On July 16, 1959, Charles Fitts, Elliott Grabill, Representative James DeNormandie and Katharine White of the Planning Board attended the congressional hearing in Washington preceding the enactment of the enabling legis- lation for the park. A carefully worded statement was presented at this time, setting forth the position of the town. The park bill was enacted into law September 21, 1959. One of the provisions of the act is that a com- mission of five members be appointed by the Secretary of the Interior. Representative composition of this com- mission includes Lincoln, Concord, Lexington, the Common- wealth of Massachusetts and the Department of Interior. On September 21, 1959, the Selectmen voted to nominate to the Secretary the appointment of Katharine White.


Mrs. White has spent an enormous amount of time in the initial planning stages of the park and is ably quali- fied to represent the Town's position on this commission.


The Selectmen feel that continuing coordination is essential and are therefore recommending that this com- mittee be continued in view of the importance of the future contribution it can make in behalf of the Town.


Retirement Policy


As a result of the sentiment expressed at the annual Town Meeting, a committee was appointed by the selectmen to study our retirement system and all other subjects re-

lated to such benefits. The following is a copy of their report :


"Board of Selectmen Town of Lincoln Massachusetts


The Retirement and Pension Study Committee was appointed by the Board of Selectmen in March, 1959, to review all matters relating to the present pension system, and to conduct such other studies as are deemed advisable in re- spect to the benefits accruing to all full time and casual employees of the Town.


The Massachusetts Retirement Plan covers all employees of the Commonwealth and its political subdivisions. It is administered by 99 separ-


ate Retirement Boards. The Town of Lincoln comes under the jurisdiction of the Middlesex County Retirement Board. Under the contributory retirement law every regular employee of the Town under 60 years of age who receives annual com- pensation of $200 or more must be a member of the Retirement Plan and must contribute 5% of regular pay toward the Retirement Fund. There are cer- tain provisions for early retirement, but retire- ment is compulsory at age 70.


The amount of pension received at retirement is determined by age of the individual, total earnings and the number of years employed as a regular employee of the Town. It should be noted that employees are credited with service for years worked prior to the establishment of the Retirement Plan at no additional cost to the employee.


The retirement deduction is taken from the pay of casual as well as regular employees. However, casual employees may receive their contributions back when they leave the employ of the Town pro- vided they have not reached age 55 (optional re- tirement age). There is a further provision in the law that if upon retirement an employee's pension is less than $120 annually, the total amount withheld is to be returned to the employee in lieu of a pension.

"In order to determine the experiences of other towns, the Committee consulted with Town Offices at Wayland, Sudbury, Weston, Bedford, Concord, Lexington, Acton and Littleton. Inquiries revealed that these towns have experienced no unusual problems in the administration of the Retirement Plan and that casual employees usually request and receive the amounts with- held at the termination of their employment.


As a result of the investigations the Committee submits the following recommendations :


1. When financial assistance from the Town is requested by former casual employees, such assistance, if ap- proved, should be through some means other than a Pension.


2. Contractors and employees of con- tractors doing business with the Town are not eligible to partici- pate in the Retirement Plan because of their services to the Town. It is recommended that this matter be clarified with all contractors.


3. All town jobs should be classified as to regular or casual, and incum- bent informed as to status under the Massachusetts Retirement Plan.


The Committee wishes to express their appre- ciation to Mrs.Louis Paddock, Assistant Treasurer, Town of Lincoln, for the generous contribution of her time and for her assistance during the investi- gation.

The Town Clerk is the official recorder of Town events and activities and issues licenses and certificates. His duties include recording the proceedings at Town Meetings and Elections, and notifying the Selectmen and other officers concerned of appropriations which have been voted.


The record of Registered Voters of Lincoln is kept at the Clerk's office. Persons wishing to become voters in the Town should communicate with the Clerk.


ANNUAL TOWN MEETING March 16, 1959


Pursuant to a Warrant duly served, the Meeting was called to order by the Moderator, Mr. Donald P. Donaldson, at 7:30 o'clock P. M. The return of the Warrant was read, and Reverend Morris R. Robinson opened the meeting with prayer. The Moderator then called attention to Article 1 (Election of Officers), and the following busi- ness was transacted:


Article 2. To bring in their votes for any com- mittees, commissioners, trustees, and other officers re- quired by law to be elected by ballot or otherwise. Voted : That Albert S. Brooks be elected Measurer of Wood and Bark for the ensuing year.


Article 3. To hear and act upon the reports of the Town Officers, Committees, Commissioners and Trustees. Voted: That the reports of the Town Officers, Committees and Trustees, as printed in the Town Report, be accepted; and the reports of the following Committees be accepted as interim reports, and that the Committees and their unexpended appropriations be continued: Hart- well School Building Committee, Library Building Committee, Long Term Capital Requirements Committee, Veterans' Memorial Committee, School Needs Committee, Fire and Police Station Building Committee; and that the following reports be accepted as final: Tennis Court Committee, Mosquito Control Committee.

Voted : That the main motion be amended by increasing item #520 by $1,200.00 and increasing the total by a like amount, and item #504 be amended by an increase of $500.00 to a total of $58,215.00.


Article 6. To determine whether the town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipa- tion of the revenue of the financial year beginning January 1, 1960, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. Article 7. To determine whether the Town will vote to raise and appropriate the sum of $682.79 to pay the following unpaid 1958 bills, or take any other action relative thereto: Legal - $200.00; Schools -- $60.00; Fire and Police Building - $205.05 ; Property Insurance $217.74. Voted : That the Town raise and appropriate the sum of $682.79 to pay the following unpaid 1958 bills : Legal -- $200.00; Schools -- $60.00; Fire and Police Build- ing Maintenance - $205.05; Property Insurance -- $217.74.


Article 8. To determine whether the Town will vote to conduct services on Memorial Day, the thirtieth of May, appoint a committee, raise and appropriate the sum of $200.00, or any other sum, or take any action relative thereto.


Voted : That the Moderator be authorized to appoint a committee of five to plan and carry out exercises on Memorial Day, the thirtieth of May next, and that the Town raise and appropriate the sum of $200.00 for the use of such committee in connection with these exercises.


Article 9. To determine whether the Town will appropriate to Surplus Revenue the unexpended balances re- maining in the following accounts: School House Roof, $565.00; Tennis Courts, $135.10; Elementary School Building Committee, $119.69; Preserving Town Records, $139.94. Voted : That the following unexpended appro- priation balances be rescinded and the amounts returned to Surplus : School House Roof, $565.00; Tennis Courts, $135.10; Elementary School Building Committee, $119.69; Preserving Town Records, $139.94.


Article 10. To determine whether the Town will vote to change the spelling of McIntosh Lane to Mackintosh Lane, the correct spelling of the land donor's name. Voted : That the Town change the spelling of McIntosh Lane to Mackintosh Lane to conform with the name of the land grantor.


Article 11. To determine whether the Town will vote to raise and appropriate a sum not to exceed $1,000.00 for the purchase of approximately 1,200 feet of land, more or less, and freight house situated thereon, belonging to the

Boston and Maine Railroad, and located at the railroad tracks on Lincoln Road, or take any other action relative thereto.


Voted: That the selectmen be and hereby are authorized and empowered in the name and on behalf of the Town to acquire in fee by purchase a certain parcel of land with buildings thereon, now owned by the Boston and Maine Railroad, as shown on sketch plan entitled "Land of the Boston and Maine Railroad (Freight House) in Lincoln, Mass." dated March, 1959, Snelling, Hilton and Associates, bounded and described as follows:


Beginning at the southeasterly corner of the premises to be conveyed as shown on said plan, thence running along Lincoln Road S. 68º 57' 31" W. twenty and eighteen hundredths (20.18) feet to a corner at Lincoln Road and other land of the Boston and Maine Railroad; thence turning and running by land of Boston and Maine Railroad N. 28º 37' 29" W. fifty-one and seventeen hun- dredths (51.17) feet to a corner at other land of the Boston and Maine Railroad; thence turning and running by land of the Boston and Maine Railroad N. 61º 22' 31" E. twenty (20.00) feet to a corner at land of Boston and Maine Railroad and its side line of location; thence turning and running along the railroad side line of loca- tion S. 28 37' 29" E. fifty-three and eighty-three hun- dredths (53.83) feet to the point of beginning; containing 1,050 square feet according to said plan; and that there be and there is hereby appropriated from available funds in the treasury for said purpose the sum of one thousand dollars ($1,000.00).
