REPORT OF THE TOWN CLERK
To the Citizens of Hamilton:
I submit herewith my sixteenth annual report as Clerk of the Town of Hamilton.
During the year 1959 the elections and town meetings consisted of the Annual Town Meeting and Election held March 2nd and 10th respec- tively ; a Special Town Meeting held June 9th. A detailed report of each is printed in the town report as part of the Town Clerk's report.
A list of births, marriages, and deaths recorded during the year is also included as a part of the Clerk's report. In many cases the record of a birth in another community is not received in time to be included in the town report. In such cases, the birth is recorded as soon as it is received in the office and becomes a record in the town even though not printed in the town report.
I take this opportunity to express my sincere appreciation to all the townspeople and town officials who have assisted me in my duties during the year.

The Moderator, Mr. John H. Perkins, opened the meeting at eight o'clock (8:00) in the evening on Monday, March 2, 1959.
Reverend Robert P. Perry offered the invocation.
Moderator: "The first business of the evening is Article 2: "To choose and appoint all other Town Officers in such manner as the Town may determine."
Moved by Mr. Lawrence Lamson and duly seconded : "That four field drivers and four measurers of wood, lumber and bark be elected by the meeting from the floor and that the field drivers be nominated and elected first and the measurers of wood, lumber and bark immediately following."
Voice vote. Motion unanimously carried.

Moved by Mr. Lawrence Lamson and duly seconded : "That Harold M. Dodge, George Morrow, William W. Bancroft and Ernest M. Barker be elected field drivers for the ensuing year."

Moved by Mr. Lawrence Lamson and duly seconded : "That Theo- dore E. Johnson, Ernest R. MacGregor, Ernest M. Barker and Leon S. Perkins be elected measurers of wood, lumber and bark for the ensuing year."

Article 3. Moderator: "To hear the reports of the Town Officers and of the Finance and Advisory Committee and all other committees and take any action thereon or relative thereto."
Moved by Mr. Lawrence Stone and duly seconded : "That the re- ports of the Town Officers and of the Finance and Advisory Committee and all other Committees as printed in the town report for 1958 be received and placed on file, and that the Union Health Department Study Committee be discharged with thanks and appreciation of the services rendered by the members thereof."
Voice vote. Motion unanimously carried.
Article 4. Moderator : "To raise and appropriate money for Schools, Highways, and all other Town expenses and determine the manner of expending the same."

THE EMERGENCY REPORTING CENTER
FOR EMERGENCY FIRE OR POLICE DIAL: HO 8-4421 (After 3:00 A.M. May 1, 1960)
On May 1, 1960 an Emergency Fire and Police Reporting Center will go into operation concurrent with the dial conversion of the Hamilton telephone exchange. This center, located in the Hamilton Fire and Police Station, will be manned 24 hours a day and will be the dispatching station for the Fire and Police Depart- ments of both Hamilton and Wenham.
In the Emergency Center are large wall maps of the two Towns; a magnetic "call board" indicating the location and "ready" condition of all Fire and Police vehicles ; special telephone arrangements for answering calls and alerting, via direct lines, the Fire and Police Stations; the Fire Department assembly-call boxes; the base station radio transmitter and receiver of the new Fire and Police mobile radio system; and a CON- ELRAD radio alerting receiver. The room is laid out utilizing a U shaped desk with all the items within easy reach of the dispatcher for maximum operating conveni- ence. Wherever possible, color codes and symbol shapes are used to save time and prevent errors.
A citizen requiring Emergency Assistance such as Fire, Police, Ambulance, etc., will dial HO 8-4421, three lines are available under this number. He will re- port the nature of his emergency and MUST give his name, street address and-of paramount importance- his TOWN. Failure to give the TOWN name can cause great loss of time in trying to locate the site of the emergency.
It must be remembered that the Emergency Cen- ter is for the protection of all the citizens of Hamilton and Wenham. Only calls of an EMERGENCY na- ture should be made to the HO 8-4421 number. Calls such as requests for a fire location or whether school ses- sions will be held MUST NOT be made, as the dis- patcher will be distracted from his work and the Emer- gency lines will be unnecessarily tied up completely pre- venting anyone else requiring Emergency Assistance from reaching the Emergency Dispatcher. Normal Police calls should be made to the regular Police num- ber listed in the Directory.

Article 5. Moderator : "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Construction, or take any action thereon or relative thereto."
Moved by Mr. Lawrence Lamson and duly seconded: "That the Town raise and appropriate the sum of $3,000 for Chapter 90 Highway Construction to be expended for its share of the work, and that available funds may be used while carrying on the work until the Town is reim- bursed for the State and County share of the work."
Voice vote. Motion unanimously carried.
Article 6. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for Chapter 90 Highway Maintenance of various streets in town, or take any action thereon or relative thereto."
Moved by Mr. Lawrence Lamson and duly seconded : "That the Town raise and appropriate the sum of $1,000 for Chapter 90 Highway Maintenance of various streets to be expended for its share of the work, and that available funds may be used while carrying on the work until the Town is reimbursed for the State share of the work."
Voice vote. Motion unanimously carried.
Article 7. Moderator : "To see if the Town will vote to authorize the Library Trustees to construct, originally equip and furnish a new library building, and for said purposes (a) to employ an architect, and let contracts and (b) to transfer to the custody and control of the Library Trustees from the School Committee and the Board of Selectmen a parcel of land on Bay Road on which said Library shall be located, such parcel being of approximately 200 feet on Bay Road and approximately 200 feet deep, and lying between the New Fire House and the new Elementary School, as more fully shown on a plan on file with the Town Clerk; and for the foregoing purpose to raise and appropriate a sum of money, and to determine the manner in which the appropriation is to be raised, whether by borrowing, by taxation, by transfer of available funds, or otherwise, or take any other action thereon or relative thereto."
Moved by Mr. John Neary and duly seconded: "That the Library Trustees be authorized to construct, originally equip and furnish a new library building, and for said purposes a parcel of land on Bay Road of approximately 40,000 square feet lying between the Fire House and the new Elementary School being of 200 feet in frontage and 200 feet in depth as more fully shown on a plan on file with the Town Clerk be

transferred to the custody of the Library Trustees, and that for said purposes the sum of $1,000 be appropriated and the sum of $89,000 be borrowed and that the Town Treasurer, with the approval of the Select- men, be and he hereby is authorized to issue at one time or from time $89,000 principal amount of bonds or notes of the town, said bonds and notes to be payable in accordance with the applicable provisions of Chapter 44 of the General Laws of Massachusetts, and that the Board of Library Trustees be authorized to employ an architect and to proceed with the foregoing work, to enter into all necessary or proper contracts or agreements, and to do all acts or things necessary or convenient to obtain said loan and to carry out such work with full powers in the premises."
Remarks by Mr. John Neary, Mr. Thomas G. Stevenson and Mr. Everett F. Haley.
Moved by Mr. Roger Taylor that the motion be tabled. Motion lost, and action reverted to the main motion.
Moved by Lawrence Lamson and duly seconded that the motion be amended by striking out $89,000 and substituting therefor the sum of $49,000. The Moderator read the motion as amended, and explained that the vote would be on the amendment and not the main motion. By a voice vote the motion to amend was defeated.
The Moderator called for a standing vote on the main motion, with 184 in favor, and 218 opposed. Moderator declared the motion defeated.
Article 8. Moderator : "To see if the Town will vote to purchase a new Cruiser-Ambulance for use of the Police Department, provide for the turning in of the present cruiser toward the purchase price thereof, and to raise and appropriate a sum of money therefor, or take any other action thereon or relative thereto."
Moved by Mr. Lawrence Stone and duly seconded : "That the Town purchase a new Cruiser-Ambulance for use by the Police Department, and that the present vehicle be turned in toward the purchase price thereof and that the Town raise and appropriate the sum of $2,000 for the balance of the purchase price, and that the Board of Selectmen be and hereby is authorized and empowered to take all necessary action to make such purchase on behalf of the town."
Voice vote. Motion unanimously carried.
Article 9. Moderator: "To see if the Town will vote to purchase a new truck cab and chassis for use by the Health Department primarily for garbage collections, provide for the turning in of the present Chevrolet cab and chassis toward the purchase price thereof, and to raise and appropriate a sum of money therefor, or take any action thereon or rela- tive thereto."

Moved by Mr. William Mackenzie and duly seconded: "That the Town purchase a new truck cab and chassis for use by the Health Department primarily for garbage collection, and that the present cab and chassis be turned in toward the purchase price thereof and that the Town raise and appropriate the sum of $3,000 for the balance of the purchase price, and that the Board of Health be and hereby is authorized and empowered to take all necessary action to make such purchase on behalf of the Town."
Voice vote. Motion unanimously carried.
Article 10. Moderator : "To see if the Town will vote to raise and appropriate a sum of money for the purpose of acquiring and installing two-way radio communication equipment for use by the police, fire and other Town departments, or take any other action thereon or relative thereto."
Moved by Mr. Lawrence Lamson and duly seconded: "That the Town purchase and install two-way radio communication equipment for use by the police, fire or other Town Departments, and raise and appro- priate the sum of $2,000 for such purposes, and that the Board of Selectmen be and hereby is authorized and empowered to take all neces- sary action to make such purchase and installation on behalf of the Town."
Voice vote. Motion unanimously carried.
Article 11. Moderator: "To see if the Town will vote to lease for the purposes of a town dump a parcel of land now or formerly of Gordon College of Theology of approximately seven acres situated on 'Proprie- tors Road,' so-called, near the Manchester-Hamilton town line, for a period of five years at an annual rental of $50, or take any other action thereon or relative thereto."
Moved by Mr. William Mackenzie and duly seconded: "That the Town lease for the purposes of a town dump a parcel of land now or formerly of Gordon College of Theology of approximately seven acres situated in 'Proprietors Road,' so-called, near the Manchester-Hamilton town line, for a period of five years at an annual rental of $500, and that the Board of Health be and hereby is authorized and empowered on behalf of the Town to execute an agreement and lease therefor."
Voice vote. Motion unanimously carried.
Article 12. Moderator: "To see if the Town will vote to authorize the use of $2,000 appropriated under Article 11 of the warrant for the 1957 Annual Town Meeting (for the purpose of providing a water main on the town dump, and not expended for such purpose) to provide a water pipe to the new town dump near the Manchester line the lease of

which is referred to in Article 11 of this warrant, or take any other action thereon or relative thereto."
Moved by Mr. William MacKenzie and duly seconded : "That the Town authorize the Board of Health to install water pipe and hydrant for fire protection at the new town dump near the Manchester-Hamilton town line, and that the $2,000 appropriated under Article 11 of the war- rant for the 1957 annual town meeting be transferred for such purposes."
Voice vote. Motion unanimously carried.
Article 13. Moderator: "To see if the Town will vote to authorize the Board of Water Commissioners to acquire by purchase or eminent domain a parcel of land belonging to Massachusetts Audubon Society of approximately five acres as shown on a plan on file with the Town Clerk, such land if acquired by purchase to revert to said Massachusetts Audu- bon Society if not used for water purposes for a period of twenty-four consecutive months, and to acquire adequate rights of way thereto, and to raise and appropriate a sum of money therefore, or take any other action thereon or relative thereto."
Moved by Mr. Gordon Thompson and duly seconded: "That the Board of Water Commissioners is hereby authorized to acquire by pur- chase or by eminent domain under Chapter 79, General Laws of Massa- chusetts, or otherwise, the fee in all or a part of a parcel of land in the Pleasant Pond area of Hamilton consisting of approximately five acres, with rights of way thereto from Lake Drive as shown on a plan on file with the Town Clerk entitled 'Plan of Proposed Land Acquisition from the Massachusetts Audubon Society, Feb. 10, 1959, Charles H. Morse & Son, Mass. Reg. No. 1378, Haverhill, Mass.,' such land if acquired by purchase from the Massachusetts Audubon Society to revert to the present owner if not used for water purposes for a period of twenty-four consecutive months, and for said purposes the sum of $10.00 is hereby appropriated."
Moderator : "In view of the fact that this land may be purchased or acquired by eminent domain this motion requires a 2/3 vote."
Voice vote. Motion unanimously carried.
Article 14. Moderator: "To see if the Town will vote to raise and appropriate a sum of money for mosquito spraying in the Town, the work to be done under the direction of the Board of Selectmen, or take any other action thereon or relative thereto."
Motion made by Mr. Lawrence Stone and duly seconded : "That the sum of $2,500 be raised and appropriated for mosquito control by spray- ing in the Town, the work to be done under the direction of the Board of Selectmen."

Voice vote. Motion carried.
Article 15. Moderator : "To see if the Town will vote to transfer a sum of money from the Cemetery Sales of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery, or take any other action thereon or relative thereto."
Moved by Mr. John T. Walke and duly seconded : "That the Town transfer the sum of $500 from the Cemetery Sale of Lots and Graves Fund to the Cemetery Account for improvements to the Town Cemetery."
Voice vote. Motion unanimously carried.
Article 16. Moderator : "To see if the Town will vote to transfer the sum of $4,000 from the Overlay Reserve Fund to the Reserve Fund, or take any other action thereon or relative thereto."
Moved by Mr. Thomas G. Stevenson and duly seconded : "That the sum of $4,000 be transferred from the Overlay Reserve Account to the Finance Committee Reserve Fund."
Voice vote. Unanimously carried.
Article 17. Moderator: "To see if the Town will vote to authorize the Board of Assessors to use available funds or 'free cash' in an amount not to exceed the sum of $30,000 in determining the tax rate for the year 1959, or take any other action thereon or relative thereto."
