum of $10,000.00 from the Excess and Deficiency Fund to Maturing Debt, or take any action thereon."
Moved by Mr. John T. Nightingale and duly seconded: That the Town vote to transfer the sum of $10,000.00 from the Excess and Defi- ciency Fund to Maturing Debt.
Voice vote. Motion unanimously carried.
Article X. "To see if the Town will vote to purchase and acquire a 750 gal. triple combination pumping engine from the Seagrave Corpora- tion of Columbus, Ohio, raise and appropriate or transfer from the Ex- cess and Deficiency Fund, a sum of money therefor or take any action thereon."

Moved by Mr. Theodore A. Holland and duly seconded: That the Town vote to purchase and acquire on behalf of the Town a 750 gallon triple combination pumping engine recommended and approved by the board of engineers from the Seagrave Corporation of Columbus. Ohio, for the sum of $10,000.00 such sum to be met and provided for by a transfer from the Excess and Deficiency Fund, and that the selectmen and board of engineers be authorized and empowered, with full power to consummate such purchase.
Voice vote. Motion unanimously carried.
Article XI. "To see if the Town will vote, subject to the approval of the Commissioner of Corporations and Taxation, to transfer the sum of $2,000.00 from the Excess and Deficiency Fund to the Reserve Fund, or take any action thereon."
Moved by Mr. John Hollister and duly seconded: That the Town vote to transfer the sum of $ ?. 000.00 from the Excess and Deficiency Fund to the Reserve Fund.
Voice vote. Motion unanimously carried.
Article XII. "To see if the Town will vote to raise and appropriate the sum of $346.11 for the payment of unpaid bills of the water depart- ment incurred for the year 1945, due to insufficiency of appropriation in 1945, as provided for by Section 64. Chapter 44 of the General Laws and amendments thereto or take any action thereon."
Moved by Mr. George A. Harrigan and duly seconded : That the Town vote to raise and appropriate the sum of $346.11 for the payment of unpaid bills of the water department incurred for the year 1945, due to insufficiency of appropriation in 1945. as provided for by Section 64, Chapter 44 of the General Laws and amendments thereto.
Voice vote. Motion unanimously carried.
Article XIII. "To see if the Town will vote to construct a perman- ent sidewalk on both sides of Walnut Road, from Main Street to the Ham- ilton and Wenham boundary line, and raise and appropriate a sum of money therefor, or take any action thereon, as petitioned for by ten or more registered voters."
Moved by Mr. Everett F. Haley and duly seconded: That the Town raise and appropriate the sum of $2,000.00 to be expended for the purpose of building a sidewalk on the southerly side of Walnut Road and relocat- ing or altering and surveying the same, that the selectmen be requested to petition the County Commissioners to relocate or alter said Walnut Road, and after such relocation or alteration has been made by the County Com- missioners that the work shall be done under the supervision and direc- tion of the surveyor of highways.
Voice vote. Motion unanimously carried.

Article XIV. "To see if the Town will vote to appoint a committee to provide and arrange for a suitable welcoming home-coming reception to the returning veterans of World War II, raise and appropriate a sum of money therefor, or take any action thereon."
Moved by Mr. John H. Perkins and duly seconded : That the Town vote to raise and appropriate the sum of $2,000.00 to provide for a suit- able welcome home reception to the returning veterans of World War II, and that the Moderator appoint a committee consisting of fifteen members, including the selectmen, with full power to make all plans and arrange- ments therefor.
Voice vote. Motion unanimously carried.
Article XV. "To see if the Town will vote to name the playground and recreation centre at the junction of Main street and Asbury street in honor of the late Gen. Patton as the General George S. Patton, Jr. Memorial Park, appropriate a sum of money therefor or take any action thereon. as petitioned for by the board of park commissioners."
Moved by Mr. Ralston F. Pickering and duly seconded: That the Town vote to name the playground and recreation centre at the junction of Main Street and Asbury Street in honor of the late Gen. Patton as the General George S. Patton, Jr. Memorial Park, that a committee of six, including the board of park commissioners. be appointed by the moderator to consider plans for a suitable memorial. to report at the next special or annual town meeting, and that the sum of $100.00 be appropriated.
Voice vote. Motion unanimously carried.
Article XVI. "To see if the Town will vote to approve and accept as a gift to the Town one or more tennis courts. to be located and installed under the direction of the park commissioners on the town Playground and Recreation Centre at the junction of Main and Asbury Streets, or take any action thereon, as requested by the board of park commissioners."
Moved by Mr. Stanley Allen and duly seconded: That the Town accept the gift of one or more tennis courts to be located and installed on the town playground and recreation centre at the junction of Main and Asbury Streets. the work to be under the direction of the Park commis- sioners with the cooperation of the donor.
Voice vote. Motion unanimously carried.
Article XVII. "To see if the Town will vote to place the position of town accountant under the civil service laws, rules and regulations, and that the tenure of office of the present incumbent thereof shall be unlimited. subject to said laws; and authorize its representative to file a petition in the General Court to effect the same, or take action thereon, as petitioned for by ten or more registered voters."
Moved by Mr. Theodore A. Holland and duly seconded: That the Town vote that the position of town accountant be placed under the classi- fied civil service laws, rules and regulations of the State, that the tenure

of office of the incumbent thereof be unlimited, subject to such laws, and further that the Town request and authorize its representative in the General Court to file a petition to effect the same.
Voice vote. Motion carried.
Article XVIII. "To see if the town will vote at the annual election in 1947 to elect one member of the School Committee for one year. one member for two years and one member for three years. each such member to be elected thereafter for three years or take any action thereon."
Moved by Mr. Robert B. Walsh and duly seconded : That the Town vote at the annual election in 1947 to elect one member of the school committee for one year, one member for two years and one member for three years, each such member to be elected thereafter for three years.
Voice vote. Motion unanimously carried.
Article XIX. "To see if the Town will vote to have determined and established the boundary line of the Town of Hamilton between the Hamil- ton Town Cemetery and lands of Miss Mary Curtis in Hamilton, Mass., situated 621 Main Street, as shown substantially on a plan now on file in the office of the Selectmen, entitled "Plan Showing Boundary Line Be- tween Lands of Miss Mary Curtis and Town of Hamilton in Hamilton, Mass .. Scale 1 inch-20 feet. Oct. 1945, Thomas A. Appleton, C. E." or take any action thereon."
Moved by Mr. Robert B. Walsh and duly seconded : That the boundary line between the Hamilton Town Cemetery on Main Street and the ad- joining lands of Miss Mary Curtis of said Hamilton, namely 621 Main Street, in said Hamilton, be and hereby is determined and established after due survey as being the boundary line shown on a plan entitled "Plan Showing Boundary Line Between Lands of Miss Mary Curtis and the Town of Hamilton in Hamilton. Mass .. Scale 1 in .- 20 Ft. Oct. 1945, Thomas A. Appleton, C. E.", now on file in the office of the selectmen, and that the selectmen with full powers, be and hereby are authorized, empowered and directed, on behalf of the town, to record or have recorded such plan with Essex Registry of Deeds So. Dist. and to perform all such acts and record all such instruments as may be necessary.

Article XX. "To see if the Town will vote to locate. relocate, de- termine and establish the right of way twenty (20) feet wide within a strip of land sixty (60) feet in width as appurtenant to remaining land of the grantor, reserved in a certain deed from the Trustees of the Myopia Schooling Field Trust to the Town of Hamilton, dated December 4, 1941, and recorded with Essex Registry of Deeds (So. Dist.) Book 3281, Page 53, Plan Book 74, Plan 84, said right of way extending from the grantor's remaining land lying northeasterly of the grantee's premises to Asbury Street, the northwesterly boundary of said sixty (60) foot strip being the northeasterly boundary of the Boston and Maine Railroad location, as

substantially shown on a plan entitled "Plan of Relocation of Right of Way Over Hamilton Playground and Recreation Centre, Scale 1 inch-50 ft. dated January 26, 1946. E. H. Smith, Surveyor," on file in the office of the Selectmen or take any action thereon, as petitioned for by the board of park commissioners."

Pickering and duly seconded: That the right of way twenty (20) feet wide within a strip of land sixty (60) feet in width as appurtenant to remaining land of the grantor, reserved in a certain deed from the Trustees of the Myopia Schooling Field Trust to the Town of Hamilton, dated December 4, 1941, and recorded with Essex Registry of Deeds (So. Dist.) Book 3281, Page 53, Plan Book 74, Plan 84, said right of way extending from the said grantor's remaining land lying northeasterly of the grantee's premises to Asbury street, the north- westerly boundary of said sixty (60) foot strip being the northeasterly boundary of the Boston and Maine Railroad location, as substantially shown on a plan entitled "Plan of Relocation of Right of Way over Hamil- ton Playground and Recreation Centre, Scale 1 inch-50 ft. dated Jan- uary 26, 1946. Dist. and a blue print of the same be furnished said Myopia Schooling Trust.

Article XXI. "To see if the Town will vote to accept the provisions of Chapter 723 of the Acts of 1945, being an act "To Authorize the Estab- lishment and Maintenance of Municipal Departments and of Districts for Furnishing Information, Advice and Assistance to veterans of World War II or Other Veterans," raise and appropriate a sum of money therefor, or take any other action thereon."
Moved by Mr. Edward A. DeWitt and duly seconded : That the article be indefinitely postponed.
Voice vote. Motion unanimously carried.
Article XXII. "To see if the Town will vote to adopt the following by-law as petitioned for by Robert B. Walsh :
The selectmen are authorized and empowered to sell, and execute and deliver a deed or deeds therefor, from time to time as occasion there- for may arise, lands of low value, after first giving notice of sale in some convenient place in the town fourteen (14) days at least before the sale, property taken by the Town under tax title procedure as provided for under Chapter 60 of the General Laws and amendments thereto. The selectmen or whom they may authorize to hold such public auction may reject any and all such bids which they deem inadequate."
Moved by Mr. Robert B. Walsh and duly seconded: That the Town adopt the following by-law : ,

Walsh and duly seconded: That the Town hereby authorize the Selectmen to sell, and execute and deliver a deed or deeds therefor, land of low value, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the town fourteen days at least before the sale, property taken by the Town under tax title procedure as provided for under Chapter 60 of the General Laws and amendments thereto, provided that the Select- men or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate.
