REPORT OF THE TOWN CLERK


To the Citizens of Hamilton:


I submit herewith my fourteenth annual report as Clerk of the Town of Hamilton.


During the year 1957 the elections and town meetings consisted of the Annual Meeting and Election held March 4th and 12th respectively ; a Special Town Meeting held April 16th and another Special Town Meeting held September 10th, all of which were held in the high school auditorium. A detailed report of each is printed in the town report as part of the Town Clerk's report.


A list of births, marriages and deaths recorded during the year is also included as a part of the Clerk's report.


I express my sincere appreciation to all the townspeople and town officials who have assisted me in my duties during the year.

The Moderator, Mr. John H. Perkins, opened the meeting at seven forty-seven (7:47) in the evening on Monday, March 4, 1957.


Rev. Norman B. Cawley offered invocation.


Moderator: "The first business of the evening is Article 2: "To choose and appoint all other Town Officers in such manner as the Town may determine."


Moved by Mr. Lawrence Lamson and duly seconded : "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately following."


Voice vote. Motion unanimously carried.

Moved by Mr. Lawrence Lamson and duly seconded : "That Harold M. Dodge, Carl C. Anderson, William W. Bancroft and Ernest M. Barker be elected field drivers for the ensuing year."

Moved by Mr. Lawrence Lamson and duly seconded : "That Theo- dore E. Johnson, Frank W. Buzzell, Ernest M. Barker and Leon S. Perkins be elected measurers of wood, lumber and bark for the ensuing year."

Article 3. Moderator : "To Hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any other action thereon or relative thereto."


Moved by Mr. Lawrence R. Stone and duly seconded : "That the reports of the Town Officers and of the Finance and Advisory Committee and all other Committees, excepting the report of the School Building Needs Study Committee to be acted upon under Article 18, as printed in the town report for 1956 be received and placed on file."


Voice vote. Motion unanimously carried.


Article 4. Moderator: "To raise and appropriate money for Schools, Highways, and all other Town expenses and determine the manner of expending the same.

Moved by Mr. Clark S. Sears and duly seconded : "That the various recommendations of the Finance and Advisory Committee be approved and the sums recommended be appropriated and that the meeting now proceed to the consideration of the item that was passed."

Mr. John F. Neary: "The Trustees of the Library are unanimous that no action be taken tonight on the proposed new library. Our reason is not that we are any less interested but that we do not have a business- like proposition to offer the town because of the shortness of the time. We have a blueprint which is pretty sketchy and we just haven't had

time to present this to you properly. A library is something that will be with us for a long time and I would like to move that our budget expenses be increased by $1,000.00 for which we propose to bring in plans on or before the next Town Meeting."


Voice Vote. Motion carried.


Article 5. Moderator : "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Maintenance of various streets in the town, or take any other action thereon or relative thereto."


Moved by Mr. Everett F. Haley and duly seconded: "That the Town raise and appropriate the sum of $1,000 for Chapter 90 Highway Maintenance of various streets, to be expended for its share of the work, and that available funds may be used while carrying on the work until the Town is reimbursed for the State share of the work."


Voice vote. Motion unanimously carried.


Article 6. Moderator : "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Construction in the Town, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence Lamson and duly seconded : "That the Town raise and appropriate the sum of $3,500 for Chapter 90 Highway Construction on School Street, to be expended for its share of the work, and that available funds may be used while carrying on the work until the Town is reimbursed for the State and County share of the work.


I might add that this is a $14,000 project; the Town to pay $3,500, the State $7,000 and the County $3,500."


Voice vote. Motion unanimously carried.


Article 7. Moderator: "To see if the Town will provide for the permanent construction of Willow Street subject to the approval of the State Department of Public Works and the receipt by the Town of State funds for such purpose, and to raise and appropriate a sum of money therefor, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence R. Stone and duly seconded : "That the Town appropriate the sum of $20,066.11 for the re-building of Willow Street, and to meet such appropriation the sum of $4,000 be raised by taxation, and the sum of $16,066.11 to be received by the Town under the provisions of Chapter 718 of the Acts of 1956 be transferred and appropriated for such purpose, the work to be done under the direction and supervision of the Board of Selectmen."


Voice vote. Motion unanimously carried.


Article 8. Moderator: "To see if the Town will vote to purchase a new Cruiser-Ambulance for use of the Police Department, provide for

the turning in of the present cruiser toward the purchase price thereof, and raise and appropriate a sum of money therefor, or take any other action thereon or relative thereto."


Moved by Mr. Everett F. Haley and duly seconded: "That the Town purchase a new Cruiser-Ambulance for use by the Police Depart- ment, and that the present vehicle be turned in toward the purchase price thereof and that the Town raise and appropriate the sum of $2,000 for the balance of the purchase price, and that the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to con- consummate such purchase."


Voice vote. Motion unanimously carried.


Article 9. Moderator : "To see if the Town will vote to purchase a new truck for use of the Water Department, provide for the turning in of the present 1942 Dodge Truck toward the purchase price thereof, and raise and appropriate a sum of money therefor, or take any other action thereon or relative thereto."


Moved by Mr. Richard H. Smith and duly seconded: "That the Town purchase a new truck for use by the Water Department, and that the present Dodge truck be turned in toward the purchase price thereof and that the Town raise and appropriate the sum of $2700 for the balance of the purchase price, and that the Board of Water Commissioners be and hereby is authorized and empowered on behalf of the Town to consummate such purchase."


Voice vote. Motion unanimously carried.


Article 10. Moderator : "To see if the Town will vote to raise and appropriate a sum of money for the purchase of a truck equipped with a so-called automatic sand spreader, snow plow and other snow fighting equipment for use of the Highway Department, or take any other action thereon or relative thereto."


Moved by Mr. Charles F. Poole and duly seconded: "That the Town purchase and acquire a truck equipped with a so-called automatic sand spreader body, snow plow and other equipment for use by the Highway Department, that the sum of $6500 be raised and appropriated therefor, and that the Highway Surveyor be and hereby is authorized and empowered on behalf of the Town to consummate such purchase."


Voice vote. Motion unanimously carried.


Article 11. Moderator : "To see if the Town will vote to lease from F. Harlan Clock and Nellie L. Clock the area of about one and three-quar- ters acres with right of way thereto from Sagamore Street for a town dump for a period of ten years, being the same area which is now used as a town dump, at a rental of $300 a year and the installation by the Town at an estimated cost of $2,000 of a six-inch water main on the leased land for the sole use of the Town for the duration of the lease and thereafter to the land; to raise and appropriate the sum of $2,000 for the foregoing purposes, or take any other action thereon or relative thereto."

Moved by Mr. Everett F. Haley and duly seconded : "That the Town lease from F. Harlan Clock and Nellie L. Clock the area of about one and three-quarters acres with right of way thereto from Sagamore Street for a town dump, at a rental of $300 a year and the installation by the Town of a six-inch water main on the leased land for the sole use of the Town for the duration of the lease and thereafter to go with the land, and that the sum of $2,000 be raised and appropriated for the installation of said water main."


Voice vote. Motion carried.


Article 12. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for mosquito spraying in the Town, the work to be done under the direction of the Board of Selectmen, or take any other action thereon or relative thereto."


Moved by Mr. Everett F. Haley and duly seconded : "That the Town raise and appropriate the sum of $2500 for mosquito spraying in the Town, the work to be done under the direction and supervision of the Board of Selectmen."


Voice vote. Motion carried.


Article 13. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for the purpose of cleaning rivers and streams, the work to be done by the Massachusetts Department of Public Works under Chapter 91, to assume liability in the manner provided by said Chapter 91 for all damages that may be incurred by said work; and to authorize the Selectmen to execute bonds of indemnity therefor, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence Lamson and duly seconded : "That the Town raise and appropriate $1,000 for the purpose of cleaning rivers and streams, the work to be done by the Massachusetts Department of Public Works under Chapter 91, General Laws, the Town to assume liability in the manner provided by said Chapter 91 for all damages that may be incurred by said work, and to authorize the Selectmen to execute bonds of indemnity therefor.


Voice Vote. Motion carried.


Article 14. Moderator: "To see if the Town will vote to authorize and approve the Board of Assessors to use available funds or "free cash" in an amount not to exceed the sum of $20,000 in determining the tax rate for the year 1957, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence E. Pelkey and duly seconded : "That the Town authorize and approve the Board of Assessors to use available funds or "free cash" in an amount not to exceed the sum of $20,000 in determining the tax rate for the year 1957."


Voice Vote. Motion unanimously carried.

Article 15. Moderator: "To see if the Town will vote to transfer the sum of $2,000 from the Cemetery Sale of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery, or take any other action thereon or relative thereto."


Moved by Mr. John T. Walke and duly seconded : "That the Town transfer the sum of $2,000 from the Cemetery Sale of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery."


Voice Vote. Motion unanimously carried.


Article 16. Moderator : "To see if the Town will vote to transfer the sum of $8,000 from the Overlay Reserve Account to the Finance Committee Reserve Fund, or take any other action thereon or relative thereto."


Moved by Mr. Charles E. Grant and duly seconded : "That the Town transfer the sum of $8,000 from the Overlay Reserve Account to the Finance Committee Reserve Fund."


Voice Vote. Motion unanimously carried.


Article 17. Moderator: "To see if the Town will authorize the Board of Selectmen to acquire by purchase or eminent domain under Chapter 79, General Laws of Massachusetts, or otherwise, the fee in all or a part of the parcel of land on Bay Road of approximately 60,000 square feet, identified as parcel B on a plan entitled "Portion of Ander- son Property" prepared by Northrup B. Allen, C.E., and dated Feb- ruary 15, 1957, on file with the Town Clerk, and adjacent land, and to construct and originally equip and furnish a building or buildings for one or more of the following purposes : police headquarters, fire station, and/or library on said land ; to raise and appropriate a sum of money for the foregoing purposes and to determine the manner in which the ap- propriation is to be raised, whether by borrowing, by taxation, by trans- fer of available funds or otherwise, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence Lamson and duly seconded: "That the Board of Selectmen are hereby authorized to acquire by purchase or by eminent domain under Chapter 79, General Laws of Massachusetts, or otherwise, the fee in all or a part of a parcel of land on Bay Road, identified as Parcel B on a Plan entitled "Portion of Anderson Prop- erty", prepared by Northrup B. Allen, C.E., dated February 15, 1957, on file with the Town Clerk, and adjacent land on Bay Road of not more than 40,000 square feet, for police and fire purposes, and that the sum of $4,000 is hereby appropriated for such purposes, but, if and to the extent that all said sum of $4,000 is not needed to acquire land for said purposes, the balance shall be added to the following appropriation : that the sum of $76,000 is hereby appropriated, which together with any unexpended portion of said $4,000 under the supervision of the select- men shall be applied to construct, originally equip and furnish a com- bined police headquarters and fire station building, to be located on the

aforesaid land; and to meet said appropriations, the sum of $4,000 be transferred from available funds, and the Town Treasurer with the ap- proval of the Board of Selectmen be and he hereby is authorized to borrow under the provisions of Chapter 44 of the General Laws of Mas- sachusetts the sum of $76,000, and to issue bonds or notes to be paid in not more than twenty years, such bonds or notes to be issued in ac- cordance with the applicable provisions of the aforesaid Chapter 44, and that the Board of Selectmen be authorized to take all such action as may be necessary or advisable to provide for the proper issue and sale of said bonds.


This article requiring a two-thirds vote, the Moderator called for a standing vote and appointed the following tellers : Left side, Cornelius Murray and Arthur Bennett; right side, Robert Chittick and Bernard Cullen. The count of votes was reported to the Moderator by the tellers, and he announced the vote to be :

The Moderator then declared the motion carried.


Article 18. Moderator: "To see if the Town will vote to receive and accept the Fifth Report of the School Building Needs Committee for the period from July 1956 to the present time as an interim report and to continue the Committee for the purpose of making further study and investigation concerning school housing needs; such Committee to render its report at a Town Meeting at or before the next Annual Town Meeting, or take any other action thereon or relative thereto."


Moved by Mr. Lawrence R. Stone and duly seconded : "That the Town receive and accept the Fifth Report of the School Building Needs Committee for the period from July 1956 to the present time as an interim report and to continue the Committee for the purpose of making further study and investigation concerning school housing needs; such Committee to render its report at a Town Meeting on or before the next Annual Town Meeting."


Voice Vote. Motion unanimously carried.


Article 19. Moderator: "To see if the Town will authorize the School Building Committee to employ architects to prepare final plans for the construction of an elementary school, consisting of twelve class rooms, physical education room, cafeteria-auditorium, offices and in- cidental rooms, playing fields, landscaping, access and paved areas, to raise and appropriate a sum of money for the foregoing purposes, and to determine the manner in which the appropriation is to be raised, whether by taxation, transfer of available funds or otherwise, or to take any other action thereon or relative thereto."
