Report of City Solicitor

City Council, City of Newburyport
Gentlemen :
I herewith submit my report of the Law Department of the City of Newburyport for the year of 1939.
CASES TRIED
LEWIS FURLONG: This case started in 1938 and hearings before a master and single Justice of the Supreme Court, a finding was made in favor of the City; The respondent then appealed the case to the full Bench of the Supreme Court of Massachusetts where the case was argued in October 1939. This case has now been completed with a final decision by the Full Court in favor of the City.
MARY A. FLATLEY: The plaintiff claimed damages for injuries alleged to have been caused by a defect in the highway at Plum Island in 1937. Suit was pending in this case when I took office. The case was tried before a jury at the Middlesex Superior Court in April 1939. The jury returned a verdict in favor of the City.
ALICE LAPLANTE: This was a claim for damages for injuries, alleged to have been received from a defect in the highway. Suit brought in the Essex Superior Court and called for trial in September 1939. Court ordered a finding in favor of the City when the case was called for trial.
ELIZABETH THURLOW: Claim for injuries from fall due to defect in sidewalk on Pleasant Street. Suit brought in the Essex Superior Court, case was reached for trial at the September sitting of the Superior Court in Newburyport, 1939; The case was settled just before trial for the sum of $60 with the consent of the General Government Committee.
WILLIAM EATON: Action for damages for injuries received due to fall on sidewalk on Merrimac Street. Case entered in Superior Court, called for trial in September 1939 and the plaintiff failed to answer the call of the case and was non-suited.
BROOKS CONSTRUCTION & LUMBER Co. This is an action of contract against the city for materials furnished to all departments of the city covering a period of years. At the call of the list it was agreed that the attorneys for the parties would go over the accounts and try to determine the true balance due before the court would appoint an auditor. This case has not been finished as yet, the attorneys have spent many hours going over the vouchers, warrants and cancelled checks and will require a great deal of time to finish the same.

There have been many claims of damages for injuries alleged to have been received from falls due to various causes and alleged defects. Reports of accidents or falls have been investigated and pictures taken. In many of the claims no written notice has been given to the city. A large number of these cases where notice had been given claimants were given leave to withdraw as investigations showed that there was no liability on the part of the city.

SUITS BROUGHT BY THE CITY
City of Newburyport vs. City of Lowell
City of Newburyport vs. Town of Salisbury
The city of Lowell and the Town of Salisbury owed the plaintiff $3,723.20 and $4,728.21 respectively for assessments as their share of the maintenance of the Clam Chlorinating Plant at Plum Island. It was necessary to bring a bill in Equity in the Supreme Judicial Court, under the statutes, in order to enforce payment thereof. These claims have now been paid.
CITY OF NEWBURYPORT VS. ANDREW GILLIS :
An action of ejectment was brought by the City against the defendant who was a tenant in the Hannah Building on Pleasant Street; the justice of the District Court issued to the plaintiff an execution for possession, the Defendant then brought a bill in equity against the city to enjoin it from ousting the defendant as a tenant under said execution and to force the city to retain the tenant in the premises. After hearings before a master and argument before the Justice of the Superior Court a

final decree was entered in favor of the city and the defendant was required to remove from the premises.
The services of the city solicitor were required at a number of hearings and matters of legislation affecting the City of Boston and Salem and Newburyport. The most important was the hearing of the commissioners appointed by the Supreme Court to revise the proportionate shares, of the cities and Towns flowing sewerage into the Merrimac River, of the cost of maintenance of the Chlorinating Plant at Plum Island, hearings were held in Salisbury, Boston and Lawrence and before the Single Justice of the Supreme Court and visitation of the Plant by the Commission members appointed by the Court. The cities share was but slightly increated by the findings of the commission.
TAX TITLES
There have been a number of parcels of land where the buildings are dilapidated. and the city holds tax titles, these tax titles have been taken to the Land Court where the right of redemption has been foreclosed and the title is now in the city : Several parcels have been deeded outright to the city without the necessity of entering them in the Land Court.

There have been many matters that have required conferences with state official: on municipal affairs. Numerous opinions have been rendered to the various depart- ment heads, city council and the Mayor throughout the year. Numerous papers. ordered, contracts releases etc. have been drawn up for various City officials.
