REPORT OF BOARD OF COMMISSIONERS OF TRUST FUNDS


February 2, 1925


To the Inhabitants of the Town of Wayland:


The Commissioners were elected at the annual town meeting in March, 1924, under the provisions of General Laws, Chapter 41, sections 45 to 47, and have duly quali- fied, this being the first time that Commissioners of Trust Funds have been elected in the town of Wayland.


We have received from the Town Treasurer particu- lars of the various trust funds in his hands at the time of our appointmentment and of additional funds re- ceived by him during the year. We have approved of the investment of trust funds made prior to our qualifica- tion in designated securities, and have specified the in- vestments in which additional trust funds received dur- ing the year shall be made.


The statute under which we are acting provides that the board of commissioners of trust funds "shall have the management of all trust funds given or bequeathed for the benefit of the town or the inhabitants thereof, unless the donor in making the gift or bequest shall otherwise provide," and that the board shall "so far as consistent with the terms of the trusts, manage and control the same, and distribute the income in accordance with the terms of the respective trusts." The authority thus conferred is very broad, and gives the board juris- diction to manage and control both the investment of the principal of the trust funds of the town and the distribu- tion of the income, so far as consistent with the terms of the trusts. This includes at least supervisory control over the distribution of income heretofore exclusively con- tolled by other agencies of the town, where such control is not contrary to the terms of the gifts or inconsistent with the trusts pertaining thereto.

In view of the short time the board has been in existence, we have not yet definitely determined in what manner or to what extent we may or should control the distribution of income from trust funds which have heretofore been administered exclusively by other boards or trustees acting under authority of the town, but dur- ing the present year the board will establish a plan of procedure. in this connection, in co-operation with the other boards or trustees having to do with trust funds, which we expect will meet with approval and fulfil the objects contemplated by the law under which we are acting.


The following is a list of the trust funds under our jurisdiction, of which the Town Treasurer is custodian, and of the investments approved or authorized by us up to and including December 31, 1924:
