That the school committee be instructed to divide all school monies, excepting twenty-five per cent. of the State School Fund, or such part of twenty-five per cent. of said fund as has been expended for school apparatus, in such a manner that each

Special Appropriations.
Appropriation in 1870 for sluice near J. M. Bent's, $100 00
The request being made to examine the clerk's records, and state the precise votes in relation to the sluice above named, for the purpose of ascertaining the exact sum the town is liable for, and the committee to expend the same, the following as found is given :-
Town meeting April 5, 1869. "For causeway near R. Ham- mond's, and corner near C. W. Moore's, and a sluice near J. M. . Bent's, $200."
" Chose selectmen a committee to expend the money." The selectmen's records show an order issued to J. N. Hammond (dated Dec. 10, 1869) for $129.20 out of this appropriation, leaving a balance of $70.80 transferred to incidental account, as it was understood that the object for which the appropriation was made was in the main accomplished, the balance being insufficient to build a new drain.
April 4, 1870. "Voted for sluiceway near J. M. Bent's, $100. Chose J. M. Bent, Horace Heard, and E. W. Giles, agents to expend the same."
April 3, 1871. "Voted to excuse Horace Heard from com- mittee on drain, south part."
May 2, 1871. " Also under this article, voted to empower the committee on a drain near James M. Bent's shoe shop, to borrow one hundred dollars additional to complete the drain." " Also under the Sth article, chose Thomas J. Damon on said committee, in place of Horace Heard, resigned."
The matter as understood by the auditor is as follows :- an appropriation by an assessment of one hundred dollars, now in the treasurer's hands, also leave to borrow the same amount, with no application of any part of the money, for any other pur- pose, to any other portion of any other highway in Cochituate. The treasurer exhibited satisfactory vouchers for all monies paid during the year, with accounts correctly cast.
The records of the treasurer and selectmen agree in the final result, differing in a few instances in the manner of making entries in the ledger. No order should be issued overdrawing upon an appropriation, without stating from what source the excess is taken in another order.
REGULATIONS . ADOPTED BY THE TOWN MARCH 3, 1873.
It is hereby ordered, First, That the collector on or before the first day of May, and the treasurer within seven days from the time of his election, shall give bonds in such sums, and with such sureties, as shall be satisfactory to the selectmen.
Second. That in case the collector and treasurer, or either of them, fail to give such bonds within the time specified, the selectmen shall immediately appoint such officer or officers as provided by law.
Third. The selectmen are hereby ordered not to issue any order to the treasurer, nor the assessors their warrant to the collector, until said officers have filed such bonds in the select- men's office. That these regulations be entered upon the clerk's records, the officers named to be governed by them, until otherwise ordered.

" In the year of our Lord one Thousand seven hundred & eighty "-
" An act for incorporating the Easterly Part of the Town of Sudbury, in the County of Middlesex, into a Separate Town by the name of East Sudbury "-
" Whereas, it appears to this Court, that the Inhabitants of the Easterly part of the Town of Sudbury, in the County of Middlesex, labor under many Difficulties in their present Situa- tion, and whereas for the remedying of which they have earnestly requested that they may be incorporated into a Separate Town;"
"Be it therefore Enacted by the Council and House of Representatives in General Court Assembled, & by the Au- thority of the Same, that the Easterly part of the Town of Sudbury, in the County of Middlesex, Bounded as followeth, viz; Beginning with the River between Concord & Lincoln, thence to run with the River till it comes to the mouth of a Ditch on the Westerly side of said River between the meadows of William Baldwin Esq. & Eliakem Rice, thence on the said Ditch to the County Road leading to Stow, crossing said Road and bounded on the Southerly side thereof till it comes to the line between the Land of Nathl. with the line Between said Carter & Whelor, to the County Road leading to Marlborough, thence running up and Bounding on the Westerly side of said Road, till it comes opposite to the line between the Heirs of Lieut. Goodenow, Deceased, & land in possession of Robert Eames, at Sandy hill so called, thence Crossing said Road, to the Corner aforesaid, thence running to a white Oak Tree, near the Head of Capt. Moses Maynard's meadow, thence running a straight Line to a swamp White Oak Tree standing on the Bank of the River, Eastwardly from the Dwelling House of Capt. Moses Stone's, thence up & with said River to Framingham Line, thence Bounded on all other parts agreeable to the known & ancient Bounds of the Town of Sudbury, on the Town of Framingham, Natick, Weston, & Lincoln, to the first mentioned Bounds ; be & hereby is Incorporated into a Town by the name of East Sudbury, and that the Inhabitants thereof be & they are hereby invested with all the powers, priviledges, and Immunities, which the Inhabitants of Towns within this State do or may by Law enjoy "-
" Provided never the less & be it further Enacted, that the Inhabitants of the Town of East Sudbury, & the Town of Sudbury, shall support and maintain the Bridges & the long Causeways over the River and meadows, near Mr. Jonathan Carters, within said Town of East Sudbury, notwithstanding said Causeways and Bridges lying within the Town of East Sudbury, in equal proportion Between the said Town of East Sudbury, and the Town of Sudbury, & that the Town stock of arms & ammunition, be divided according to the number of persons that are obliged to bear arms in said Towns; and that the Donation Given by Mary Dean to the Inhabitants of the East side of the River, be disposed of according to the Direction of the Donor, & all other Donations Given to the poor or for Benefit of Schools & all Lands & all Moneys now in the Treasury, or due on Bonds, under the care of Trustees, or by any other Way or Means, that Doth Belong to the Town of Sudbury, shall be equally Divided Between said Town & the Town of East Sudbury, & the poor which now belong to the said Town of Sudbury, shall be Divided Between the Town of Sudbury and the Town of East Sudbury, according to the Last Tax act, and it is also Enacted, that the House & Lands of

Caleb Whelor, together with the Training Field adjoining thereto, Remain to the Town of Sudbury-And be it further Enacted that the proprietors in the Town of Sudbury, shall forever hold all their Rights and Priviledges, in all their Com- mon & Undivided Lands, and remain a joint propriety in the Town of Sudbury and the Town of East Sudbury, as if the Town of East Sudbury had not been set off into a separate Town "-
"And be it further Enacted, that the said Town of East Sudbury shall be held to pay their Proportionable part of all Town, County & State Taxes, that have been assessed or granted, or that shall be granted to be assessed on the Town of Sudbury, by the Great & General Court During their present session-And be it further Enacted, that Josiah Stone Esqr. be, & he is hereby Directed and impoured to Issue his Warrant, Directed to some principle Inhabitant of said Town of East Sudbury, requiring him to warn the Inhabitants of said Town of East Sudbury, qualified by Law to act in Town affairs, to · assembled at some seutable Time and place in said Town, to Choose all such officers as Towns by Law are required to Choose, in the Month of March Annually, and to Transact all other Matters and things Necessary to be done in said Town "-
