Article 15. To see if the Town will appropriate $55.00 for general improvement in any of the Cemeteries, same to be taken from money in the Town Treasury received from the sale of Burial Lots in 1934, in accordance with Chapter 114, Section 15, of the General Laws, or do or act.

Article 17. To see if the Town will appropriate for pay- ment of Water Main Extension Notes maturing in 1935 the sum of $2,500.00 to be taken from "Water Receipts Reserved for Appropriation" in 1934, or do or act.


Voted unanimously that the sum of $2,500.00 be appro- priated for payment of Water Department Main Extension Notes of that amount maturing in 1935, said sum to be trans- ferred from "Water Department 1934 Receipts reserved for appropriation."


Article 18. To see if the Town will appropriate for pay- ment of interest due in 1935 on Water Main Extension Notes the sum of $1,725.00, same to be taken from "Water Receipts Reserved for Appropriation" in 1934, or do or act.


Voted unanimously that the sum of $1,725.00 be appro- priated for payment of interest due in 1935 on Water Depart- ment Main Extension Notes, said sum to be transferred from "Water Department 1934 Receipts reserved for appropriation."

Article 19. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for municipal purposes, under authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933, as amended by Chapter 313 of the Acts of 1934, or take any action thereto.


Voted unanimously that the Treasurer, with the approval of the Selectmen, be and hereby is, authorized to borrow for general maintenance expenses of the Town the sum of $15,- 000.00, but in no event a sum in excess of the amount of tax titles taken or held by the Town, and to issue a note or notes of the Town therefor, all in accordance with the provisions of Chapter 49 of the Acts of 1933, as amended by Chapter 313 of the Acts of 1934.


Article 20. To see if the Town will accept the following bequest : $5,251.67 received from the Trustees under the will of Marshall Russell to be designated and always known as the "Russell Fund," and to be held in trust forever; the income only to be used for the relief and aid of the deserving poor, who are residents of said Town, and of the Protestant faith, or do or act.


Voted unanimously that the Town accepts with gratitude the bequest of $5,251.67 received from the Trustees under the will of Marshall Russell, to be designated and always known as "The Russell Fund" and to be held in trust thereunder, the income only to be used for the relief and aid of the deserving poor who are residents of said Town and of the Protestant faith and to be dispursed by the Selectmen, Board of Public Welfare and Allen Trustees acting jointly.


Article 21. To consider and act upon the question of amending the by-laws of the Town by substituting for Articles 1 to 9 of the present by-laws, Articles 1 to 8 inclusive substan- tially as proposed by the committee appointed by the Board of Selectmen as authorized by the vote of the Town to consider the revision of the Town by-laws, the report of which com- mittee is printed in the annual town report for the year ending December 31, 1934, or do or act.


Voted unanimously that the By-laws of the Town be and they hereby are amended by substituting for Articles 1 to 9 of the present By-laws Articles 1 to 8 as submitted by the By-law Committee and printed on pages 30-34 inclusive in the Town Report for the year ending December 31, 1934.

Article 22. To see if the Town will vote to construct a sidewalk on West Plain Street on the southerly side from Lake Road to Edgewood Road or any portion thereof, to relieve unemployment : appropriate and assess a sum of money to pur- chase materials; and that the work proceed provided that the Emergency Relief Administration labor can be procured.


Voted unanimously that the Board of Selectmen are auth- orized and directed to construct a concrete sidewalk on the southerly side of West Plain Street, substantially from Lake Road to Edgewood Road, the work to be done and payment therefor made under the following terms and conditions :


The Board of Selectmen, together with the Chairman and Clerk of the Finance Committee, are to endeavor to obtain the approval of the work as an E. R. A. or other Federal project, and are to purchase the necessary material and pay for any other necessary non-labor costs from the funds appropriated under Article 23 of the Warrant for this meeting, if any, the construction to be under the supervision of the Surveyor of Highways, the labor costs to be paid for from E. R. A. or other Federal Funds.


Article 23. To see if the Town will appropriate and assess a sum of money to be used in connection with E. R. A. projects.


Voted unanimously that the Town appropriate and assess the sum of $9,000.00 to be expended under the direction of the Board of Selectmen and the Chairman and Clerk of the Finance Committee, to be used in connection with E. R. A. Projects, and that this committee have charge of hiring all trucks and truck drivers on all E. R. A. projects.


Article 24. To see if the Town will vote to appropriate and assess a sum of money for the relocation and reconstruction of a portion of Concord Road, according to plans to be recom- mended by the County engineers.


Voted unanimously that the Town appropriate and assess the sum of $6,000.00 to be expended under the direction of the Board of Selectmen for the purpose of relocating and recon- structing a portion of Concord Road according to plans to be recommended by the County Engineers, said sum to be ex- pended in cooperation with the Commonwealth of Massachu- setts and the County of Middlesex in accordance with the pro- visions of the General Laws.


Article 25. To see if the Town will appropriate and assess

a sum of money to install a fireproof vault in the Town Hall, or do or act.


A Report was given by Mr. Frank G. Mackenna, chair- man of the Committee to report on the needs of a vault for Town Records, stating fully the needs of a vault.


The Town voted not to install a vault.

Article 26. To see if the Town will appropriate and assess a sum of money not exceeding $1,000.00 to purchase a piece of land to be used for burial purposes, to enlarge the Lake View Cemetery, said piece of land now supposed to be owned by the heirs and demises of the late Edward Dammers; said piece of land adjoins the North East boundary of Lake View Cemetery and is described as follows :- Starting at a point of the North- easterly corner of present Lake View Cemetery and running approximately 152 feet on unaccepted way, thence at right angle to said way approximately 238 feet in a westerly direction to point of beginning, or do or act.


Voted to pass over the Article.


Article 27. To see if the Town will authorize or instruct the Board of Selectmen to petition the General Court for legis- lation, giving the Board of Selectmen full authority over the waters of Dudley Pond, and control over all fishing, boating, bathing, skating and other recreational activities in or on Dudley Pond and the shores thereof, or do or act.


Voted unanimously that the Board of Selectmen be and they hereby are authorized and instructed to petition the Gen- eral Court for legislation giving to the Board of Selectmen of the Town full authority over the waters of Dudley Pond and control over fishing, boating, bathing, skating and other recrea- tional activities in or on Dudley Pond and the shores thereof.


Article 28. To see if the Town will appropriate and assess a certain sum of money for the establishment and maintenance of outdoor swimming baths on the shore of Dudley Pond for the purpose of affording the inhabitants of the Town oppor- tunities to swim and receive instruction in swimming, and for the acquiring of the necessary land for public parking places in connection therewith, or adjacent thereto, and for other municipal purposes, and will authorize the Board of Selectmen to acquire the necessary land for such purposes by eminent

domain or otherwise, as it may to them seem necessary and proper, or do or act.


Voted unanimously that the sum of $1,700.00 be and it hereby is raised and appropriated for the purpose of establish- ing and maintaining an outdoor swimming beach on the shore of Dudley Pond, together with the acquisition of land for public parking places in connection therewith or in addition thereto; said sum to be expended for material and expenses other than labor, and that the Selectmen be and they hereby are authorized to make any necessary taking of land by eminent domain for the purpose of providing such swimming beach or parking place, either or both the labor costs to be provided by E. R. A. or other government funds if available.


Article 29. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of the Planning Board for the purpose of completing the study of highways leading to and in the vicinity of Dudley Pond, or do or act.


Voted that the substance of Article 29 be referred to the Planning Board.


Mr. Gilbert Small read a Report of the Wayland Planning Board on Maiden Lane and Park Lane and the present Con- dition of other Private Ways and of Real Estate in the vicinity of Dudley Pond.


Article 30. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of the Planning Board for the purpose of having prepared an adequate plan for the alteration, repair and relocation of Syca- more Road and Hawthorne Road, or any portion of either, in order that the necessary steps may be begun looking to the ultimate acceptance of said roads by the Town, or do or act.


Voted to pass over the Article.


Article 31. To see if the Town will accept as public ways, the private ways known as Sycamore Road and Hawthorne Road or any portion of either, and acquire any necessary land by eminent domain or otherwise; and appropriate and assess a sum of money to be expended to relocate and repair any por- tions accepted, or do or act.


Voted to pass over the Article.


Article 32. To see if the Town will appropriate and assess a certain sum of money to be expended under the supervision of

the Planning Board for the purpose of having prepared an adequate plan, for the alteration, repair and relocation of Pine Ridge Road, in order that the necessary steps may be begun looking to the ultimate acceptance of said road by the Town, or do or act.


Voted to pass over the Article.


Article 33. To see if the Town will appropriate and assess a sum of money for materials to construct a shed to house Highway equipment, or do or act.


Voted to appropriate and assess the sum of $350 for materials to construct a shed to house Highway equipment.


Article 34. To see if the Town will authorize the Surveyor of Highways with the approval of the Board of Selectmen, to sell, trade, or otherwise dispose of the International 11/2-ton truck, or do or act.


Voted to hereby authorize the Surveyor of Highways with the approval of the Board of Selectmen to sell, trade or other- wise dispose of the International 11/2-ton truck.


Article 35. To see if the Town will vote to purchase a truck for the Highway Department, and to appropriate, grant, borrow or otherwise provide a sum of money to pay for the same, or do or act.


Voted to appropriate and assess the sum of $752 for the purchase of a truck for the Highway Department and that the Board of Selectmen act as a committee for the purchase of the same.


Article 36. To see if the Town will appropriate and assess a sum of money to gravel Clay Pit Hill Road, or do or act.


Voted not to gravel Clay Pit Hill Road.


Article 37. To see if the Town will authorize the Board of Assessors to employ counsel and expert valuers, to assist them in contesting appeals from the decisions of Wayland's Assessors, and appropriate and assess a sum of money not exceeding $500.00 for that purpose, or do or act.


Voted that the Board of Assessors are hereby authorized to employ counsel and expert valuers to assist them in con- testing appeals from the decisions of Wayland's Assessors and the sum of $500.00 is hereby appropriated and assessed for that purpose.


Article 38. To see if the Town will appropriate and assess the sum of $1,100.00 to purchase fire hose, or do or act.

Voted that the Town appropriate and assess the sum of $1,100.00 to purchase fire hose for the two fire stations.


Article 39. To see if the Town will appropriate and assess a sum of money for the purchase of a piece of fire apparatus to replace the old Reo truck now in service in the Cochituate station, or do or act.


Voted that the Town appropriate the sum of $3,265.50 to purchase a new fire truck, and that $1,265.50 be assessed, and two notes for $1,000.00 each be given, one to be paid in 1936 and the other to be paid in 1937.

Article 40. To see if the Town will extend the water main from Brown's corner on Concord Road, down Oxbow Road, a distance of 1400 feet to the residences of Edgar Cain, Nickelas Gain and George N. Sherman ; appropriate and assess a sum of money therefor, or do or act.


Voted unanimously that the Board of Water Commission- ers be and they hereby are authorized to extend a six inch water pipe from Brown's corner on Concord Road in the north- erly part of the Town along Oxbow Road a distance of sub- stantially 1400 feet to the residence of Nickelas Gain, and that the sum of $1,050.00 be taken from money appropriated under Article 23 for the purpose of providing the necessary pipe and other materials, the work to be done under the supervision of the Board of Water Commissioners, the labor to be paid from any Federal grant which may be obtained, but if money is not provided by the E. R. A. or by other government funds, work is not to be started.


Article 41. To see if the Town will appropriate and assess a sum of money for the purchase, from Harold E. Draper of Wayland, of a set of twenty-four (24) original tracings of plans and profiles of about forty-six thousand (46,000) feet of roads in and around Wayland center, or do or act.


Voted to pass over the Article.


Article 42. To see if the Town will appropriate and assess the sum of $350.00 to be expended by the Board of Health, under the direction of the School Committee in support of a Dental Clinic for the school children of Wayland.


Voted that the Town appropriate and assess the sum of $350.00 to be expended by the Board of Health under the direc-

Article 43. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropria- tions made under the foregoing articles.

Pursuant to the following warrant the inhabitants of the Town of Wayland met this day and did the following business.


Article 1. To hear the reports of Town Officers, Agents and Committees, and act thereon.

Article 2. To see if the Town will raise and appropriate a sum of money for notices of meetings, or do or act.


Voted that the Town appropriate the sum of $75.00 for notices of meetings, the amount of said appropriation to be transferred from surplus revenue.


Article 3. To see if the Town will authorize the Board of Selectmen to accept the transfer of the care and control to the Town for a period of 99 years of a certain parcel of land located at or about the outlet of Dudley Pond for park and recreational purposes, said land being described in the 101st parcel of a tak- ing by the Metropolitan Water Board, dated January 1, 1898, and recorded with Middlesex South District Deeds, Book 2635, Page 1, all in accordance with a certain indenture between the Commonwealth of Massachusetts acting through its Metropoli- tan District Commission, Water Division, and Inhabitants of the Town of Wayland, a copy of which is in the hands of the Town Treasurer, and will authorize the execution by the Board of Selectmen on behalf of the Town of said indenture, or will ratify and approve the execution thereof, or do or act.


Voted that the Board of Selectmen be and they hereby are authorized to accept the transfer of the care and control to the Town for a period of 99 years of a certain parcel of land

located at or about the outlet of Dudley Pond for park and recreational purposes, said land being described in the 101st parcel of a taking by the Metropolitan Water Board, dated January 1, 1898, and recorded with Middlesex South District Deeds, Book 2635, Page 1, all in accordance with a certain indenture between the Commonwealth of Massachusetts acting through its Metropolitan District Commission, Water Division, and Inhabitants of the Town of Wayland, a copy of which is in the hands of the Town Treasurer, and to execute said inden- ture on behalf of the Town.


Article 4. To see if the Town will appropriate a sum of money to defray cost of administration, purchase of materials, and truck hire for Emergency Relief Administration and Works Progress Administration, or do or act.


Voted that the Town appropriate $3,500.00 to defray cost of materials and truck hire necessary for U. S. Works Prog- ress Administration purposes, the amount of said appropriation to be transferred from surplus revenue.


Voted to dissolve the Meeting 8.50 P. M.
