REPORT.


To the City Council of the City of Newburyport:


Your committee on claims, which it has been a part of my duty to assist, has considered and disposed of the following cases during the past year :


Claim of Max J. deRochemont for damage to sleigh. Petitioner given leave to withdraw.


Claim of William H. Haskell of Merrimac for taking a strip of his land on Winter street for the purpose of widening said street, settled by the pay- ment of one hundred dollars, in consideration of a warranty deed from Mr. Haskell to the city, of the land taken.


Claim of Susan C. Manning for injuries sustained by reason of a defect in the sidewalk upon Green street, referred to the mayor and city solicitor, and settled by the payment of two hundred and fifty dol- lars to the claimant.


Claim of the South End Gun Club for damage to its property on Water street caused by water flowing from the street into its cellar, settled by the payment of twenty-five dollars.

Claim of Edward L. Toppan, amounting to forty dollars and forty-nine cents, said sum of money be- ing paid by him for taxes upon land assessed to him and of which he was not the owner, settled by the refunding of said amount of money to Mr. Toppan.


Claim of James Leonord for damages to his prem- ises on Prospect street on account of water overflow- ing the sidewalk and running into his yard and cellar was considered by the committee, and the claimant given leave to withdraw.


Claim of Edwin F. Hunt for damages sustained by reason of an alleged defect of a city culvert which allowed water to overflow his premises, settled by the payment of ten dollars, and permission being given by the claimant to the city to lay a culvert across his premises to prevent further damage in the future.


Claim of Edward O'Connor for damages to his horse, carriage and harness at Chain bridge settled by the payment of twenty-five dollars.


Claim of Mary Mannix for personal injuries caused by an alleged defect in the sidewalk on Lime street was considered by the committee and no final action has been taken.


At the present time there are but two suits pend- ing in court against the city, one, that of Mary Fen- ton of Lynn, the other that of Humphrey Coffey, now or formerly of Salisbury. These suits are both trivial in character and will probably never be

pressed to trial by the plaintiffs. Reference has been made to both in previous reports.


The suit of Cornelius Toomey against the city, an action for permanent personal injuries, alleging dam- ages in the sum of ten thousand dollars, was tried in the superior court October last and was disposed of by a verdict in favor of the city.

In accordance with the terms of the bequest, one half of the income is to be expended on shade trees for our public streets, and one half to the improving of sidewalks.


During the year, fifty-nine shade trees were planted in various parts of the city on the request of owners of estates.


What costs nothing sometimes does not get much care or at- tention ; if the trees annually planted had some protection when

young, more of them would doubtless survive the attack of mis- chievious boys or men and irresponsible horses.


Many of the reasons advanced for the removal of shade trees that have withstood attacks of every nature for a generation are too trivial to be listened to with patience, yet the desired per- mission is often too easily obtained, the tree doomed. All per- sons in authority are not always lovers of shade trees and when one of them gets in his work it means a sad loss to the whole community.


The assessments for sidewalk improvements adjoining a con- siderable number of estates ordered in by the mayor and alder- men have been met from the income of this fund during the past year, in some cases the whole amount assessed, in others a por- tion, but in no case to relieve said estates from liability for their proportion of repairs hereafter, said proportion to be in accord- ance with the amount advanced from the income of this fund.

SAWYER FUND.


To the Honorable Mayor and City Council of the City of Newburyport :


GENTLEMEN :- The joint standing committee of · the City Council on Sawyer fund, held in trust by the city for the benefit of the Public Library, respectful- ly report said fund is invested in a city note, $5,000, bearing interest at the rate of 4 1-2 per cent per annum.


The interest for the year 1897 has been paid over to the directors of the public library by order of the committee.


The annual report of the directors of the public library is referred to for further information touch- ing the disposal of the above income.
