RECORDS OF WARRANTS AND PROCEEDINGS OF TOWN MEETINGS, BIRTHS, MARRIAGES AND DEATHS, WITH STATEMENT OF MONEY PAID TO THE COUNTY TREASURER ON ACCOUNT OF DOG LICENSES.


TOWN WARRANT.


COMMONWEALTH OF MASSACHUSETTS,


MIDDLESEX SS.


To William E. Swain, Constable of the Town of Wilmington.


GREETING :


In the name of the Commonwealth of Massachusetts, and in the manner provided in Sect. 2, Art. 1, of the By-Laws, you are hereby directed to notify and warn the inhabitants of the Town of Wilmington qualified by law to vote in town affairs, to meet and assemble at the Town Hall, on Monday, the fourth day of March next, at nine o'clock in the forenoon, the polls to be opened at ten o'clock A. M., and may be closed at four o'clock P. M., for the election of officers, and to act upon the following articles, namely :


ART. 1. To elect by ballot a Moderator to preside at said meeting.


ART. 2. To bring in your votes on one ballot for three Selectmen, " who shall act also as Assessors and Overseers of the poor," Town Clerk, Treasurer, Collector of Taxes, one School Committee for three years, Constable, Auditor, three Fence Viewers, one Cemetery Committee for three years, one Cemetery Committee to fill vacancy for remainder of term of three years from the first Monday of March, 1899, also to vote upon the following question, viz. : Shall license be granted for the sale of intoxicating liquors in this town ? Yes or No.


ART. 3. To choose all other necessary town officers for the year ensuing.


ART. 4. To hear reports of Committees and act thereon.


ART. 5. To see how much money the town will vote to raise and appropriate for the support of schools, for school books and supplies, for salary of School. Committee, for salary of Super- intendent of Schools, for highways, roads and bridges, for support of poor, for repairs of public buildings, for care and

improvement of cemeteries, for support of public library, for police, for salary of town officers, for removing snow, for mis- cellaneous expenses, for printing, for notes payable, for interest, for state and county taxes, for outstanding indebtedness, for abatement of taxes, and military aid.


ART. 6. To see what method the town will adopt for the collection of taxes and determine the compensation of the Collector.


ART. 7. To see if the town will authorize the Treasurer, under the direction of the Selectmen, to borrow money in anticipation of the taxes of the present municipal year.


ART. 8. To see how much money the town will raise and appropriate for the observance of Memorial Day.


ART. 9. To see if the town will vote to adopt the provisions of Sections 20 and 21, of Chapter 50 of the Public Statutes, in regard to the establishment and grading of sidewalks.


ART. 10. To see if the town will vote to accept the list of jurors as revised by the Selectmen.


Hereof, fail not and make due return of this warrant with your doings thereon, to the Town Clerk at time and place of said meeting.

TOWN MEETING.


RECORD OF PROCEEDINGS OF ANNUAL TOWN MEETING HELD MARCH 4, A. D. 1901.


In accordance and obedience to the directions of the fore- going warrant, the qualified voters of the Town of Wilmington, assembled at the Town Hall, on Monday, the fourth day of March, A. D. 1901, at nine o'clock in the forenoon, the results, with the votes taken, are as follows :


The meeting was called to order by the Town Clerk, the warrant read, and Article one taken up.


ART. 1. Chester W. Clark was elected unanimously the vote being taken by ballot and the check list being used.


ART. 2. The Moderator examined the ballot box which was found empty, the register indicated 000, the box was locked and the key delivered to the Constable. The Ballot Clerks and Tellers having been sworn the official ballots were delivered to the Ballot Clerks, a receipt for the same being taken by the Town Clerk. The Moderator announced that the polls for the election of officers were then open and that balloting might proceed. On motion it was voted that the polls for the election of officers be closed at 4 o'clock P. M. At the appointed time the Moderator declared the polls closed. The names checked upon the lists numbered one hundred and sixty-seven and the ballots as counted from the ballot box numbered one hundred and sixty-seven the register also indicated one hundred and sixty-seven.

ART. 3. Voted a committee of three be appointed by the Moderator to retire, and bring in a list of nominations for the several offices to be filled under the article. Moderator appointed Edward A. Carter, William E. Gowing and William HI. Carter 2nd, as said Committee. The following list was pre- sented and being read by the Moderator was accepted by the meeting, and it was voted that the said candidates be declared elected to the several offices to which they received nominations for the term required.

For State and County Taxes. The actual amounts called for in the Warrants of the Treasurer and Receiver-Gen- and the County Commissioners.


Voted on motion of Mr. Charles J. Sargent that the Select- men be authorized to use any money remaining in the treasury from appropriations not used in full. "After the purposes for which the money was raised have been accomplished " to pay any liabilities incurred for other objects in excess of appro- priations.

ART. 6. Voted that two per cent. commission be paid for all taxes collected of the year 1901, and that all taxes legally assessed be collected within two years from the October follow- ing the May in which they were assessed.


Motion made and voted to pay three per cent. for collecting the uncollected taxes for the year 1900.


Voted to reconsider the vote, whereby it was voted to pay three per cent. for collecting the uncollected taxes of the year 1900.


The vote was then taken on the original motion and declared by the Moderator in the affirmative.


The vote was doubted and the yeas and nays called for. Result, yea 6, nay 32 ; and the motion was declared not carried.


Motion made that a commission, not to exceed four per cent., be paid for collecting the balance of the taxes of the years 1899 and 1900.


Amendment made that five per cent. be paid. The vote being taken on the same was declared in the negative.


The vote was then taken on the original motion and it was voted not to exceed four per cent.


Mr. James E. Kelley requested permission to introduce and read resolutions on the sudden death of one of Wilmington's respected citizens who was also an official of the town at the time of his death, which were as follows :-


Whereas, The great Ruler of the Universe has, in his infinite wisdom, removed from our midst our worthy and esteemed fellow citizen, Othniel Eames ; and


Whereas, The intimate relations held by him with the citizens of this town through life, and as Collector of Taxes for the past two years, render it proper that we should place on record our appreciation of his services, and his merits as a man ; therefore be it


Resolved, That we, the citizens of the town of Wilmington, in Town Meeting assembled, tender our heartfelt sympathy to the family and friends of our deceased townsman, in this their sad affliction.


Resolved, That his sudden removal by death leaves a vacaney and shadow that will be deeply realized by all who knew him.

Resolved, That these resolutions be entered on the records of the town and that a copy be sent to the bereaved family by the Town Clerk.


The resolutions were appropriately seconded by Rev. Walter . H. Rollins, Jonathan Carter, William E. Gowing and Chester W. Clark, and were unanimously adopted by a rising vote of the meeting.


ART. 7. Voted, That the Treasurer is hereby authorized "under the direction of the Selectmen " to borrow a sum or sums of money in the aggregate amounting to thirteen thousand dollars and to execute and deliver the note or notes of the town therefor, payable within one year from the time the loan is made and from the taxes of the present municipal year. The vote was unanimous.


ART. 8. Voted, That the sum of $75 be raised and appro- priated for the observance of Memorial Day.


Voted, That a committee of three be appointed by the Moderator 'to expend said appropriation, said committee to be appointed from the veteran citizens of the town. Committee appointed : Levi Swain, George W. Sidelinker and Horatio G. Littlefield.


ART. 9. Sections 20 and 21 of Chapter 50 of the Public Statutes were read by the Town Clerk and after considerable debate on the question it was voted not to adopt said sections.


ART. 10. Mr. Othniel Eames having died after the revision of the list by the Selectmen, his name was withdrawn and the name of Donald K. Colgate was substituted in place thereof by the meeting. As then revised it was accepted. To serve for the ensuing year, Mr. Edward A. Carter was sworn by the Moderator as Surveyer of Wood, Bark, and Lumber.


After the declaration of the vote for town officers under Article 2 of the Warrant by the Moderator and the sealing of the ballots and check lists used, it was voted to dissolve the meeting.

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the town of Wilmington qualified by law to vote in State and town affairs to meet and assemble at the Town Hall, on Tuesday, the (5th) fifth day of November next, "it being the Tuesday after the first Monday in said month," at six o'clock in the forenoon, then and there to bring in their votes on one ballot to the Selectmen for Governor, Lieutenant-Governor, Secretary, Treasurer, Auditor, Attorney-General, Councillor, Sixth Dis- trict; Senator, Sixth Middlesex District ; two Representatives in the General Court, Twenty-seventh Middlesex District ; County Commissioner, Middlesex; two Associate Commis- sioners, Middlesex; District Attorney, Northern Middlesex ; Clerk of Courts, Middlesex ; and Sheriff, Middlesex.


And you are further required, by the authority aforesaid, to notify and warn the inhabitants aforesaid to meet and assemble at the same place, on the same day, at ten o'clock A. M., to act upon the following articles, namely : -


ART. 1. To choose a Moderator to preside at said meeting.


ART. 2. To see if the town will ratify the action of the Selectmen in accepting a conveyance to the town under a deed from Edward O. Howard, dated Feb. 28, 1901, and recorded in the Middlesex North District Registry of Deeds, in book 328, page 63, of the land described therein.


ART. 3. To see if the town will vote to adopt the pro- visions of Sections 1, 2, 3, 4 and 5 of Chapter 101 of the Public Statutes.


The polls for the election of officers may be closed at 4 o'clock P. M.

RECORD OF PROCEEDINGS.


At ten o'clock A. M., the hour specified in the Warrant for the Town Meeting having arrived, the Town Clerk called the same to order, read the Warrant and under Article One called for ballots for Moderator. Mr. Chester W. Clark was unani- mously chosen.


Under Article Two of the Warrant, the following motion was made by Mr. Edward N. Eames: "That the town hereby ratifies and confirms the action of the Selectmen referred to in said article." On being seconded and put to the meeting, it was voted in the affirmative, and declared carried by the Moderator


Under Article Three of the Warrant, a request was made that the Clerk read the sections referred to. After the reading of the same, on motion by Mr. Howard M. Horton, it was voted : "That the town adopts the provisions of the sections and chapter referred to in the article."


Voted to adjourn the meeting called for town business.
