"Principal of fund appropriated in accordance with the provi- sion of Ch. 5, Acts of 1943. Excerpt from Ch. 5, Acts of 1943: 'No bonds held under this act may be sold prior to the termination of the existing state of war. The proceeds from the sale of any such bonds shall be used only for purposes for which the city, town or district may borrow money for a period of not less than ten years in accordance with Sections 7 and 8 of Ch. 44 of the General Laws; provided, that such proceeds may, in each instance with the approval of the Board established under Sec. 1, of Ch. 49 of the Acts of 1933, be appropriated and used in whole or in part for other purposes.'"


KING CAESAR POOR AND HOSPITAL FUND:


On February 15, 1916, in accordance with the terms of the will of William Bradford Weston, the sum of $6,158.00 was deposited with the Massachusetts Hospital Life Insurance Company to be held in trust until July 14, 2015.


"On July 14, 2015, the principal sum and accumulations of this policy shall be divided by said Company into two parts, one of one-eight (1/8) and one of seven-eights (7/8), issuing therefor two new policies to provide as follows:


First Policy - being one-eight (1/8) of said fund and ac- cumulations. The said Company shall continue to hold said fund and pay the net income thereof quarter-yearly (less any charge that may be made for said quarterly payments) to the Treasurer from time to time of the testator's native Town of Duxbury, in Plymouth County, Massachusetts, to be ex- pended by the proper authorities of said Town for the relief of the old and worthy poor of said Town, who are not from time to time living in the Poorhouse so-called.

This fund is created in memory of the testator's great- grandfather, Ezra Weston, formerly known by his fellow townsmen and County as "King Caesar", and his son Ezra, the testator's grandfather, two of the most prominent, ener- getic, active, persevering and wealthiest citizens of the Town, and under the firm name of E. Weston and Son were said to be rated to be the largest ship owners in the United States. This fund shall always be known by the name of "King Caesar's Poor Fund".


Second Policy - (Being seven-eighths (7/8 ) of said fund and accumulations ). The said Company shall continue to hold said fund, and it may at any time thereafter purchase from the Principal thereof suitable land in said Duxbury (unless the said Town or some well-disposed, kind-hearted citizen gives a lot) and erect thereon a small fire-proof Hospital with all the then modern improvements, to cost not more than one-quarter of the then value of the said seven-eighths (7/8) of said accumulated fund, as it shall then exist; and to hold the balance of said fund and expend the income thereof towards the running expenses of said Hospital, add- ing any income not appropriated for this purpose to the principal.


All the beds in said Hospital shall be absolutely free to all citizens of the Town of Duxbury, unless they are perfectly able to pay, and said Hospital shall be known as “King Caesar's Hospital"."


At the present time there are 2,100.28 units of Massachusetts Life Fund valued at $45,009.00.

"I give and bequeath to the Inhabitants of the Town of Dux- bury, Massachusetts, for educational purposes, the sum of Fifteen Hundred ($1,500.00) Dollars. Said sum shall be held in Trust by the Town of Duxbury and the Principal thereof shall be invested so that the members of the School Committee of said Town may make an annual award to a member of each year's graduating class of the high school, who intends to pursue his or her education further, either in a college, university, trade school, or other institution of higher learning. It is my desire that preference be given to a student who may be in need of financial assistance. The amount of such award shall be determined by the Trustees and shall be paid out of the annual income or out of the undistributed income of this fund.


The term 'annual income' shall be the 'net income', as herein defined, for the 'fiscal year' of the Fund which ends prior to the date of graduation for which such award is to be made. The term 'net income' as herein used shall include income received from all sources, other than gains from sales or exchanges of property, held by such Fund, after deducting all expenses properly chargeable against Income. Any gains or losses from sales or exchanges of property held by such Fund shall be regarded as an addition to or as a charge against Principal. The fiscal year of such Fund shall be the twelve month period commencing with the first day of the month in which such Fund shall be created."

REPORT OF THE FINANCE COMMITTEE


The Duxbury Finance Committee held its organizational meeting in May at which time the newly appointed members, John T. Hathaway, Jr., Edward B. Peters and Theodore H. Reed were welcomed and the following officers were elected: Chairman, Edwin D. Ryer; Vice-Chairman, Henry W. Palmer, and Secretary, Theodore H. Reed. John T. Hathaway, Jr. was elected to serve as the Finance Committee member on the Per- sonnel Board.


During the year 1959 the Finance Committee approved the following transfers from the $10,000 Reserve Fund appro- priated to take care of unusual and unforeseen expenses in- curred by Town Departments.

The Finance Committee is currently engaged in reviewing and discussing the proposed budgets for 1960 with the Select- men and the Heads of Town Departments. Committee recom- mendations will appear in the Warrant for the Annual Town Meeting or will be made at that meeting.


In the Warrant for the 1959 Town Meeting the Finance Committee pointed out that it appeared some savings in insur- ance premiums paid by the Town might be made. To advise

them on this situation, the Selectmen appointed an Insurance Committee consisting of the Town Treasurer and two experi- enced insurance men, neither of whom are interested in handl- ing the Town insurance. Members of the Committtee are Mau- rice Shirley, Town Treasurer; Theodore W. Page, partner in the insurance firm of Hale & Co. and former Chairman of the Town Finance Committee and O. E. Ringquist, Vice-president of the Liberty Mutual Insurance Co. and currently a member of the Town Finance Committee. This Committee after care- ful study has submitted a report with recommendations to the Selectmen. The recommendations, if followed, should result in improved insurance coverage at lower cost.


The Finance Committee in the 1959 Warrant also ex- pressed concern about the growing subsidy for the Mayflower Cemetery. It appears that the Cemetery Trustees are making progress toward halting this rising cost and the Finance Com- mittee has urged them to continue their efforts toward making this a true enterprise account.


In reviewing budgets and making recommendations your Finance Committee endeavors to reflect the point of view of the tax-payer who wishes to live in a well run Town, pay a fair fee for essential services and eliminate non-essentials.


The members of the Finance Committee take this oppor- tunity to thank the Town's elected officials, Department Heads and other employees for assisting the Committee in its task.

REPORT OF THE TOWN ACCOUNTANT


To the Honorable Board of Selectmen:


I am pleased to submit the annual statement of all receipts and expenditures of the Town of Duxbury for the financial year ending December 31, 1959. This statement is supplemented by additional reports and schedules which assist the individual in understanding the town's business affairs.


Our State Audit, the first since July of 1957, commenced on October 24, 1959 and your three fiscal officers were pleased to observe that their work had been "tops" for the unusually long period between official visits from the representatives of the State's Bureau of Accounts.


Your Accountant attended the Autumn session of the Massachusetts Municipal Auditors and Accountants Associa- tion, held in Great Barrington, where new legislation was the main topic of lectures and discussion periods.


Performance budgeting and improved methods of pre- senting financial statements and their accompanying letters of transmittal are receiving the attention of the New England States and Municipal Finance Officers Association, which met in Man- chester, Vermont. Your Accountant, who boasted last year of enjoying a long fog-bound flight, took a ride this year (personal expense) in the Chair Ski Lift at Mount Bromley and was frankly just plain scared. After that ride it was heavenly to feel the floor under foot while attending to the serious business of the conference.
