There is Granted to M' Newman a strip of the Towns Land for an inlargement to his yard: that is to saye so much as hee think fitt provided he preduice not the Coun- try road: which is left to the Discreiton of John Fiske & Richard Coye to order

This Indentur made between John Killim & John Abeye on the one party & the Towne on the other parte Witneseth that ve Aforesaid John Killim & John Abey Doe by these presents covenant & Agree with the towne: yt they will Kepe the towne heard for this Sumer follow- ing viz. to Begine on ye Second Daye of Aprill Next faithfully to Keepe them untill Micklmase Daye follow- ing Beginning or Driveing out theire Cattle at |ye Sunn! 3/4 of an houre high in the morning Dayly & to Bring them home: at Sunn 1/2 an houre high at Night & to take them every morning betwine M' Browns Swampe & the Lañe that Goeth to Thomas Fisks house: & also in Austen Killims yard: & to Blowe an horne at ve said plac[es] every morning sufficantly to give notic when they goe out & at night when they come home & in Case the said Keepers shall putt a Keeper in in thir absence it shall be a suthicant man upon ve forfiture of ther wages. Its voated that M' Newmans Contribution for this present year shall be Gatherd by waye of Rate: which Rate is to be made by the Select men & Richard Hutton and Thomas Fiske.


The Select men together with Goodman Abey John Soo- lard, John Killim & Goodman Waldern are Desired to laye out a conveniant high waye from the Cart Bridg goeing over into the Neck to the towne Common.


Its also voated that our Comon of 600 Akres lyeing beyond the Neck shall be Eaqually Devided betwixt the Inhabitants of the towne.

At a towne meeting on the 4 Janu: - 63: the towne by a generall voate hath given unto John Solard a small parcell of land of aboute sixt[ie] rods adioning to the above said John Solards land: the land being a kind of a triangell bounded from the post of the sd Solards gar- den running a right line to the corner post of the sd Jolin Solards fense on the other side:

Also it is Agreed that who ever shall for time to Com be defective in Aperin & continuing at Leagall town metings we say to Com at the Generall town Meting at nin A Clock & other town metings at time apoynted shall pay half a Crown for the defect in the Generall Meting & eighteen pence for every other such defect.


The 19th of ye 11th mo: 1663: there was a Rate made (by the Select men together with others Chosen to Joyne with them) for the carrying on of our meeting house & Assignd & Deliverd into the Constables hand to Gather parte of it| the Rate being 80€:3-8: who by order from the Aforesd Raters is forthwith to Gather in the one halfe of it in wheate & Indian or els in such paye as shall Carry on the Abovesd worke.


This 19 Febuary 1663 at a Towne Meetting Thomas Fiske Richard Hutton & Thomas White are Chosen to goe in way of perambulation Betwene the towne of Salem & the towne of Wenham together with some of Salem whome they shall send : this to be done & perfected by the last of March next ensueing the date heareof :


* At a generall towne Meeting the 29th of 12ºº: 1663:


there is Granted to Mr. Newman all the towne land lyeing betwixt his Gardine & the swamp on the back side let it be more or lese together with the towns Interest in the sd swampe be it more or lese.


Also its voated that the towne order made formerly for the Devision of the Comon of 600 Akers is hereby repealed.


Also tis ordered & Agreed that all Comon lands whither swampe or upland shall be & is hereby Approperated onely to them that are now towne dwelers unles such as shall be accepted afterwards.


Also tis Agreed yt there shall be 200 Akers of land ļof ye best | of our Comon Lea[sed] to fowre men for one thousand years viz. to Abner Ordway Tho: Sear[les]

In persueanc of an order of our towne 29th of the 12th 1663 for the leaseing out of 50 Acres of land to John Edwards &c: the Comitte impowerd hath bounded said 50 acres as followeth-viz: to begin at a Cleft of rocks by the edg of Pleasant or long pond on the Southerly syd from thenc to a heape of stones which heape of stones lyes Southwesterly from said Cleft & from the heape of stones Southeasterly to a red oake marked on foure sydes standing nere Turnup Swampe: & so on the brook which Runs in said swamp |taking the brooke for a bound! untill it Com to the aforsd pond takeing in |the one halfe of| a slip of medow which lyeth on the East end of said pond as also the one halfe |of| a parcill of medow and swampe which lyeth from the northerly sid of said pond to Ipswich lyne thirtie rod in bredth from the west- erly syde of the brook that runeth out of sd pond to Ipswich Round pond.


* According to a town Act made on the 29th of the 12th month 1663: Richard Kemball Thomas White Rich- ard Hutton & Thomas Fiske have in the Behalfe of the towne Leate out to Thomas Scarles John Edwards & Richard Kemball Juni' to each of them |theire heirs & Assigns| fiftie Akers of land Being parte of the towne Comon of 600 Akers for one thousand yeers according to the said order: to the performance whereof wee | the said| Thomas Searles John Edwards & Richard Kemball Doe Bind our selves our heirs Executors Administrators

Also the Select men together with Goodman Soolard & old Goodman Abey (who is chosen Sirvey":) are im- powered to see to the Repairing of all County & towne highwayes in the towne & are hereby impowered to Call together the Inhabitants of the towne to vt end & whoever shall not attend the worke upon three dayes warning to com at sun an howre high in the morning shall for a dayes defect forfite five shillings to be paid to the said over- seers for the use of the towne & 12ª for one liours defect to be gathered by the Constable by order from the Select men so to doe.

Its ordered that all fences both generall |& particku- laire| within the limits of our towne shall be sufficiantly Repaired by the 10th of the next month that is to saye to be a sufficiant foure Rayle fenc or equivalent there- unto: & so to be kept from time to time untill the 15th of October next upon the forfiture of five shillings for every Gap not exceeding two Rod & for greater quan- tyties two shillings & six penc per Rod John Batch- elder & Alexander Maxey are Chosen for Sirvey" for this following veere who are to see to the Due discharge of that their trust according to lawe in Seeing to the Re- paire of all Comon fences of Corne feilds if the owners neglect |more than three daves| to doe it them selves: & have hereby full power to demand & Receave the aforesd two shillings & six penc per Rod for their lab".
