The Moderator, Mr. Oliver Wolcott, opened the meeting at seven- thirty o'clock in the evening (7 :30 p. m.) on Monday, March 1, 1948.
Rev. Angus Dun, Jr. lead the meeting in prayer.
Mr. John H. Perkins: "Mr. Moderator, before the meeting gets under way, I should like to call to the voters' attention the absence of one of our most capable town officials. I refer to our eminent Town Counsel who for over thirty years has been the guiding influence on matters pertaining to law, and his mature judgment on all other matters has not only greatly aided but materially lightened the responsibilities of all Town Officials. Mr. Walsh is convalescing from a long illness and I recommend that we extend to him our best wishes for a speedy recovery.
Moderator: "The first business of the evening is Article 2:
Article 2. "To choose and appoint all other Town Officers in such manner as the Town may determine."

Moved by Mr. Edward A. DeWitt and duly seconded: "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately thereafter, and that Fred Berry, Carl C. Anderson, William W. Bancroft and Ernest M. Barker be elected field drivers for the ensuing year."
Voice Vote. Motion unanimously carried.
Moved by Mr. Edward A. DeWitt and duly seconded: "That Jesse S. Mann, Ernest M. Barker, Timothy A. Moynihan and Charles S. Poole be elected as measurers of wood, lumber and bark for the ensuing year."
Voice Vote. Motion unanimously carried.
Article 3. Moderator : "To hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action thereon."
Moved by Mr. Lawrence R. Stone and duly seconded : "That the re- ports of the Town Officers, Finance and Advisory Committee and all de- partmental reports, as printed in the Annual Town Report be received and placed on file."
Voice Vote. Motion unanimously carried.
Article 4. Moderator : "To raise and appropriate money for Schools, Highways, Essex County Retirement Board and all other Town expenses and determine the manner of expending the same."
Moved by Mr. Theodore A. Holland and duly seconded : "That we proceed to vote to raise and appropriate money for Schools, Highways, Es- sex County Retirement Board and all other town expenses and determine the manner of expending the same, the various items to be considered seriatim."
Voice Vote. Motion unanimously carried.
Moderator : "As in past years I shall read the appropriations recom- mended by the Finance Committee and if debate is wished on any item, call 'Pass' and that item will be considered after the others are voted as a whole."

Moved by Mr. Theodore A. Holland and duly seconded : "That the various appropriations considered seriatim as amended be approved and that the meeting now proceed to the consideration of the items that were passed."

Moderator : "We shall now go back to the item, Additional Teacher, under Lamson School Specials, as passed.
Mr. Harold A. Daley: "I would like to ask why that item is sep- arated from School Salaries."
Mr. Theodore A. Holland : "The reason for that item being separated in that manner is primarily because there is a possibility that the school department will need an additional teacher in the elementary school this coming year. Mr. Towne . in his annual report expressed opinion that Hamilton is faced with the problem of a larger enrollment in the ele- mentary school which will undoubtedly result in the procuring of an addi- tional first grade teacher. The Finance Committee feels that rather than include that amount as a lump sum in an entire figure, it is to be ex- pended only for the particular purpose for which it is intended, and we have therefore made it a special."
Voice Vote. Motion unanimously carried.
Mr. Harold A. Daley : "What is Hatfield Road appropriation ?"
Mr. Theodore A. Holland : "The Water Department would be better qualified to make an explanation. We haven't been able to obtain what the Water Department has in mind on either two streets."

Mr. George A. Harrigan: "Chestnut Street and Hatfield Road are not accepted streets. There are ten applications in for new homes on Chestnut Street, and at the present time one house is being built on Hat- fild Road."
Voice Vote. Motion unanimously carried.
Article 5. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account the sum of $1,500.00 for chapter 90 Highway Construction on Essex Street or take any action thereon."
Moved by Mr. Everett F. Haley and duly seconded : "That the Town vote to raise and appropriate the sum of $1,500.00 for Chapter 90 High- way construction on Essex Street.
Voice vote. Motion unanimously carried.
Article 6: Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account the sum of $1,000.00 for chapter 90 Maintenance or take any action thereon."
Moved by Mr. Edward A. DeWitt and duly seconded : "That the. Town vote to raise and appropriate the sum of $1,000.00 for chapter 90 Highway Maintenance of various streets."
Voice Vote. Motion unanimously carried.
Article 7. Moderator : "To see if the Town will vote to transfer the- sum of $1,800.00 from the Cemetery Sale of Lots and Graves Fund to a Special Cemetery Account to be expended by the Cemetery Commis- sioners for improvements of the cemetery or take any action thereon."
Moved by Mr. Raymond A. Whipple and duly seconded : "That the Town vote to transfer the sum of $1,800.00 from the Cemetery Sale of Lots and Graves Fund to a special Cemetery Account to be expended by the Cemetery Commissioners for improvements to the town cemetery."
Voice vote. Motion unanimously carried.
Article 8. Moderator: "To see if the Town will vote to raise and' appropriate or transfer from the Excess and Deficiency Account the sum of $10,000.00 for the purpose of making alterations in the Jonathan Lam- son School building on Railroad Avenue, consisting of an emergency exit in the cafeteria to the yard, certain rewiring work, fireproofing, installa- tion of a sprinkler system at strategic points and/or other necessary alterations, or take any other action thereon, as petitioned for by Richard Preston and others."
Moved by Mr. Allan MacCurrach and duly seconded: "That the Town vote to transfer the sum of $5,000.00 from the Excess and De- ficiency Account for the purpose of making alterations in the Jonathan Lamson School building on Railroad Avenue, consisting of an emergency exit in the cafeteria to the yard, certain rewiring work, fireproofing, in-

stallation of a sprinkler system at strategic points and other necessary alterations, and that the work be done under the direction and supervision of the School Committee.
Mr. MacCurrach. Since the committee last met and considered the $10,000 appropriation, we estimated and modified some of the work. Therefore, I wish to amend and ask for $5,000.00.
Voice vote. Motion unanimously carried.
Article 9. Moderator : "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account the sum of $2,000 to continue the building of a hot-top sidewalk on the north- easterly side of Asbury Street, beginning at the end of the existing hot- top construction and extending toward Main Street or take any action thereon."
Moved by Mr. Lewis Pierce and duly seconded: "That the Town vote to raise and appropriate the sum of $2,000.00 for the purpose of building a hot-top sidewalk on the northeasterly side of Asbury Street, beginning at the end of the existing hot-top sidewalk and continuing to Main Street, the work to be done under the direction and supervision of the Highway Surveyor."
Voice Vote. Motion unanimously carried.
Article 10. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money to build a hot-top sidewalk on the southeasterly side of Union Street from Asbury Street to Mill Street or take any action thereon.
Moved by Mr. Benjamin A. Dodge and duly seconded: "That the Town vote to raise and appropriate the sum of $400.00 for the purpose of building a hot-top sidewalk on the southeasterly side of Union Street from Asbury Street to Mill Street, the work to be done under the direction and supervision of the Highway Surveyor."
Mr. Frederic Winthrop: "Mr. Moderator, it is the opinion of the Finance Committee that the Town should build sidewalks where they will give the greatest amount of service. There already is a sidewalk on the other side of that street, and we do not feel justified in building another when some have none at all."
Voice Vote. Motion lost.
Article 11. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account a sum of money for the purpose of building a hot-top sidewalk on the southwesterly side of Pleasant Street from Willow Street to Elliott Street or take any action thereon."
Moved by Mr. Alvin Perley and duly seconded: "That the Town vote to raise and appropriate the sum of $400.00 for the purpose of build- ing a hot-top sidewalk on the southwesterly side of Pleasant Street from

Willow Street to Elliot Street, the work to be done under the direction and supervision of the Highway Surveyor."
Mr. Theodore A. Holland: "Just for the purpose of consistency, the same rule would apply in the opinion of the Finance Committee in con- nection with this particular motion. The situation in this particular case is that some harm was done to the sidewalk because of some water installa- tion in one of the neighboring residences. I think it would be perfectly satisfactory if the Water Department made arrangement to place some cinders on that sidewalk and would be consistent with the action taken in reference to our opinion on the previous article."
Voice vote. Motion lost.
Article 12. Moderator: "To see if the Town will vote to raise and appropriate or transfer from the Excess and Deficiency Account the sum of $10,000.00 to build a Municipal Garage of cement blocks on the town property in the rear of the Town Hall for use by the Highway Depart- ment for the storage of its motor vehicles, material and its other equip- ment, or take any action thereon."
Moved by Mr. Frederic Winthrop and duly seconded: "That the Town vote to transfer the sum of $15,000.00 from the Excess and De- ficiency Account for the purpose of erecting on the Town Property in the rear of the Town Hall a town garage and shop adequate for the needs of the Highway Department, Moth Department, Tree Department and Water Department and which will conform architecturally in general appearance with the Town Hall, the work to be done under the direction and super- vision of the Selectmen, who are hereby authorized with full powers to enter into the contracts necessary for the procuring of plans and specifica- tions and the building of said garage and shop."
Voice vote. Motion unanimously carried.
Article 13. Moderator: "To see if the Town will vote to transfer from the Excess and Deficiency Account a sum of money for the state and county share of Chapter 90 Highway maintenance and construction."
Moved by Mr. Lawrence R. Stone and duly seconded : "That the sum of $5,000.00 be transferred from the Excess and Deficiency Account to meet the cost of the state and county share of Chapter 90 road construc- tion and maintenance, and that the reimbursements from the state and county on account of such work be credited to the Excess and Deficiency Acount."
Voice vote. Motion unanimously carried.
Article 14. Moderator: "To see if the Town will vote to receive the report of the General George S. Patton, Jr., Memorial Committee printed in the annual Town Report as a report of progress, to continue in office the present committee for the purposes therein set forth, or take any action thereon."

Moved by Mr. Standish Bradford and duly seconded: "That the Town vote to receive the report of the General George S. Patton, Jr., Memorial Committee printed in the Annual Town Report as a report of progress and that the present committee continue in office for the purposes therein set forth."
Voice vote. Motion unanimously carried.
Article 15. Moderator: "To see if the Town will vote to have the Assessors publish a Valuation List and Poll, Personal Property and Real Estate Taxes of the Town of Hamilton in the year 1950 and every fifth year following thereafter or take any action thereon."
Moved by Mr. Harold A. Daley and duly seconded: "That the Town vote the Board of Assessors publish, beginning with the year 1950 and con- tinuing every fifth year thereafter, a Valuation List and the Poll, Per- sonal Property and Real Estate Taxes of the Town of Hamilton, that the first List be distributed among the taxpayers of the town not later than December 31, 1950 and that the subsequent publications as provided for herein be distributed not later than December 31, of the year of publica- tion."
Voice vote. Motion unanimously carried.
Article 16. Moderator: "To see if the Town will vote to rescind section 6 of chapter II of the Town By-laws, providing that "fifty legal voters shall constitute a quorum at all town meetings" and substitute the following : "Section 6. One hundred legal voters shall constitute a quorum at all town meetings."
Moved by Mr. Everett F. Haley and duly seconded : "That the Town vote to rescind section 6 of chapter II of the Town By-laws providing "that fifty legal voters shall constitute a quorum at all town meetings" and sub- stitute the following therefor: "Section 6. One hundred legal voters shall constitute a quorum at all town meetings."
Mr. John E. Hartnett, Jr .: "It seems to me that the basic idea of this motion is good, but I am not satisfied that it goes far enough. I sug- gest and I will make a motion that Mr. Haley's motion be amended and that the number be 200 rather than 100 and I urge that that be seriously considered.
Voice vote. Motion unanimously carried.
Article 17. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I. of chapter 41 of the General Laws as enacted under chapter 40 of the Acts and Re- solves of 1947, to accept the proposed layout as a public way by the select- men of Lake Road, so-called, situated in East Hamilton, all substantially as shown on a plan entitled "Plan of Lake Road, Hamilton, Mass., dated November, 1947. Charles H. Morse, Eng., Haverhill, Mass." now on file in the office of the Town Clerk of Hamilton, or take any action thereon."

DeWitt and duly seconded : "That the Town accept the proposed layout as a public way by the Selectmen of Lake Road, so-called, and approved in writing by the Planning Board, all substantially as shown on a plan entitled "Plan of Lake Road, Hamilton, Mass., dated November, 1947. Charles H. Morse, Eng., Haverhill, Mass.," now on file in the office of the Town Clerk of Hamilton, and that said Lake Road be designated Forest Street."
Voice vote. Motion unanmiously carried.
Article 18. Moderator : "To see if the Town will vote, subject to com- pliance by the selectmen with the provisions of section 81 I. of chapter 41 of the General Laws as enacted under chapter 340 of the Acts and Resolves of 1947, to accept the proposed layout as a public way by the selectmen of Margaret Road, so-called, as shown on a plan entitled "Plan of Margaret Road, Hamilton, Mass., for acceptance, Scales as Noted, dated December, 1947" now on file in the office of the Town Clerk of Hamilton, or take any action thereon."
Moved by Mr. George A. Harrigan and duly seconded : "That the Town accept the proposed layout as a public way of Margaret Road, so- called, by the selectmen, and approved in writing by the Planning Board, all as substantially shown on a plan, entitled "Plan of Margaret Road, Hamilton, for acceptance, Scales as Noted, Dated December, 1947" now on file in the office of the Town Clerk of Hamilton."

Article 19. Moderator: "To see if the Town will vote, subject to compliance by the selectmen with the provisions of section 81 I. of chapter 41 of the General Laws as enacted under chapter 340 of the Acts and Resolves of 1947. to accept the proposed layout by the selectmen of Adams Road, so-called, from Baker Avenue to Central Avenue as shown on a plan entitled "Plan of Adams and Gifford Road, Hamilton, Mass., for accept- ance, dated November, 1941, Morse, Dickinson and Goodwin Eng'rs., Haverhill, Mass.," now on file in the office of the Town Clerk of Hamilton, or take any action thereon."

Stone and duly seconded: "That the Town accept the proposed layout as a public way of Adams Road, so-called, from Baker Avenue to Central Avenue by the Selectmen and approved in writing by the Planning Board, all as substantially shown on a plan en- titled "Plan of Adams and Gifford Roads, Hamilton, Mass., for acceptance dated November, 1941, Morse, Dickinson and Goodwin, Engineers, Haver- hill, Mass.," now on file in the office of the Town Clerk of Hamilton.

Article 20. Moderator: "To see if the Town will vote to adopt a by- law relative to the parking of vehicles, that no person shall park a vehicle longer than one hour at any time between the hours of 9 A. M. and 6 P. M. of any day except Sunday and holidays on Railroad Avenue between Main Street and Willow Street and on Main Street between the Wenham line

and Walnut Road, to provide for the erection of warning signs or signals at dangerous points in the town, to define the powers of the police, to fix the penalties to be imposed for violations of the provisions of the by-law and to make rules and regulations relative to the use of motor vehicles and their traffic upon the streets and highways of the Town of Hamilton or take any action thereon."
Moved by Mr. Everett F. Haley and duly seconded: "That the fol- lowing by-law relative to parking of vehicles on Railroad Avenue and Main street between the Wenham line and Walnut street and regulating the use of motor vehicles and their traffic upon the streets and highways of the Town of Hamilton be adopted by the Town and that the sections be con- sidered seriatim."
