The following Copy of the first book of records of Wenham has been made by me under the direction of the town authorities of Wenham and at the special re- quest of Mr. Wellington Pool, the present Town Clerk, whose intimate acquaintance with the history of Wenham has enabled him to render me valuable assistance.
The Copy contains all that there is in the original record book, arranged, for convenience of reference in chronological order. The original paging, however, is given in the margin in order to enable anyone consulting the Copy to know the relative position in the original book of each part of the record, and also to refer easily from the Copy to the original.
The original record is much worn and in some places difficult to read. One of the original covers is lost ; and also one leaf; but it appears to have been a blank leaf.
The book was paged by William Rogers, Town Clerk in 1717, the pages being numbered from the beginning and from the end of the book; and in the middle of the book, where the one series of paging meets the other, he made the following entries :
"There is in this book one hundred and sixty-five pages till it cometh to the turning the other end upward-in the year 1716/17; and for the last six year past.
"William Rogers Town Clerk."
"There is in this end of the Book to this place eighty seven pages till it comes to the turning the other end upwards on this.
March the 15th 1716/17: William Rogers Town Clerk.
The wholl in the Booke is 252 pages."
The paging from the end of the book when referred to in the Copy is indicated by a line written over the number.

(The index contains every name found in the record and is also a general index of places and of subjects.)
On the second page from the end of the book are some entries written in Dutch, apparently a list of property owned by some Dutch merchant, and dated July 14, 1650. This is not in the Copy.
On the outside page at the beginning of the book is written :

There is given unto Wenham Twenty acres of ground being laid out of eyther side of ye meeting house. Ten acres given by M' Smith out of his fearme & laid out by him beginning with the bounds at ye upper end of Phinehas Fiske Lott & soe to ye swampe: & the other Ten acres given by Mr John Fiske being laid out Joyneing to it on ve other side of ye meeting house :
It is ordered & agreed upon at this our meetinge yt such as have any ground graunted of that which is given to ye Towne which lyes about ye meetinge house, such shall come and live upon it themselves, & if not to lav it downe to ye plantation, & if any shall build upon it &c & after remove themselves & make sale of the same it is ordered that the Plantation shall have the first pro- farc & give there answere in a short time before they make sale of it to any other.

It is ordered & Joyntly agreed yt whosoever of this towne shall receauie into his family upon and pretence whatsoever any Inmate from out of any other Towne the master of ye said family shall give notice thereof unto such of our Towne who are Selectmen within one weeke after the comeing of any such a one into his house upon ye forfeiture of Twenty shillings & in cause the partie shall not be allowed by ye Towne there to abide or elsewhere within ve liberties of ye Plantation that then the said person, who beng in or receaive into his family the said inmate, to procure such good & sufficyent securitie to lay in unto the Towne as they shall like of for the discharge of the toune of any Inconveniences or damage as may be liable to accrue unto this towne in the future by reason of any such act, & in default thereof the said person shall forfitt for every weeke any such inmate shall bide under his roff the vallew of five shil- lings per weeke unto the Towne to be paid in upon de- mand to the constable for the use of the Towne afore- said, & upon default the constable to have power to dis- traine therefore according as in other causes touching distresses.

It is agreed at this meetinge that none shall fell a tree upon the Comon & cut it out for any thinge, to sell it out of the Towne to any; if any doe soe it is agreed that for every tree made use on as aforesaid, shall forfit ten shillings.

It is alsoe agreed that those that have any Lotts in ye neck have libertie from the Towne to inclose in a common field, with a strait fence from ye right hand of ye cart bridge unto ye river by Richard Dodges against Thomas Princes Lott. Provided a common hye drift way for catle & carting be left out at ye discression of Wm Fiske & John Fayerfeild.
It is agreed that no inhabitant in this Towne shall have libertie to put in any catle into any common feild wherein corne is growinge untill the corne be gathered out of ye field upon the penalty of Two shillings six pence per head of every head soe put in to be paid to ye owners of said feild by him who put or cause to be put in the said catle & the satisfying of the dammage done in the said feild by such catle according as shall be Judged by Two Indifferent men.

Order as to Swine
Allso it is is ordered by the Celect men that all swine shall be yoaked that is to say all swine above a quarter of a veere old to be yoaked with yoakes standing up 5 inches above there necks & if they be a year old to be 9 inches longe of each syde & all swine under a quarter old shall eyther be yoaked or elc there owners to paye the Dammage which is don by such swine & in cass any shall not observe this order shall forfit one shil- ing per swine unto whoever shall find any swine un- yoaked, provided : it be after Leagall warning which shall be two dayes: this order to be in force on the tenth daye of April next ensueing.

It is also ordered that whoesoever shall not observe suficantly to repaire & maintaine all there fences by the first of April next insueing according to the former order made: the first of January 1654: shall be liable to paye doubell Dammage which any shall receive by reason of such defective fences.

Whereas Great Dammage hath bine don to ye Great midow by Cattells feeding of it it is therefore ordered that Every inhabitent of this towne who hath midow therein & is thereby concerned in the Case shall make or cause to be made ther proportions of the fenc-that is to say two Rayles or equelant thereunto by the 8th| day of Aprill next Insueing upon the forfit of 12ª per poalt for every person neglecting the same: & the Celect men have herby power Graunted them to doe it or cause it to be don & to give the forfit which is 12 per poall to whoesoever will doe it-& James Moulton Richard Hutton Samuell Foster Daniel Killim & Thomas Fiske are chosen to proportion the above said fenc & Richard Hutton & Thomas Fiske are chosen to aquaint those of Salem who have midow in the great midow & if they refuse to doe it, then the aforesaid men Richard & Thomas have power Granted them to deall with them according to Lawe.

It: Mr. Gott Phinehas Fiske & Robert Gowing are chosen for Commissioners for this yeere following.
Whereas there are severall percals of lands in the bounds of our Town which are holden by severall persons by Doubtful Titles its therefore ordered: that the Celect men anually chosen shall hereby be impowered to take Notic of all titles of lands that shall by any person be brought to there knowledg & allow of the same: & to cer- tifie the same to the Recorder who is impowered to Re- cord the same |*Grant & Grantee| all which lands being so Recorded shall be accounted a leagall title to all such lands.

All swine shall eyther be yoaked |sufficien [tlv]| or shutt up by the 15th of March next upon the forfiteing of 12ª for every swine that shall be found Defective & Alex- ander Maxey & John Powland are to take the said forfit & to yoake the said swine sufficiantly.
