To the Honorable Mayor and Municipal Council :
I herewith submit my first annual recommendations for electrical branch of the Fire Department for the coming year :
Mintenance of Fire Alarm. $800.00
Salary of Superintendent of Fire Alarm .... 2.002.00
Something should be done this year in regard to a small car for inspection purposes, as conditions are bound to arise which would crip- ple both branches of the service namely. I might be in southern part of the city, or elsewhere, making inspections with truck and something happening to fire alarm service under these conditions, my helper being at the station, would be absolutely unable to render service owing to my having truck and tools on inspection work.
As present truck will have been in the service three years this spring, authority considered good in such matters, advises me that it will cost approximately $300 to keep present machine in repairs for coming year owing to its three years of constant service. In light of the fact that $150 is all that can be realized in trade for present truck at this date. I do not consider it wise economy to spend twice as much for repairs as we can get in trade for new car. I therefore recommend trading present truck for light car for inspection purposes and the pur- chase of a larger truek for fire alarm service, as present truck is en- tirely inadequate owing to its age and capacity for present service.
The matter of new switchboards for fire alarm service is very urgent. due to the fact that present boards are 50% overloaded, and the Insurance Underwriters' report will condemn present conditions.
There are also 18 obsolete type fire alarm boxes which should be replaced. the same having been recommended the last two years. I would suggest that we replace six of these boxes yearly until all have been replaced with modern. successive, positive, non-interfering type.
Also upon recommendation of Board of Engineers would ask for one new fire alarm box to be located on South Avenue, in vicinity of Snell Street, as there are eight or nine houses in this neighborhood, representing twenty or twenty-five thousand dollars investment, which are anywhere from a quarter to a half mile from nearest fire alarm box.

CITY SOLICITOR
To the Honorable Mayor and Municipal Council. City of Attleboro :
I herewith submit my report as City Solicitor for the year 1921.
As predicted in my last annual report, the work of this office has been .more arduous than for the two preceding years, although there have not been as many court trials as anticipated. The number of con- ferences, advice given to city officials, opinions written, claims settled, contracts drawn and examined. bills collected, views of property rela- tive to accidents, ordinances examined and interpreted. interpretations of the charter and pleadings filed in court have been considerably more than any other year since I have held the office of City Solicitor. Ex- cepting for court work, I have not had to go out of town on business as much as last year, but altogether the ordinary routine of the office has been much more than before.
I have assisted the Sealer of Weights and Measures in one prosecu- tion in court : the Overseers of the Poor on one Juvenile case, and the Assessors before the County Commissioners on an appeal from their re- fusal to make an abatement, report of all of which will probably appear in the reports of these departments. I have either settled. or assisted in settling several small claims against the city, which are matters of report in other departments of the city.
I also assisted in contesting the matter of the petition for a . receiver of the N .. T. & A. Street Railway, which was dismissed and the injunction sought refused by the court.
Court Cases.
Simpson Case-The case of Sarah V. Simpson for personal injuries caused by a defect in Emory Street was tried at the March term of the court and resulted in a verdict against the city of $572.00. which was a smaller amount than my predecessor in office offered to settle this case for several years before.
State Case-The snit brought by the Treasurer and Receiver Gen- eral for the board of Olivene Gagnon is still pending.
Fisher Case-The case against the Estate of John M. Fisher for damages to a hydrant is still pending. but will be brought to trial in the near future.
Collum Case-The case of Wallace Collum for personal injuries caused by a defect in Bishop Street was settled ont of court by authority of the Municipal Council.
Smith & Dexter Case-The case of Hugh A. Smith et al., a petition for damages for land taken for the relocation of Bank Street was settled out of conrt by authority of the Municipal Council.
Nellie A. Cooper Case-This is a petition for assessment of dam- ages by jury for land taken for the relocation of Bank Street. and is still pending.
Joseph F. Fuller Case and Herbert Linkletter Case-Both of these cases are on a petition for review of assessment by jury as abutters on the A. B. C. Street Railway and are still pending.

Avadis Zahigian Case-This is a petition for assessment of damages by jury for land taken at corner of Park and Pine Streets and is still pending.
Frank A. Cummings Case-The petition of Frank A. Cummings for assessment of damages by jury for land taken has recently been settled out of court by authority of the Municipal Council.
Frank A. Cummings Case-The petition by Frank A. Cummings for writ of certiorari is a petition for a writ to have the assessment on the A. B. C. Street Railway declared void, principally for the reasons that it is alleged that the act allowing the assessment is unconstitutional. This was heard before Judge Jenney at the November sitting of the Supreme Court at New Bedford. I feel that the result is that the case will be decided on the broad grounds of the constitutionality of the act, or the fairness of the assessment. The case has been heard. argued and briefs submitted, and now awaits the decision of the court.
Ellen Loew Case. Two suits have been brought, one by Ellen Loew and the other by husband. William Loew, for damages arising from an alleged defect in the sidewalk on Park Street. These cases have been answered and are pending.
Timothy O'Neil Case-Suit has been entered by Timothy O'Neil aris- ing out of an alleged defect in Park Street. answer has been filed, and the case is still pending.
Alvin N. Cooper Case-I brought suit for the city against Mr. Cooper for a water bill which has been settled by authority of the Municipal Council.
Alvin N. and Frederick P. Cooper Case-I have recently filed a petition in the Land Court in behalf of the city at the instance of the City Collector to foreclose the right of redemption on six parcels of land sold to the city for unpaid taxes on land taxed to Alvin N. and Frederick P. Cooper. This, of course. is still pending because it has not vet reached the stage for judgment even if it is not contested.
Miscellaneous-There are three matters in which the city has re- ceived notice of claim for injuries caused by alleged defects in the high- ways which I have investigated. but in none of which suit has yet been brought.
There are two notices of claims against the A. B. C. Street Railway in which suit has not been brought. and one report in which no claim for damages has been made.
A claim has been entered by the City of Boston for a hospital bill amounting to $635.43 for board and care of Delia Vallequette for thirty- nine weeks. This is a child that was in the Fourth District Court as a neglected child, and so far, in consequence of the court action, I am of the opinion that the city is not liable for this bill, and I have so noti- fied the Health Department of the City of Boston.
From the above, it will be seen that, as stated in the beginning of this report, the work of this department has been considerable for the past year, and promises to be so for next year.
The expenses of this department have been $23.35.
I recommend the same appropriations for 1922 for salary and ex- penses as during the past year for this department.
